About measures for further enhancement of hunting and activities of hunting farms in the Republic

For the purpose of systematization and enhancement of procedure for carrying out hunting and training of hunters in the country, implementations of advanced technologies in the field of increase in biodiversity in hunting farms, employments of local population due to development of infrastructure of hunting tourism, protection of fauna and its rational use, and also ensuring execution of the Presidential decree of the Republic of Uzbekistan of January 12, 2024 No. UP-9 "About Measures for Significant Increase in Flow of Foreign Tourists to the Republic and Further Activation of Internal Tourism":

1. Approve the offer of the Ministry of ecology, environmental protection and climate change (further - the Ministry of ecology) about establishment since September 1, 2024 of the following procedure for the organization of hunting economy:

a) hunting is performed only in the territory of hunting farms and implementation of hunting outside the territory of hunting farms is forbidden (except for catching of fish by physical persons according to the procedure of general use on natural waterways, and also channels and collector and drainage networks and hunting for the purpose of regulation of number of wild animals, and also hunting in the free hunting territories according to the procedure, established by the Ministry of ecology);

b) for the purpose of creation of hunting farms the parcels of land from lands of nonagricultural appointment and lands of forest fund up to 10 hectares for the organization of hunting bases and up to 100 hectares for the organization of nurseries with one lot with establishment of investment and contractual commitments by means of electronic online auctions on the basis of the lease right for a period of 49 years in the following stages are allocated to legal entities and physical persons:

at the first stage - for 10 years;

by results of accomplishment of investment and contractual commitments:

at the second stage - for 10 years;

at the third stage - for 29 years.

At the same time, if within two years for cultivation and reproduction of wild animals infrastructure of nurseries or the reproduction site are not created, the lease is terminated;

c) the hunting grounds adjacent to hunting farms (hunting bases and nurseries), for maintaining hunting economy are assigned to legal entities and physical persons - based on the direct agreement on provision of hunting grounds signed with the Ministry of ecology by winners of electronic online auction. At the same time:

the amount of the annual payment levied for use of the fixed hunting grounds is established by the Ministry of ecology in coordination with the Ministry of Economics and finance;

in case of refusal legal entities and physical persons - winners of electronic online auction from the conclusion of the agreement on provision of hunting grounds in the adjacent territory for maintaining hunting economy, results of electronic online auction are cancelled and the parcels of land are repeatedly exposed on electronic online auctions;

d) hunting farms:

perform activities on the basis of materials of the feasibility statement calculated for 10 years developed and approved in the format approved by the Ministry of ecology;

based on the procedure established by the Ministry of ecology will organize hunting during the whole year for wild animals in the quantity equal to quantity of the wild animals issued in the hunting grounds assigned to them with establishing full-stage cultivation of wild animals in nurseries, except for the periods of their reproduction. At the same time receipt of permission to hunting for wild animals is not required;

e) the periods of reproduction of wild animals are determined based on the conclusion of Institute of zoology.

In case of creation by legal entities and physical persons of hunting bases and nurseries till September 1, 2024 on the parcels of land belonging to them, hunting grounds in the territory, adjacent to this parcel of land, are fixed for a period of 49 years based on the direct agreement on provision of hunting grounds signed with the Ministry of ecology for maintaining hunting economy.

2. Confer to the Ministry of ecology the following powers:

approval of standard form of the agreement on provision of hunting grounds for maintaining hunting economy;

approval of format of materials of the feasibility statement when maintaining hunting economy;

the conclusion of the contract with legal entities and physical persons about provision of hunting grounds for maintaining hunting economy.

3. To the ministry of ecology together with the interested ministries and departments in three-months time to introduce the draft of the regulatory legal act determining procedure for lease of lands for nonagricultural appointment and lands for forest fund to the Cabinet of Ministers.

4. Approve "Road map" on further enhancement of hunting and activities of hunting farms it agrees приложению*.

5. Determine that:

a) since October 1, 2024 the hunting permit is issued to hunters on the basis of quotas for getting of wild animals through the electronic platform developed by the Ministry of ecology.

At the same time the amount of payment for issue of hunting permits is determined by hunting farms;

b) the quota for getting of wild animals affirms the Ministry of ecology based on the objects of fauna this the state inventory, data on accounting of number of the wild animals and the got wild animals this about accounting of the wild animals received from the forestry operating in the republic, reserves, nurseries and other physical persons and legal entities performing such activities.

In case of approval of annual quotas for withdrawal from the environment of dwelling of rare and endangered species of the wild animals included in the Red List of the Republic of Uzbekistan in additional procedure recommendations of Academy of Sciences of the Republic of Uzbekistan on the basis of the conducted and published scientific research are considered;

c) under the organization of trophy hunting hunting is allowed in all days of the week irrespective of hunting season;

d) networks for industrial fishery are allowed to sale only to fish-breeding farms to which industrial fishery quotas are allocated, sale to fish-breeding farms to which quotas are not allocated is forbidden.

6. Since October 1, 2024 to establish the following procedure for issue of the hunting ticket:

training of applicants for receipt of the hunting ticket at special training courses takes root (further - training courses);

the hunting ticket is issued by Development department of ecotourism and hunting under the Ministry of ecology (further - Department) for a period of 2 years through the Single portal of interactive state services to physical persons, capable, reached eighteen-year age, ended training courses and successfully passed tests;

information on issue of the hunting ticket is integrated into passport details or the identifying ID cards of physical persons;

training courses for receipt of the hunting ticket, are organized by Department or educational institutions with prediscretion of training in special knowledge of preserving biodiversity, to types and anatomy of animals, rules of hunting, hunting ethics and methods of hunting, and also on first-aid treatment;
