About fundamentals of town planning
This Law determines the legal, economic, social and organizational beginnings of town-planning activities in Ukraine and is directed to forming of the full-fledged habitat, ensuring at the same time protection of the surrounding environment, rational environmental management and preserving cultural heritage.
The town planning (town-planning activities) is the purposeful activities of state bodies, local government bodies, companies, organizations, organizations, citizens, associations of citizens for creation and maintenance of the full-fledged habitat including forecasting of development of settlements and the territories, planning, building and other use of the territories, designing, construction of facilities of town planning, construction of other objects, reconstruction of historical settlements with preserving traditional nature of the circle, restoration and rehabilitation of objects of cultural heritage, creation of engineering and transport infrastructure.
The main directions of town-planning activities are:
planning, building and other use of the territories;
development and implementation of town-planning documentation and investing programs of development of settlements and territories;
determination of the territories, the choice, withdrawal (redemption) and provision of lands for town-planning needs;
implementation of architectural activities;
placement of construction of construction engineering, production and other facilities, forming of town-planning ensembles and landscape complexes, rest areas and improvement of the population;
creation of social, engineering and transport infrastructures of the territories and settlements;
creation and maintaining town-planning inventories of settlements;
protection vital and the environment from harmful effects of technogenic and social factors, natural hazards;
preservation of monuments of cultural heritage;
development of national and cultural traditions in architecture and town planning;
ensuring high architectural and planning, functional and constructive qualities of objects of town planning forming and reconstruction of town-planning ensembles, quarters, areas and landscape complexes, rest areas and natural medical resources;
development of the legal acts, national standards, regulations and rules connected with town planning;
control of observance of the town-planning legislation;
training for town planning, increase in their qualification;
Licensing of types of economic activity on construction of facilities which on class of effects (responsibility) belong to objects with average and large effects, according to the list of work types and according to the procedure which are determined by the Cabinet of Ministers of Ukraine.

When implementing town-planning activities shall be provided:
development of town-planning documentation, projects of specific objects according to basic data on designing, with observance of regulations and rules;
placement and construction of facilities according to approved in accordance with the established procedure by town-planning documentation and projects of these objects;
rational use of lands and the territories for town-planning needs, increase in efficiency of building and other use of the parcels of land;
protection of cultural heritage, preserving traditional nature of the circle settlements;
accounting of the state and public concerns when planning and building the territories;
accounting of legitimate interests and requirements of owners or users of the parcels of land and structures surrounding the site;
informing through media of citizens on plans perspective developments of the territories and settlements, placement of important town-planning objects;
participation of citizens, associations of citizens in discussion of town-planning documentation, projects of separate objects and entering of relevant proposals into state bodies, local government bodies, to the companies, organizations and organizations;
protection of the rights of citizens and public organizations according to the legislation.
The legislation of Ukraine on town planning consists of the Constitution of Ukraine, this Law, the laws of Ukraine "On regulation of town-planning activities", "About architectural activities" and other regulatory legal acts published in their execution.
State regulation in the field of town planning is performed by the Supreme Council of Ukraine, the Cabinet of Ministers of Ukraine, the Supreme Council and Council of Ministers of the Autonomous Republic of Crimea, local public administrations, local government bodies, and also the central executive body providing forming of state policy in the field of town-planning, the central executive body realizing state policy in the field of town-planning, the central executive body realizing state policy concerning the state architectural construction supervision, other bodies according to the procedure, established by the legislation.
State regulation in the field of town planning consists in:
planning of the territories at the nation-wide, regional and local levels;
analysis of condition of town planning, forecasting of its development;
preparation, approval and implementation of the state, regional and local town-planning programs, town-planning documentation;
coordination of interaction of subjects of town-planning and architectural activities;
provision of requirements concerning accounting of state interests in case of development of town-planning documentation;
conducting examination of town-planning documentation and projects of specific objects;
development and approval of construction regulations, estimate norms, standard rates and rules;
control of compliance with law in the field of town planning, regulations, requirements of basic data, the approved town-planning documentation and projects of specific objects, rational use of territorial and material resources during the designing and construction;
control of observance of requirements for protection of cultural heritage and preserving traditional nature of the circle settlements;
