About approval of the Regulations on the organization of ensuring smooth functioning in the conditions of the special period of bank system of Ukraine, activities of non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank of Ukraine exercises

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", for the purpose of ensuring smooth functioning and protection of critical infrastructure of bank system of Ukraine, activities of non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank of Ukraine exercises, in the conditions of the special period of board of the National Bank of Ukraine decides:

1. Approve Regulations on the organization of ensuring smooth functioning in the conditions of the special period of bank system of Ukraine, activities of non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank of Ukraine (further - the Provision) which is applied exercises.

2. To banks of Ukraine, branches of foreign banks, non-bank financial institutions and other persons which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank of Ukraine, taking into account requirements of the Provision exercises:

1) within six months from the date of entry into force of this resolution to develop and approve internal documents concerning ensuring smooth functioning in the conditions of the special period;

2) within six months from the date of entry into force of this resolution to provide to the National Bank of Ukraine information electronically on the developed internal documents concerning ensuring smooth functioning in the conditions of the special period approved by authorized body of management of bank, non-bank financial institution and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank of Ukraine, and also copies of documents on their approval exercises;

3) to provide possibility of operational change of the modes of functioning, activities adaptation / information resources by enhancement of the management system of smooth functioning entered according to requirements of regulatory legal acts of the National Bank of Ukraine taking into account requirements to ensuring functioning in the conditions of the special period.

3. Department of strategy and development (Arsen Makarchuk) after official publication to inform banks of Ukraine, non-bank financial institutions and other persons which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities exercises the National Bank of Ukraine, information on adoption of this resolution.

4. To impose control over the implementation of this resolution on the Chairman of the National Bank of Ukraine Andrey Pyshny.

5. The resolution becomes effective from the date of, its official publication following behind day.

I. General provisions

1. This Provision is developed according to the Law of Ukraine "About the National Bank of Ukraine", for the purpose of ensuring smooth functioning of bank system of Ukraine, activities of non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank of Ukraine exercises (further - National Bank), and determines features of their functioning and activities, and also implementation by National Bank of supervision of their activities in case of approach of the special period.

2. Terms in this Provision are used in the following value:

1) the protocol - the internal document which determines operations procedure and the list of the measures taken by banks, branches of foreign banks, non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank, and/or National Bank for the purpose of transition to certain mode of functioning which is activated depending on the scenario of events exercises;

2) the functioning mode - the condition of functioning of bank system of Ukraine, non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank, and National Bank during which accomplishment of certain amount of obligations/tasks/functions, with establishment of the provided services inherent in such condition of the list, the operating processes, the attracted information systems and resources is provided (inclusive exercises human);

3) subjects of the market of financial services of Ukraine - banks, branches of foreign banks, non-bank financial institutions and other faces which are not financial institutions, but have the right to provide separate financial services, regulation and supervision for which activities the National Bank exercises;

4) the scenario of events - certain external events or circumstances which approach makes impossible or limits capability of subjects of the market of financial services of Ukraine and National Bank to provide services / to carry out tasks/functions.

Other terms used in this Provision are used in the values determined by the laws of Ukraine, regulatory legal acts of National Bank concerning regulation of activities of subjects of the market of financial services of Ukraine and protection of critical infrastructure.
