About import licensing of separate types of goods from wood

Based on articles 29 and 47 of the Agreement on the Eurasian Economic Union of May 29, 2014 and subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 124

1. Determine that under the one-time licenses granted by the Ministry of anti-monopoly regulation and trade (further – licenses) in coordination with the Belarusian production and trade concern forest, woodworking and pulp and paper industry (further – Bellesbumprom concern) according to the procedure, similar established by Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries approved by the Decision of Council of the Eurasian economic commission of November 24, 2023 No. 125 are applied (further – Rules) commodity importation according to appendix is performed (further if other is not provided, – goods):

to the Republic of Belarus from state members of the Eurasian Economic Union (further – EEU);

because of limits of customs area of EEU to the Republic of Belarus from the states which are not state members of EEU in case of their room under customs procedures of release for internal consumption (except for rooms under customs procedure of release for internal consumption for the purpose of completion of action of customs procedure of free customs zone) and free customs zone.

2. Operation of this resolution does not extend to goods:

moved within the international transit carriages which are beginning and coming to an end outside customs area of EEU;

placed under the customs procedures in the state member of EEU other than the Republic of Belarus moved with transit through the territory of the Republic of Belarus;

moved within the international transit carriages which are beginning outside customs area of EEU and coming to an end in the state member of EEU other than the Republic of Belarus;

their origins coming from state members of EEU on condition of confirmation by the certificate of origin of the ST-1 form or other certificate confirming goods origin from state member of EEU, which is drawn up authorized on issue of these certificates by the organization, or included in the Eurasian register of manufactured goods of state members of EEU;

imported as foreign free aid;

which cost according to one transport (transportation) document does not exceed the amount equivalent of 200 euros.

3. The legal entity, the individual entrepreneur (further – the interested person) for receipt of approval of licensing for commodity importation addresses to Bellesbumprom concern with submission of the following documents:

the statement in any form of approval of licensing for commodity importation;

the application for licensing (in duplicate) issued according to appendix No. 1 to Rules;

the document confirming goods origin.

4. The documents specified in Item 3 of this resolution are represented to Bellesbumprom concern during acceptance of the interested person, or by means of mail service, or the courier (courier).

5. Approval of licensing for commodity importation is performed:

free of charge within 10 working days from the date of submission of the documents specified in Item 3 of this resolution;

by putting down on the statement, the specified in paragraph three of Item 3 of this resolution, signature of person authorized on approval and impress of a seal of Bellesbumprom concern.

6. Approval effective period – before date of issue of the license for commodity importation.

Approval of licensing is issued or goes to the interested person according to the procedure, No. 433-Z established in article 27 of the Law of the Republic of Belarus of October 28, 2008 "About bases of ministerial procedures".

7. The bases for refusal in approval of licensing for commodity importation are:

the cases determined in article 25 of the Law of the Republic of Belarus "About bases of ministerial procedures";

availability in the Republic of Belarus productions of the goods similar to imported.

8. To add Item 25.15 of the single list of the ministerial procedures performed concerning subjects of the managing approved by the resolution of Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548, with subitem 25.15.10 of the following content:

9. Approve regulations of the ministerial procedure performed concerning subjects of managing according to the subitem * 25.15.10 "Approval of licensing for import of separate types of goods from wood" (is applied).

10. To the Ministry of Foreign Affairs to notify the Eurasian economic commission on introduction of the measure of non-tariff regulation specified in Item 1 of this resolution.

11. To the State Customs Committee:

take measures for control of commodity importation according to the paragraph third Item 1 of this resolution;

monthly to the 15th following reporting to provide to concern "Bellesbumprom" in electronic form and the Ministry of anti-monopoly regulation and trade data on the amounts of commodity importation placed under customs procedures of release for internal consumption (except for rooms under customs procedure of release for internal consumption for the purpose of completion of action of customs procedure of free customs zone) and free customs zone, and also imported from other states concerning which customs authorities register statistical declarations.
