About approval of the Procedure for carrying out logical and arithmetic control of the declaration of person authorized on accomplishment of functions of the state or local self-government

According to Article part two 7, Item 5 parts one of Article 12, parts three of article 51-1 of the Law of Ukraine "About prevention of corruption" PRIKAZYVAYU:

1. Approve the Procedure for carrying out logical and arithmetic control of the declaration of person authorized on accomplishment of functions of the state or local self-government which is applied.

2. To submit to management of conducting complete checks this order on state registration to the Ministry of Justice of Ukraine.

3. I reserve control over the implementation of this order.

4. This order becomes effective from the date of its official publication.

Procedure for carrying out logical and arithmetic control of the declaration of person authorized on accomplishment of functions of the state or local self-government

1. This Procedure determines the procedure of carrying out by the National agency concerning prevention of corruption (further - the National agency) logical and arithmetic control of the declaration of person authorized on accomplishment of functions of the state or local self-government, provided to the Unified state register of declarations of persons authorized on accomplishment of functions of the state or local self-government (further - the Register).

Action of this Procedure does not extend to the declarations provided by separate categories of persons according to article 52-1 of the Law of Ukraine "About prevention of corruption" (further - the Law).

2. In this Procedure terms are used in the following values:

weight coefficient of discrepancies (risks) - the numerical indicator determining the weight of discrepancy (risk) in the declaration established when carrying out logical and arithmetic control of the declaration;

the declaration declaration of person authorized on accomplishment of functions of the state or local self-government, and in case of submission of the corrected declaration - the last corrected declaration, except the declarations submitted according to paragraph one of part two and part three of article 45 of the Law;

subject to declaring object, data on which are specified or shall be specified in the declaration according to article 46 of the Law;

the previous declaration - the last annual declaration submitted for the previous accounting year, and in case of lack of such declaration - the last declaration of other type which covers the previous accounting year (the period from January 01 to December 31 inclusive).

Other terms are used in the values specified in the Law.

3. The national agency carries out by software of the Register logical and arithmetic control of the declaration submitted to the Register.

The national agency determines rules of logical and arithmetic control for declaration risks assessment which are part of program code of the Register and are not subject to promulgation and distribution.

4. Carrying out logical and arithmetic control of the declaration begins from the date of, the submission of the corrected declaration, or the expiration following behind day for submission of the corrected declaration according to paragraph one of part four of article 45 of the Law.

5. Logical and arithmetic control of the declaration is carried out on set of the following stages:

1) detection of discrepancies (risks) in the declaration by the automated comparison of the data specified in the declaration with the data which are available in the registers, databanks, other information and communication and help systems including containing information with limited access, holder (administrator) of which are state bodies, local government bodies which may contain information on subjects to declaring, to which the National agency has the automated access.

Data from registers, databanks, other information and communication and help systems including containing information with limited access, the National agency receives by electronic information exchange by means of program interfaces of electronic information resources according to procedures, protocols of the automated exchange of information or the agreements on information exchange signed between the National agency and holders (administrators) of the corresponding registers, databanks, other information and communication and help systems;

2) detection of other discrepancies (risks) in the declaration by application of rules of logical and arithmetic control for declaration risks assessment, namely:

the analysis and comparison of the data specified in the declaration, for the purpose of establishment of compliance of the data specified in it or detection of their discrepancy (risk);

the analysis and comparison of the data specified in the declaration with the data specified in the previous declaration for the purpose of establishment of logical compliance and determination of qualitative and quantitative indices of dynamics of changes of data on subjects to declaring;

processings of the numerical (cost) values specified in the declaration by their comparison among themselves and with the values specified in the previous declaration and carrying out calculations by means of arithmetic transactions (formulas), including concerning difference of the sizes of expenses on acquisition of assets to the gained income;

3) determination of weight coefficients of discrepancies (risks) in the declaration.

6. By results of the logical and arithmetic control of the declaration which is carried out by the National agency the declaration risks assessment in accordance with the established procedure is performed.
