About measures for enhancement of system of public procurements and stimulation of participation of small business entities in it

For the purpose of employment increase of persons with disability, women and youth by expansion of participation of small business entities in public procurements, and also further enhancement of system of public procurements and strengthening of public control in this system:

1. Determine that since September 1, 2024 in cases of equality of the price and other conditions when implementing public procurements by means of electronic shop of the offer of the small business entities which provided employment of persons with disability, women and youth on the basis of one of criteria according to appendix receive priority.

To the Ministry of Economics and finance together with the Ministry of digital technologies and the interested departments till September 1, 2024 proceeding from requirements of this Item to make changes on special information portal of public procurements.

2. Implement during the period from September 1, 2024 to December 31, 2025 procedure for covering of part of expenses (to 50 percent) on equipment insurance, and also certification of raw materials and the materials imported within the projects developed by means of the centers of assistance to small business under JSB Bank razvitiya businessa (further - the centers), the basic settlement size which is not exceeding the thirtyfold size, by fund of attraction of the population to entrepreneurship.

To the Ministry of Economics and finance to bring the procedure for covering of expenses on insurance and certification provided by this Item in the Cabinet of Ministers in a month.

3. Take into consideration that according to the resolution of the President of the Republic of Uzbekistan of November 15, 2023 No. PP-366 during the period till January 1, 2026 to the small business entities created on the basis of cooperation with large enterprises with the state participation resolves realization of the goods (products) made by them by total cost to 10 billion sum within one financial year to the state customers based on direct agreements.

4. Establish procedure according to which the centers within entrepreneurial projects of the small business entities created on the basis of cooperation with large enterprises with the state participation including persons with disability, women and youth, render practical assistance in:

choice, purchase and installation of the equipment and technologies;

training of small business entities in the directions connected with the organization and business at the practical training courses created in the centers;

training in professions and advanced training of employees of small business entities at floor spaces of large enterprises with the state participation;

broad involvement of small business entities in system of public procurements for realization of their products.

To the Ministry of Economics and finance in two-month time to bring in the Cabinet of Ministers procedure of public procurements with the legal entities who established cooperation connection with small business entities.

5. Determine that since October 1, 2024 for the purpose of further enhancement of system of public procurements and strengthening of public control in this system:

the state customers carry out public discussion of direct agreements before their conclusion within at least one working day, and protocols which are drawn up by results of tenders - within at least two working days, by their placement on special information portal of public procurements;

suppliers of not having analogs in the market and technically difficult goods join in the Register of single suppliers based on the conclusion of Committee on development of the competition and consumer protection;

in electronic system of public procurements function of the notice of the subjects of entrepreneurship which were registered by this system and having the high rating of stability about placement in system of the state orders corresponding to the made (delivered) them goods (works, services) takes root;

practice of rendering electronic system of public procurements of assistance by operators to the state customers and contractors of procurement procedures according to the decision in accordance with the established procedure of the pre-judicial disputes arising in implementation process of agreements takes root;

in case one subject of entrepreneurship participated in tenders and the state customer placed the announcement of repeated tendering without change of procurement procedure and criteria on goods (works, services), at the same time the single participant of repeated tenders is the subject of entrepreneurship who was earlier participating in them, tenders are declared valid.

This procedure does not extend to participants of the tenders which are not conforming to the requirements established by the Law "About Public Procurements", and also did not draw up the offers in required form.

6. To the Ministry of Economics and finance together with the Central bank and the Ministry of Justice till December 1, 2024 to bring in the Cabinet of Ministers procedure the state customers of the following purchases with use of corporate bank cards ("purchasing cards") on expenses on:

tickets (on air and rail transport) and hotel services in case of official journeys and in other cases connected with implementation of activities of the state customer;

gas stations for the vehicles using the gasoline liquefied and the compressed gas, aviation and diesel fuel and also on charging electrical energy of electric vehicles.

7. For the purpose of ensuring continuous productive activity of corporate customers since September 1, 2024:

open as the important fact of the solution of the supervisory boards of economic societies, in authorized fund (authorized capital) of which the state share constitutes 50 percent and more, and also the economic societies which are in their structure according to annual and quarter scheduled plans of public procurements, and also the lists planned to commodity import (works, services);

create on special information portal of public procurements possibility of provision of the offers by the legal entities wishing to establish cooperation relations by localization of the goods necessary for productive activity of corporate customers.

8. To the Ministry of Economics and finance:

till October 1, 2024 to implement on special information portal of public procurements the separate Section which is openly showing to the public of goods price (work, service), including by their types, created by results of the public procurements conducted by the state customers and also to create opportunity to create their initial cost by means of this Section for the state customers;

till November 1, 2024 to make in the Cabinet of Ministers offers on reducing human factor by simplification of procurement procedure by means of electronic shop and enhancement of activities of procurement commissions, to rendering assistance to subjects of entrepreneurship on their participation in the public procurements conducted abroad and also implementation of rating of reliability of participants of public procurements on the basis of the best foreign practices;
