About protection of the population against tuberculosis

This Law establishes bases of state policy on fight against tuberculosis in the Republic of Tajikistan, determines organizational and legal order of regulation of actions for protection of the population against tuberculosis, and also regulates the rights, obligations and social guarantees of the population in case of disease of tuberculosis.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

tuberculosis - infectious disease which causative agents are tuberculosis microbacteria which extend in generally airborne way;

- active form of tuberculosis - form of tuberculosis which signs of activity are established as a result of carrying out clinical, laboratory, radiological and other trials;

- infectious form of tuberculosis - the disease form dangerous to people around in connection with allocation to the external environment of microbacteria of tuberculosis;

- antituberculous care - set of the social, medical, sanitary and hygienic and anti-epidemic actions directed to identification, inspection and treatment, including obligatory inspection and treatment, dispensary observation and rehabilitation of the TB patients who are carried out in the hospital and (or) on an outpatient basis according to the procedure established by this Law and other regulatory legal acts of the Republic of Tajikistan;

- the risk group - persons, the most subject to risk to get sick with tuberculosis, including: contact with TB patients, the labor migrants, HIV - infected the women who are not observing intervals between childbirth, the children who did not receive vaccination of BTsZh, the prisoners sick with diabetes and chronic diseases of lungs;

- prevention of tuberculosis - set of the actions directed to the prevention of spread of tuberculosis and its early identification;

- national system of fight against tuberculosis - the system of fight against tuberculosis installed by the state which is based on activities of national network of organizations of antitubercular service, general medical network including primary health care, and educational institutions within which activities for effective identification and treatment of TB patients are developed, planned and performed;

TB facilities - the medical institutions which are giving antituberculous care and performing prevention of tuberculosis, including specialized TB facilities, organizations of primary health care, medical TB facilities of system of corrective cases, medical educational institutions of the highest professional and post-qualifying education, having the relevant divisions, sanitary and epidemiologic and veterinary organizations.

Article 2. Legislation of the Republic of Tajikistan on protection of the population against tuberculosis

The legislation of the Republic of Tajikistan on protection of the population against tuberculosis is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by the Republic of Tajikistan.

Article 3. Application of this Law

Operation of this Law extends to citizens of the Republic of Tajikistan, foreign citizens, refugees, forced migrants and stateless persons, and also on the physical persons and legal entity giving antituberculous care in the territory of the Republic of Tajikistan.

Article 4. Financing of activities for protection of the population against tuberculosis

Financing of activities for protection of the population against tuberculosis, including scientific research in this area, has priority character and is performed for the account:

- means of the government budget;

- means of the trust funds;

- the funds allocated on voluntary and compulsory medical insurance;

- voluntary contributions and donations of physical persons and legal entities;

- other sources which are not forbidden by the legislation of the Republic of Tajikistan.

Article 5. Powers of public authorities of the Republic of Tajikistan on protection of the population against tuberculosis

In the field of protection of the population against tuberculosis treat powers of public authorities of the Republic of Tajikistan:

- implementation of state policy on protection of the population against tuberculosis in the Republic of Tajikistan;

- development and acceptance of the regulatory legal acts directed to protection of the population against tuberculosis;

- determination of procedure for rendering antituberculous care to citizens in the territory of the Republic of Tajikistan;

- control of execution of the legislation of the Republic of Tajikistan on protection of the population against tuberculosis;

- implementation of the state sanitary and epidemiological surveillance and organization of events on protection of the population against tuberculosis;

- development, approval and implementation of target programs for protection of the population against tuberculosis;

- development of rules, standard rates, requirements and state standards on protection of the population against tuberculosis;

- ensuring the state control of production, storage and transportation of antitubercular medicines (vaccines) and immunobiological medicines for diagnostics and prevention of tuberculosis for the purpose of ensuring their quality, efficiency and safety;

- organization of the state statistical observation for protection of the population against tuberculosis;

- ensuring economic, social and legal measures, including actions for protection of the rights and freedoms of persons to whom extends, operation of this Law;

- support and development of personnel capacity of antitubercular service;

- other powers, stipulated by the legislation the Republic of Tajikistan in the field of protection of the population against tuberculosis.

Article 6. Powers of local executive bodies of the government on protection of the population against tuberculosis

In the field of protection of the population against tuberculosis treat powers of local executive bodies of the government:

- control of observance of medical and sanitary regulations and rules on protection of the population against tuberculosis;

- providing the rights and freedoms of suffering from tuberculosis and other persons to which operation of this Law extends;

- development of network and strengthening is material - technical base of the organizations providing medical care by the TB patient;

- ensuring availability of medical care by the patient, to persons having tuberculosis (active form of tuberculosis and risk group) and control of observance of the quality standards of the medical and sanitary help given them;
