1. Approve Rules of issue of the conclusion by authorized bodies which competence includes decision making about possibility of burial, neutralization, utilization or destruction of goods otherwise according to appendix to this order.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of issue of the conclusion by authorized bodies which competence includes decision making about possibility of burial, neutralization, utilization or destruction of goods otherwise

Chapter 1. General provisions

1. These rules of issue of the conclusion by authorized bodies which competence includes decision making about possibility of burial of neutralization, utilizations or destructions of goods different way (further - Rules) are developed according to the subitem 1) of article 330 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" and determine procedure for issue of the conclusion (further - the Conclusion) authorized bodies in the field of environmental protection, drug circulation and medical products (further - authorized bodies) which competence includes acceptance the decision on possibility of burial, neutralization, utilization or destruction of goods otherwise.

These rules do not extend to withdrawal and extermination of the animals, products and raw materials of animal origin constituting health hazard of animals and the person, or their obligatory neutralization (disinfecting) and conversion without withdrawal or destruction not of the corresponding the moved (transported) objects under control to the state veterinary health control and supervision, and also withdrawal and destruction of the quarantine products infected with quarantine objects, which are not subject to disinfecting or conversion which are determined according to the legislation of the Republic of Kazakhstan in the field of veterinary science, protection and quarantine of plants.

The basis for issue of the Conclusion is the statement of physical person or legal entity, including the individual entrepreneur (further - the Statement) having the right to act as the customs applicant of goods (further - the Applicant) with application of documents according to item 4 of these rules.

Chapter 2. Procedure for acceptance and registration of a statement

The application is submitted in territorial authority of the relevant authorized body (further - territorial authorized body) in the place of expected destruction of goods by means of the Single platform of acceptance and processing of all addresses of citizens and (or) in paper form in which are specified:

1) the complete and reduced (in the presence) name, form of business (in the presence), legal address (location) - for the legal entity;

2) surname, name, middle name (in case of its availability), registration address at the place of residence (the place of stay) - for physical person, including the individual entrepreneur;

3) phone numbers, e-mail addresses (in the presence);

4) individual identification number, business and identification number;

5) data on the identity document (for physical person, including the individual entrepreneur);

6) the name of goods concerning which it is necessary to receive the Decision;

7) goods quantity, units of measure of goods;

8) expected methods and places of destruction (burial, neutralization);

9) the bases for application of the procedure of destruction of goods (the reason of destruction of goods is specified).

4. The documents containing are enclosed to the Application:

1) the basis for commodity importation on customs area of the Eurasian Economic Union which is subject to the room under customs procedure of destruction;

2) data on expected methods and places of destruction of goods.

5. Acceptance, registration of a statement with the documents attached to it are performed within 1 (one) working day from the date of their receipt.

6. The application is considered within 10 (ten) working days from the date of its registration in territorial authorized body.

Chapter 3. Procedure for issue of the Conclusion

7. The conclusion is constituted by territorial authorized body in any form with indication of data on the goods declared to destruction (description of goods, quantity, unit of measure), method of destruction of goods, the place of destruction of goods, the bases for application of the procedure of destruction of goods (in need of other data) or impossibility of destruction, with indication of the reasons.

8. The conclusion goes to the Applicant in the form of the electronic document signed by the electronic and digital signature of the head of territorial authorized body or-faced, it replacement and (or) in paper form, signed by the head of territorial authorized body or person replacing it.

9. The conclusion goes to the Applicant no later than 1 (one) working day following behind day of adoption of the corresponding Conclusion.
