About protection of the constitutional system in field of activity of the religious organizations

Verkhovna Rada of Ukraine,

based on the principles of article 35 of the Constitution of Ukraine, articles 9 and 11 of the European convention on human rights providing rights to liberty of conscience, religion and consolidation in the religious organizations and possibility of restriction of the appropriate rights with the law for the benefit of homeland or public security, protection of the rights and freedoms of other persons

recognizing obligation of the state to protect right to liberty of conscience, religion and consolidation in the religious organizations, including the right of citizens to change religion and beliefs and the right of the religious organizations to change subordination to the religious centers (management), from illegal encroachments from any persons, religious or other organizations, foreign states,

considering the armed aggression of the Russian Federation against Ukraine, and noting support of this aggression by Russian Orthodox Church that numerous illegal actions of Russian Orthodox Church and the religious organizations subordinated to it in the territory of Ukraine create threat of homeland and public security, to the rights and freedoms of citizens of Ukraine,

considering the decision of the National Security and Defense Council of Ukraine on separate aspects of activities of the religious organizations in Ukraine and applications of personal special economic and other rationing measures (sanctions),

adopts this Law.

Section I. Features of activities of the foreign religious organizations in Ukraine

Article 1. Law coverage

1. This Law for the purpose of protection of homeland and public security, human rights and freedoms determines features of activities of the foreign religious organizations in Ukraine.

2. Any of provisions of this Law cannot be interpreted as restriction of freedom of shriving of religion or beliefs, the rights to observance of religious practice and ritual ceremonies.

Article 2. Organizational bases of functioning of the foreign religious organizations

1. For the purposes of this Law the foreign religious organization is the religious organization (including religious management, consolidation, the center) as the legal entity formed and/or registered according to the legislation of other state has the location outside Ukraine.

The foreign religious organizations can perform activities in Ukraine provided that their activities do not harm homeland or public security, protection of public procedure, health, morals, the rights and freedoms of other persons.

2. In the territory of Ukraine activities of the foreign religious organizations which answer at the same time following criteria are forbidden:

1) are in the state which acknowledged performed or performing the armed aggression against Ukraine and/or temporarily occupying part of the territory of Ukraine;

2) directly or indirectly (including through public statements of heads or other governing bodies) support the armed aggression against Ukraine.

To the foreign religious organizations which are in the state which acknowledged performed or performing the armed aggression against Ukraine and/or temporarily occupying part of the territory of Ukraine, the foreign religious organizations belong (including religious managements, associations, the centers) the leading center (management) of which is outside Ukraine in the relevant state aggressor.

3. The foreign religious organizations which activities are forbidden according to this Article are determined by article 3 of this Law.

If activities of the foreign religious organization correspond to the criteria determined by part two of this Article what became known after entry into force of this law, the prohibition of activities of such foreign religious organization is performed by modification of part one of article 3 of this Law.

Cancellation of prohibition of activities in Ukraine of the foreign religious organizations established by this Law is performed by introduction of amendments to this Law.

Article 3. The foreign religious organizations which activities in Ukraine are forbidden

1. Considering that the Russian Orthodox Church is ideological continuation of the mode of the state aggressor, activities in Ukraine are forbidden to Russian Orthodox Church by the accomplice of the war crimes and crimes against humanity committed on behalf of the Russian Federation and ideology of "the Russian world".

2. Activities of the religious organizations affiliated with the foreign religious organization which activities in Ukraine are forbidden according to part one of this Article including it is direct or as the component of other religious organization, or in the presence of other signs, the stipulated in Clause 5-1 Law of Ukraine "About liberty of conscience and the religious organizations", is not allowed and such religious organizations stop in the procedure established by the law.

The list of the religious organizations in Ukraine affiliated (connected by one or several signs determined by article 5-1 of the Law of Ukraine "About liberty of conscience and the religious organizations") with the foreign religious organization which activities in Ukraine are forbidden affirms the order of the central executive body realizing state policy in the sphere of religion and will be promulgated on its official website.
