About approval of the Procedure and conditions of payment of the amounts on guaranteed savings of citizens

For the purpose of implementation of the Law of the Kyrgyz Republic "About recognition voided the Law of the Kyrgyz Republic "About recovery and protection of savings of citizens of the Kyrgyz Republic", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procedure and conditions of payment of the amounts on guaranteed savings of citizens according to appendix.

2. Determine Eldik Bank open joint stock company the agent of the Cabinet of Ministers of the Kyrgyz Republic on carrying out recovery of cash savings of citizens of the Kyrgyz Republic, and also citizens of the former Union of Soviet Socialist Republics (USSR) according to the Procedure and conditions of payment of the amounts on guaranteed savings of citizens.

3. To the Ministry of Finance of the Kyrgyz Republic to provide in the republican budget for the corresponding years expenses on cost recovery of Eldik Bank open joint stock company, the special accounts linked with opening and charge on them the recovery amounts.

4. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on conditions and payment procedure of the indexed amounts on population deposits" of December 2, 1997 No. 698;

2) the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of April 10, 1998 No. 184;

3) the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of December 2, 1997 No. 698 "About approval of the Regulations on conditions and payment procedure of the indexed amounts on population deposits" of April 30, 2004 No. 326.

5. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

6. This resolution becomes effective after seven days from the date of official publication.

Procedure and conditions of payment of the amounts on guaranteed savings of citizens

1. Citizens of the Kyrgyz Republic, and also citizens of the former USSR have the right to recovery and safety of value of cash savings.

2. Recovery of money deposits is made regardless of that, the investor withdrew money from the account or closed personal account as of January 1, 1992, by indexation of their remaining balance using coefficients:

- to 2500 rubles in the ratio 1 som to 1 ruble;

- from 2501 to 5000 rubles in the ratio 1 som to 20 rubles;

- from 5001 to 10000 rubles in the ratio 1 som to 30 rubles;

- over 10000 rubles in the ratio 1 som to 40 rubles.

3. The money made in Kyrgyzelbank and means received by investors as a result of closing of personal account after January 1, 1992 is not subject to indexation.

4. In the presence at one investor of several personal accounts of indexation money of each account separately is subject.

5. The Eldik Bank open joint stock company (further - Eldik Bank) is agent of the Cabinet of Ministers of the Kyrgyz Republic on carrying out recovery, ensuring safety and payment of cash savings of the citizens of the Kyrgyz Republic placed in Kyrgyzelbank organizations.

6. The costs of Eldik Bank connected with opening of special accounts and charge on them the recovery amounts are compensated by the Ministry of Finance of the Kyrgyz Republic.

7. Payment of the indexed amounts is made through branches Eldik Banka within the funds allocated by the Ministry of Finance of the Kyrgyz Republic.

8. Control of correctness of payments of the added amounts is imposed on directors of branches Eldik Banka.

9. Monthly to the 15th following for reporting Eldik Bank provides to the Ministry of Finance of the Kyrgyz Republic the report on use of the funds allocated for payment of the indexed amounts.

10. For receipt of the indexed amount the investor submits the application of the established form to any branch Eldik Banka. Issue of the indexed amount is made after month after filing of application by the investor.

11. In case of receipt of the indexed amounts the passport, the savings book is shown (in case open personal account).

12. In case of receipt of the indexed amount from the account "to bearer" availability of the savings book is obligatory. Otherwise payment is not made.

13. In case of loss of the savings book or closing of personal account after January 1, 1992 payment of the indexed amounts is made based on the application of the established form submitted by the investor.

14. In case of loss of the passport the indexed amount is paid after recovery of the document.

15. In the absence of card of personal account of the investor and in the presence on hands of the savings book payment of the indexed amounts is made based on data of archive and their reconciliation with entry in the savings book.

16. Indexed savings at the request of citizens can be received personally or their obtaining can be entrusted other persons based on the power of attorney certified in accordance with the established procedure confirming right to use of savings.

17. In case of change of surname of the investor the document based on which the surname is changed is submitted.

18. At the request of the receiver the compensation amount can be credited on the personal personal account opened in Eldik Banke as to the investor with the subsequent guaranteed payment on the first demand of with charge of percent on the approved interest rates Eldik Banka.

19. For receipt of the indexed amount the certificate on the right to the inheritance or the will certified of the procedure established by the law, the passport, the certificate of birth or the certificate on marriage is by inheritance shown (depending on legal status of the heir).

20. In case of detection of any mistakes in cards of personal accounts payment of the indexed amounts is not carried out before complete clarification of details of the investor (surname, name, the investor's middle name, the address, account number, the remaining balance amount, etc.).
