RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About implementation of the Law of the Republic of Belarus of January 6, 2024 No. 353-Z "About change of the laws concerning advertizing"

In pursuance of article 5 of the Law of the Republic of Belarus of January 6, 2024 "About change of the laws concerning advertizing" the Council of Ministers of the Republic of Belarus DECIDES: No. 353-Z

1. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix.

2. Determine that:

the statements for approval of outdoor advertizing and advertizing on the vehicle submitted before entry into force of this Item are considered according to the legislation existing before entry into force of this Item;

the outdoor advertizing and advertizing on the vehicle approved according to the applications submitted before entry into force of this Item are not subject to repeated approval in connection with entry into force of this Item.

3. This resolution becomes effective in the following procedure:

appendix item 4 paragraph two – since July 1, 2025;

other provisions of this resolution – since July 12, 2024.

to the Resolution of Council of Ministers of the Republic of Belarus of July 8, 2024 No. 484

The list of the changes made to resolutions of Council of Ministers of the Republic of Belarus

1. In item 4 of the Regulations on the Ministry of Education of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of August 4, 2011 No. 1049:

the fifth subitem 4.8 after the word of "training" to add the paragraph with the words "and education";

state subitem 4.34 in the following edition:

"4.34. approves advertizing about training outside the Republic of Belarus;".

2. In the resolution of Council of Ministers of the Republic of Belarus of July 9, 2013 No. 603 "About procedure for production and placement (distribution) of social advertizing":

in Regulations on the procedure for production and placement (distribution) of social advertizing approved by this resolution:

to add part one of Item 10 with the words "no more than two years from the date of receipt of such decision";

in Item 12:

state part one in the following edition:

"12. For placement (distribution) of social advertizing the state body submits the advertizing distributor in any written form the application for placement (distribution) of such advertizing (further – the request) in which it specifies the name of state body, scope of social advertizing, the address (address reference points) of the location of means of outdoor advertizing, expected terms of its placement (distribution) and data on results of assessment of its quality by Interdepartmental council if such social advertizing is subject to quality evaluation, except as specified, specified in part three of this Item and part one of Item 13 of this provision.";

in part two of the word "one month" shall be replaced with words "30 calendar days";

the fourth to state part in the following edition:

"The advertizing distributor stops placement (distribution) of social advertizing of public holidays, holidays, memorials and actions of republican or local value no later than five calendar days from the date of the end of the specified events if other is not established by this Provision.";

state Item 13 in the following edition:

"13. For placement (distribution) of social outdoor advertizing of public holidays, all-republican holidays and memorials, and also social outdoor advertizing in the field of ensuring the state and (or) public security the state body sends to the advertizing distributor in any written form the requirement about placement (distribution) of such advertizing (further – the requirement) in which specifies the name of state body, scope of social outdoor advertizing, the address (address reference points) of the location of means of outdoor advertizing, the period of its placement (distribution), and concerning social outdoor advertizing in the field of ensuring the state and (or) public security – in addition data on results of assessment of its quality Interdepartmental council. The prototype of social outdoor advertizing and (or) social outdoor multimedia advertizing in electronic form are applied to the requirement.

The period of placement (distribution) of social outdoor advertizing specified in the requirement:

public holidays, all-republican holidays and memorials shall begin not earlier than before 10 calendar days before start date of the specified events and come to the end no later than three calendar days from the date of the end of the specified events;

in the field of ensuring the state and (or) public security shall not exceed 30 calendar days.

The requirement goes not later than 10 calendar days prior to the beginning of the period of placement (distribution) of such social outdoor advertizing specified in it.

The advertizing distributor stops placement (distribution) of social outdoor advertizing of public holidays, all-republican holidays and memorials, and also social outdoor advertizing in the field of ensuring the state and (or) public security in the day following behind day of the end of the period of placement (distribution) of such social outdoor advertizing specified in the requirement if other is not established by this Provision.";

add Item 14 with parts of the following content:

"The advertizing distributor performing placement (distribution) of social outdoor advertizing of public holidays, all-republican holidays and memorials, and also social outdoor advertizing in the field of ensuring the state and (or) public security records requirements for date and time of their receipt.

In case of receipt to the advertizing distributor of several requirements from different state bodies in which the period of placement (distribution) of the corresponding social outdoor advertizing on the same means of outdoor advertizing matches the advertizing distributor performs placement (distribution) of social outdoor advertizing of earlier addressed state body, having in writing notified on it the state body which addressed later.";

add the Provision with Item 18 of the following content:

"18. The state body has the right to stop at any time placement (distribution) of social advertizing which advertiser he is, having in writing notified on it the advertizing distributor.

The advertizing distributor stops placement (distribution) of such social advertizing in time, specified by state body.";

include in the structure of Interdepartmental council on advertizing approved by this resolution, Leshchenko Dina Petrovna – the deputy chief of head department of trade and services of the Minsk regional executive committee, having excluded from it I. P. Ivanovic.
