Based on the item 4) parts (1) the Art. 15, parts (3) the Art. 21, parts (3), (4), (5) and (7) the Art. 27, the item c) parts (1) Art. 94 of the Law on payment services and electronic money No. 114/2012 (Monitorul Oficial al Republicii Moldova, 2012, No. 193-197, the Art. 661), with subsequent changes, the Executive committee of National Bank of Moldova DECIDES:

1. Approve Regulations about activities of non-bank payment service providers it (is applied).

2. This resolution becomes effective on the date of publication in Monitorul Oficial al Republicii Moldova, except for the provisions concerning activities of the non-bank payment service providers delivering the payment services specified in the item 8) and 9) to part (1) Art. 4 of the Law on payment services and electronic money No. 114/2012, which will become effective 5.08.2024.

3. Till 6.02.2024 to the non-bank payment service providers having the license of National Bank of Moldova for implementation of activities for provision of payment services and/or to release of electronic money issued based on the Law on payment services and electronic money No. 114/2012, to correct mechanisms and internal procedures according to provisions of these regulations which become effective from the date of publication in Monitorul Oficial al Republicii Moldova.

Regulations about activities of non-bank payment service providers

Chapter I General provisions

1. The regulations about activities of non-bank payment service providers are applied to payment societies, the suppliers of post services acting as suppliers of payment services / or issuers of electronic money and the societies issuing electronic money, its subject is the regulation of activities for provision of payment services and/or to release of electronic money.

2. The concepts and phrases used in these Regulations have the values provided in the Law on payment services and electronic money No. 114/2012 and Regulations on licensing and registration of the payment societies, societies issuing electronic money, and suppliers of post services as payment service providers and/or issuers of electronic money.

3. The non-bank payment service provider shall notify National Bank of Moldova on any changes of these documents enclosed to the application for issue to the license/statement for registration. The notification is submitted in National Bank of Moldova within 10 working days from the moment of emergence of changes together with the documents confirming these changes. Documents are submitted in the original or in copies with presentation of originals for check which return further, and also informative note with the description of the made changes to the documents enclosed to the application for issue to the license / statement for registration.

4. Before change of any data estimated and approved by National Bank of Moldova concerning the governing bodies, their members and/or persons holding key positions and also before appointment of the new governing bodies, their new members and/or new faces holding key positions, the non-bank payment service provider makes in National Bank of Moldova inquiry about evaluating and approval of corresponding changes according to requirements, stipulated in Item 7) parts (1) article 15 of the Law on payment services and electronic money No. 114/2012, with application of documents and information specified in Regulations about licensing and registration of payment societies, the societies issuing electronic money, and suppliers of post services as payment service providers and/or issuers of electronic money.
