About the higher education

This Law is directed to settlement of the public relations in the field of training, education, professional training of citizens of Ukraine. He establishes legal, organizational, financial and other basis of functioning of system of the higher education, creates conditions for self-realization of the personality, ensuring requirements of society and state for qualified specialists.

Section I. GENERAL PROVISIONS

Article 1. Main terms and their determination

In this Law the stated below terms are used in the following value:

the higher education - the education level received by person in higher educational institution as a result of consecutive, system and purposeful process of assimilation of content of the training which is based on complete general secondary education and coming to the end with receipt of certain qualification following the results of the state certification;

content of the higher education - the system of knowledge, skills, professional, world outlook and civil qualities caused by the purposes and requirements of society which shall be created in training process taking into account perspectives of development of society, science, the equipment, technologies, culture and art;

training content - structure, content and amount of educational information which assimilation provides to person access to higher education and certain qualification;

the state certification of persons finishing higher educational institutions - establishment of compliance of the quality level of the higher education graduated by them to requirements of standards upon termination of training in the direction, specialty;

the normative term of training - the term of training in day (internal) form necessary for assimilation by person of normative and selective parts of content of training and established by the standard of the higher education;

the standard of the higher education - set of the regulations determining content of the higher education, training content, means of diagnostics of quality of the higher education and normative term of training;

educational level of the higher education - the characteristic of the higher education on signs of degree of formation of the intellectual qualities of person sufficient for receipt of the qualification corresponding to the level determined educational qualification;

educational and qualification level of the highest obrazovaniyakharakteristik of the higher education on signs of degree of formation of knowledge, the skills of person providing its capability to carry out tasks and obligations (work) of certain level of professional activity;

level of professional activity - the characteristic of professional activity on signs of certain set of professional tasks and obligations (works) which are carried out by the specialist;

professional training - receipt of qualification in the corresponding direction of preparation or specialty;

higher educational institution - educational, the educational scientific institution founded and operating according to the legislation on education, realizing according to the provided license educational and professional programs of the higher education for certain educational and educational and qualification levels, the providing training, education and professional training of persons according to their calling, interests, capabilities and normative requirements in the field of the higher education, and also performing scientific and scientific and technical activities;

higher educational institution of the state form the sobstvennostivysshy educational institution founded by the state, financed from the government budget and subordinated to the relevant central executive body;

the higher educational institution which is in property of the Autonomous Republic of Crimea - the higher educational institution based by authorities of the Autonomous Republic of Crimea, financed from the budget of the Autonomous Republic of Crimea and subordinated to authorities of the Autonomous Republic of Crimea;

higher educational institution of utility form the sobstvennostivysshy educational institution founded by regional authorities, financed from the local budget and subordinated to regional authorities;

higher educational institution of private pattern of ownership - the higher educational institution based on private property and subordinated to the owner (owners);

educational activities - the activities connected with rendering services for receipt of the higher education with issue of the relevant document;

licensing - the procedure of recognition of capability of higher educational institution of certain type to begin the educational activities connected with receipt of the higher education and qualification according to requirements of standards of the higher education, and also with the state requirements on personnel, scientific methodically and to material logistics;

the licensed direction - the direction, on which higher educational institution of certain type acknowledged capable to perform the educational activities connected with receipt of the higher education and qualification;

licensed specialty - specialty of the appropriate educational and qualification level, on which higher educational institution of certain type acknowledged capable to perform the educational activities connected with receipt of the higher education and qualification;

accreditation - the procedure of provision to higher educational institution of certain type of the right to perform the educational activities connected with receipt of the higher education and qualification according to requirements of standards of the higher education, and also with the state requirements on personnel, scientific methodically and to material logistics;

accreditation level - the level of capability of higher educational institution of certain type to perform the educational activities connected with receipt of the higher education and qualification;

the accredited direction - the direction in which the higher educational institution of certain type acquired the right to perform the educational activities connected with receipt of the higher education and qualification;

accredited specialty - specialty of the appropriate educational and qualification level on which the higher educational institution of certain type acquired the right to perform the educational activities connected with receipt of the higher education and qualification;

accredited higher educational institution - the higher educational institution recognized capable to perform the educational activities connected with receipt of the higher education and qualification for the directions and specialties of the appropriate educational and qualification levels which at least two thirds are accredited;

quality of the higher education - the set of qualities of person with the higher education displaying his professional competence, valuable orientation, social orientation and causing capability to satisfy both personal spiritual and material needs, and requirements of society;

quality of educational activities - the set of characteristics of system of the higher education and its components determining it capability to satisfy the established and provided needs of the individual or (and) societies.

the professional standard - the requirements to knowledge, skills of graduates of higher educational institutions approved in accordance with the established procedure which are determined by employers and form basis for forming of qualifications. Professional standards correspond to levels national and industry framework of qualifications and are grouped in industry signs.

Article 2. Legislation of Ukraine on the higher education

The legislation of Ukraine on the higher education is based on the Constitution of Ukraine and consists of the laws of Ukraine "About education", "About scientific and scientific and technical activities", this Law and other regulatory legal acts adopted according to it.

If international treaties of Ukraine which consent to be bound is this the Verkhovna Rada of Ukraine establish other rules, than those which are stipulated by the legislation about the higher education then are applied rules of international treaties.

Article 3. State policy in the field of the higher education

1. State policy in the field of the higher education is determined by the Verkhovna Rada of Ukraine.

2. State policy in the field of the higher education is based on the principles:

availability and konkursnost of receipt of the higher education by each citizen of Ukraine;

independence of receipt of the higher education of influence of political parties, public and religious organizations;

integration of system of the higher education of Ukraine into world system of the higher education during the preserving and development of achievements and traditions of the Ukrainian higher school;

succession of process of receipt of the higher education;

the state support of training of specialists for the priority directions of basic and applied scientific research;

publicity when forming structure and amounts of educational and professional training of specialists.

3. Realization of state policy in the field of the higher education is provided in the way:

preserving and developments of system of the higher education and increase in its quality;

increases in level of education of citizens of Ukraine, expansion of their opportunities for receipt of the higher education;

creations and providing equal conditions of availability of the higher education;

provisions of purpose-oriented, soft public credits to persons for receipt of the higher education according to the procedure, determined by the Cabinet of Ministers of Ukraine;

providing the balanced structure and amounts of the training of specialists with the higher education performed in higher educational institutions of the state and utility patterns of ownership for means of the relevant budgets, physical persons and legal entities, taking into account needs of person, and also interests of the state and territorial bulks;

provisions to persons studying in higher educational institutions, privileges and social guarantees according to the procedure, established by the legislation;

proper support of training of specialists from among disabled people on the basis of special educational technologies.

Article 4. Right of citizens to the higher education

1. Citizens of Ukraine have the right to the higher education.

Citizens of Ukraine have the right to get higher education free of charge in the state and utility higher educational institutions on competitive basis within standards of the higher education if the citizen receives certain educational and qualification level for the first time. They are free in the choice of form of receipt of the higher education, higher educational institution, direction of preparation and specialty.

2. The foreigners and stateless persons which are in Ukraine on legal causes have the right to the higher education, except the right to the higher education at the expense of means of the Government budget of Ukraine, local budgets if other is not established by international treaties which consent to be bound is this the Verkhovna Rada of Ukraine.

3. Person recognized as the refugee or person needing additional protection has the right to the higher education, equal with citizens of Ukraine.

Article 5. Training language in higher educational institutions

Training language in higher educational institutions is determined by article 20 of the Law of Ukraine "About the principles of the state language policy".

Section II. STRUCTURE of the HIGHER EDUCATION. DOCUMENTS ON the HIGHER EDUCATION

Article 6. Structure of the higher education

1. The structure of the higher education includes educational and educational and qualification levels:

1) educational levels:

incomplete higher education;

basic higher education;

complete higher education;

2) educational and qualification levels:

junior specialist;

bachelor;

specialist, master.

2. In higher educational institutions preparation in the directions and professions of specialists of all educational and educational and qualification levels is performed according to the appropriate educational and professional programs step by step or continuously depending on requirements to the level of mastering certain set of the skills necessary for future professional activity.

Article 7. Educational levels of the higher education

1. Incomplete higher education - the educational level of the higher education of person characterizing formation of its intellectual qualities which determine development of person as persons and are sufficient for receipt of qualifications by it on educational qualification level of the junior specialist.

2. Basic higher education - the educational level of the higher education of person characterizing formation of its intellectual qualities which determine development of person as persons and are sufficient for receipt of qualifications by it on educational qualification level of the bachelor.

3. Complete higher education - the educational level of the higher education of person characterizing formation of its intellectual qualities which determine development of person as persons and are sufficient for receipt of qualifications by it on educational qualification level of the specialist or master.

4. The persons which completed training in higher educational institutions, successfully underwent the state certification according to standards of the higher education and who received the relevant document on the higher education of the state sample have the higher education.
