About verification regime of trade in strategic goods

This law:

– partially shifts Articles 1, of 2, part (1) Articles 3, of part (1) and (2) Articles 4, part (1) Articles 5, of part (1) and (2) Articles 6, of part (1) and (2) Articles 8, of part (2), (3) and (5) Articles 12, Article 15, part (1) Articles 16, part (2) Article 21 and Article 27 of Regulations (EU) 2021/821 of the European parliament and Council of the May 20, 2021 setting the mode of the Union on export control, intermediary activities, technical assistance, transit and transfer of dual-use goods (the processed version) published in the Official magazine of the European Union by L 206 of June 11, 2021 with the last changes made by the Delegated regulations (EU) 2023/2616 of the Commission of September 15, 2023 about modification of Regulations (EU) 2021/821 of the European parliament and Council regarding the inventory of dual purpose;

– will approve the national regulatory base with the Common position 2008/944/PESC of Council of December 8, 2008, determining general rules which regulate export control of military technologies and the equipment, published in the Official magazine of the European Union by L 335 of December 13, 2008, with the last changes made by the Decision (PESC) 2019/1560 of Council of September 16, 2019.

Chapter I General provisions

Article 1. Subject and subjects of this law

(1) This law regulates criteria and verification regime of trade in strategic goods, establishes the general regulatory base for activities for trade in strategic goods, determines competence of bodies of the public power in control of trade in strategic goods for the purpose of ensuring national security of the Republic of Moldova, promotion of foreign policy of the country and participation in international efforts by control of trade in strategic goods.

(2) Subjects of this law are:

a) The national commission on control of trade in strategic goods (further - the Commission). Information on activities of the Commission is information of limited access;

b) competent authorities in the field of trade in strategic goods;

c) persons performing trade in strategic goods.

Article 2. Basic concepts

For the purposes of this law the following basic concepts are used in value:

1) additional (adjacent) documents – the documents published for assistance to trade in strategic goods:

a) the international certificate for import – the document containing confirmation by body issuer of the fact that the importer shall import strategic goods to the Republic of Moldova within the amount and quantity specified in this certificate and not to re-export the corresponding goods to other countries of destination without the consent of body issuer;

b) the certificate of check of delivery – the document containing confirmation by body issuer of the fact that controlled strategic goods were imported to the Republic of Moldova on the amount and in quantity, specified in the appropriate certificate;

c) the end-user certificate – the document containing confirmation by body issuer on the basis of the declaration of the end user of the fact that the end user shall use the imported strategic goods within the amount and quantity specified in the appropriate certificate and not to re-export these goods to other countries of destination, not to move strategic goods on the territory of the country and not to redirect strategic goods for other end use without written consent of body issuer;

d) the notification – the document issued by body issuer on the goods which are not entered in the lists of the strategic goods for submission to Customs Service which are subject to control approved by the Government;

2) weapons of mass destruction – chemical, bacteriological (biological), radiological, nuclear weapons;
