About approval of the Approval procedure of minimum admissible export prices on separate types of goods

According to part four of article 19-2 of the Law of Ukraine "About foreign economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve the Approval procedure of minimum admissible export prices on separate types of the enclosed goods.

2. This resolution becomes effective in ten days from the date of its publication.

Approval procedure of minimum admissible export prices on separate types of goods

1. This Procedure determines the mechanism of approval of minimum admissible export prices on separate types of the goods classified by codes according to UKTVED 0409 00 00 00, 0802 31 00th 00, 0802 32 00th 00, of 1001, of 1002, of 1003, of 1004, of 1005, of 1201, of 1205, 1206 of 00, of 1507, of 1512, of 1514, 2306 (further - separate types of goods).

2. Determination of level of minimum admissible export prices on separate types of goods is performed by Minagropolitiki taking into account conditions of deliveries according to the international rules of interpretation of the commercial terms "Incoterms" (further - conditions of deliveries).

3. Minimum admissible export prices on separate types of goods taking into account conditions of deliveries are determined in US dollars for 1 kilogram.

4. Minimum admissible export prices on separate types of goods are calculated under the terms of deliveries which export volume was the greatest for the last five years, specified in appendix 1. Minimum admissible export prices on separate types of goods on other conditions of deliveries are equated to calculated according to appendix 2.

5. Minimum admissible export prices on separate types of goods are calculated based on the depersonalized information of State Customs Service on export of separate types of goods by customs declarations in form of the single administrative document taking into account conditions of deliveries for the last month using ten-percentage discount on the following formula:

6. Reference minimum export prices on separate types of goods are calculated using quantile method with use of the fifth percentile based on the depersonalized information of State Customs Service on export of separate types of goods by customs declarations in form of the single administrative document taking into account conditions of deliveries for the last month.

If reference minimum export price of separate type of goods on separate condition of deliveries more than twice less weighted average price of the corresponding goods on the same condition of deliveries is calculated, reference minimum export price is determined as half of weighted average price.

Weighted average price of goods for the corresponding month is calculated by formula:

where SZTs - weighted average price of goods for the corresponding month, dollars of the USA / for 1 kilogram;

Ts1... the goods n-price on separate condition of deliveries in the corresponding month, dollars of the USA / for 1 kilogram;

K1... n-goods quantity on separate condition of statements in the corresponding month, kilograms;

If last month export of separate goods was not performed, calculation of minimum admissible export price of separate type of goods is perfromed based on the depersonalized information of State Customs Service on export of separate types of goods by customs declarations in form of the single administrative document taking into account conditions of deliveries for the last 12 months.

The State Customs Service one-timely submits to Minagropolitiki the depersonalized information on export of separate types of goods in 18 months preceding month in which the regime of export providing is introduced.

7. The State Customs Service monthly to the 5th and if such day falls on non-working, - for the working day following it, submits to Minagropolitiki the depersonalized information on export of separate types of goods for the last month.

Content, details and data representation form are determined by the protocol to the Agreement on information cooperation between State Customs Service and Minagropolitiki, the prisoner in accordance with the established procedure.

8. Minagropolitiki based on information of State Customs Service determines minimum admissible export prices of each type of goods taking into account conditions of deliveries and monthly to the 10th and if such day falls on non-working, - for the working day following it, provides approval of minimum admissible export prices by adoption of the relevant decision (order).

9. For determination of level of minimum admissible export prices for each type of goods which declaring is performed based on the forward contract Minagropolitiki based on information of State Customs Service approves minimum admissible export prices which are calculated as reference minimum export prices according to Item 6 of this Procedure by adoption of the relevant decision (order):

once for the last six calendar months (for every month separately), preceding date of application by the Cabinet of Ministers of Ukraine of the mode of export providing; and

to the 10th following after month of introduction of the mode of export providing for month in which the regime of export providing is introduced.

10. Minagropolitiki no later than the next day after decision making (order), the stipulated in Item 9 presents About, submits information on approval of minimum admissible export prices to State Customs Service and GNS in machine-readable format.

11. Information on approval of minimum admissible export prices is posted on the official website of Minagropolitiki no later than the next working day after adoption of the relevant decision (order). By the time of placement of new prices the approved minimum admissible export prices on the corresponding goods for the last month posted on the official website by Minagropolitiki are applied.

12. Minimum admissible export prices are applied from the date of, their placement following behind day on the official website of Minagropolitiki.
