About approval of the Procedure for delivery of health care to the people having tuberculosis from among persons detained or which keep in organizations of execution of punishments

According to part one of article 19 of the Law of Ukraine "About overcoming tuberculosis in Ukraine" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for delivery of health care to the people having tuberculosis from among persons detained or which keep in organizations of execution of punishments.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

Procedure for delivery of health care to the people having tuberculosis from among persons detained or which keep in organizations of execution of punishments

1. This Procedure determines the procedure of the organization of obligatory routine medical examination, inspection and treatment of the people having tuberculosis:

from among persons detained who keep in pre-trial detention centers of the Public criminal and executive service (further - pre-trial detention centers), from among persons who keep in organizations of execution of punishments, - healthcare institutions of the Public criminal and executive service and the regional ftiziopulmonologichesky centers in administrative and territorial units in the territory of which the relevant organizations of execution of punishments and pre-trial detention centers are located (further - the regional ftiziopulmonologichesky centers);

from among persons detained who keep in temporary detention centers, - the regional ftiziopulmonologichesky centers.

2. In this Procedure terms are used in the value given in Bases of the legislation of Ukraine on health protection, the Laws of Ukraine "About overcoming tuberculosis in Ukraine", "About pre-trial detention", "About the Public criminal and executive service of Ukraine", "About National guard of Ukraine" and "About National police".

3. The list of the regional ftiziopulmonologichesky centers for delivery of health care to the people having tuberculosis from among persons detained who keep in pre-trial detention centers and persons who keep in organizations of execution of punishments is determined by Council of Ministers of the Autonomous Republic of Crimea, structural divisions concerning health care of the regional, Kiev and Sevastopol city state administrations and public institution "Center of health care of the Public criminal and executive service of Ukraine". The specified list in 10-day time from the date of its approval goes to popularity of Department concerning execution of criminal penalties.

The list of the regional ftiziopulmonologichesky centers for delivery of health care to the people having tuberculosis from among persons detained who keep in IVS is determined by Council of Ministers of the Autonomous Republic of Crimea, structural divisions concerning health care of the regional, Kiev and Sevastopol city state administrations and the Ministry of Internal Affairs.

4. Obligatory routine medical examinations on detection of tuberculosis at persons detained who keep in pre-trial detention centers or persons who keep in organizations of execution of punishments (except the case specified in the paragraph the second this Item) are carried out in organizations of execution of punishments and pre-trial detention centers.

Performing obligatory routine medical examinations on detection of tuberculosis at the convicts to restriction or imprisonment serving sentence in correction centers and corrective labor colonies of the minimum level of safety with the facilitated conditions of keeping is provided with the regional ftiziopulmonologichesky centers.

Rules of performing obligatory routine medical examinations on detection of tuberculosis at persons detained who keep in pre-trial detention centers or persons who keep in organizations of execution of punishments are determined by the Ministry of Health and Ministry of Justice.

5. The regional ftiziopulmonologichesky centers provide performing obligatory routine medical examinations on detection of tuberculosis at persons detained who keep in temporary detention centers, by rules certain Ministry of Health and the Ministry of Internal Affairs.

6. Medical care is provided to persons detained who keep in pre-trial detention centers in stationary conditions in sectors for content of persons detained of specialized tubercular hospitals of the Public criminal and executive service.

In administrative and territorial units in the territory of which there are no specialized tubercular hospitals of the Public criminal and executive service, to persons detained who keep in pre-trial detention centers, the TB patient with bakteriovydeleniye medical care is provided in conditions of hospital of the regional ftiziopulmonologichesky centers.

Medical care is provided to persons detained who keep in pre-trial detention centers, the TB patient without bakteriovydeleniye in stationary conditions in the healthcare institutions of the Public criminal and executive service placed in the territory of pre-trial detention centers.

Medical care is provided to people with latent tuberculosis infection from among persons detained who keep in pre-trial detention centers in out-patient conditions in the healthcare institutions of the Public criminal and executive service placed in the territory of pre-trial detention centers.

7. Medical care is provided to persons who keep in organizations of execution of punishments in specialized tubercular hospitals of the Public criminal and executive service (except persons specified in paragraph three of this Item).

In case of weight of condition of the patient or need of urgent holding medical and diagnostic actions the people having tuberculosis from among persons sentenced to imprisonment can receive medical care in the conditions of hospital of the regional ftiziopulmonologichesky centers.

To the people having tuberculosis from among the persons sentenced to imprisonment, serving sentence in corrective labor colonies of the minimum level of safety with the facilitated conditions of keeping, medical care is provided in the regional ftiziopulmonologichesky centers.

Medical care is provided to people with latent tuberculosis infection from among persons who keep in organizations of execution of punishments in out-patient conditions in the healthcare institutions of the Public criminal and executive service placed in the territory of organizations of execution of punishments.
