Chapter I. General provisions

Article 1. Basic concepts

In this Federal Law the following basic concepts are used:

seed farming - activities for production, procurement, processing, storage, realization, transportation and use of seeds of agricultural and forest plants, and also high-quality control and seed control;

seeds - the parts of plants (tubers, bulbs, fruits, saplings, actually seeds, compound fruits, parts of aggregate fruits and others) applied to reproduction of grades of agricultural plants or to reproduction of types of forest plants;

high-quality qualities of seeds - set of the signs characterizing belonging of seeds to certain grade of agricultural plants;

sowing qualities of seeds - set of the signs characterizing suitability of seeds for crops (landing);

batch of seeds - certain quantity homogeneous by origin and to quality of seeds;

approbation of crops - inspection of high-quality crops for the purpose of determination of their varietal purity or high-quality typicalness of plants, contaminations of high-quality crops, defeats by diseases and vermin damages of plants;

registration of crops - survey of high-quality crops without selection of sheaf for approbation with the subsequent registration in accordance with the established procedure results of survey;

seeds of the protected grade - seeds of the grade registered in the State register of the protected selection achievements;

varietal purity - the relation of number of stalks of agricultural plants of the main grade to number of all developed stalks of agricultural plants of these culture;

high-quality typicalness - indicator of varietal purity perekrestnoopylyayushchikhsya plants;

agricultural plants - grain, leguminous, fodder, oil, essential oil-bearing, technical, vegetable, drug, flower, fruit, berry plants, potatoes, sugar beet, the grapes used in farm-production;

forest plants - the forest wood and shrubby plants used in forestry.

Article 2. The legislation of the Russian Federation in the field of seed farming

The legislation of the Russian Federation in the field of seed farming consists of this Federal Law and the Federal Laws and other regulatory legal acts of the Russian Federation, and also the laws and other regulatory legal acts of subjects of the Russian Federation adopted according to it.

The federal executive bodies exercising control in the field of seed farming can issue acts which govern the relations arising in the field of seed farming in cases and in limits which are provided by this Federal Law, other laws, other regulatory legal acts of the Russian Federation.

Article 3. The legislation of the Russian Federation in the field of seed farming and the international agreements of the Russian Federation

If the international treaty of the Russian Federation establishes other rules, than those which are stipulated by the legislation the Russian Federation in the field of seed farming are applied rules of the international treaty.

The decisions of interstate bodies made based on provisions of international treaties of the Russian Federation in their interpretation contradicting the Constitution of the Russian Federation are not subject to execution in the Russian Federation. Such contradiction can be established according to the procedure, determined federal constitutional by the law.

Article 4. The relations regulated by the legislation of the Russian Federation in the field of seed farming

The legislation of the Russian Federation in the field of seed farming governs the relations arising in connection with implementation of activities for production, procurement, processing, storage, realization, transportation and use of seeds of agricultural plants which grades are included in the State register of the selection achievements allowed to use and also in connection with the organization and carrying out the state control (supervision) in the field of seed farming.

The relations arising in connection with implementation of activities for procurement, processing, storage, realization, transportation and use of seeds of forest plants and also in connection with the organization and carrying out seed control in forestry, are regulated by the legislation of the Russian Federation in the field of seed farming if other is not established by the forest legislation of the Russian Federation.

The property and administrative relations arising in the field of seed farming are regulated by the legislation of the Russian Federation in the field of seed farming according to the civil and administrative legislation of the Russian Federation.

Chapter II. Categories of seeds

Article 5. Categories of seeds of agricultural plants

Depending on stage of reproduction of grades of agricultural plants the following categories of seeds of agricultural plants are determined:

original;

elite (elite seeds);

reproductive (seeds of the first and subsequent reproductions, and also hybrid seeds of the first generation).

Production methods of seeds of the corresponding categories are established by specially authorized federal body of management of agricultural industry.

Article 6. Original seeds

Original seeds are the seeds of agricultural plants made by originator of grade of agricultural plant or person authorized by it.

Originator of grade of agricultural plant is the physical person or legal entity which created, removed, revealed grade of agricultural plant and (or) provides its preserving and data on which are entered in the State register of the selection achievements allowed to use.

The regulations on registration of originator of grade of agricultural plant approve specially authorized federal body of management of agricultural industry.
