The list of indicators of risk of violation of mandatory requirements when implementing federal state control (supervision) in the field of production and turnover of tobacco products, nikotinsoderzhashchy products and raw materials for their production

Identification of the fact of input in turnover of tobacco and (or) nikotinsoderzhashchy products person performing production of such products, in case of absence in the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - GIS MT) <1>, data on purchase and (or) production by this person according to tobacco and (or) nicotinic raw materials within 90 calendar days in a row from the date of the last purchase and (or) production by this person according to raw materials and (or) nicotinic raw materials about day of identification of the fact of input in turnover of the specified products.

Absence in GIS MT of data on input in turnover and (or) conclusion from turnover of tobacco products, and (or) nikotinsoderzhashchy products, and (or) raw materials for their production within 40 calendar days in a row from the date of the last input in turnover and (or) conclusion from turnover of the specified products and (or) raw materials or within 50 calendar days from the first calendar day of reporting quarter in total person having the license in the field of production and turnover of tobacco products, nikotinsoderzhashchy products and raw materials for their production, except for case of suspension of action of the specified license.

3. Availability in GIS MT the last day of calendar month of data on remaining balance of tobacco products with the term of stay it in turnover more than 12 calendar months from the date of input in turnover of tobacco products of more than 25% of total amount of the tobacco products which are at the participant of turnover.

Identification of the fact of input in turnover of raw materials and (or) nicotinic raw materials person having the license according to part 1 of article 8 of the Federal Law of June 13, 2023 No. 203-FZ "About state regulation of production and turnover of tobacco products, tobacco products, nikotinsoderzhashchy products and raw materials for their production" providing the right of the licensee to input in turnover of raw materials and nicotinic raw materials in case of absence in GIS MT within 90 calendar days in a row preceding day of identification of the fact of input in turnover of raw materials and (or) nicotinic raw materials, data on delivery and (or) conclusion from turnover of raw materials and (or) nicotinic raw materials in the amount exceeding 10 percent from the raw materials introduced into circulation and (or) nicotinic raw materials.

Identification of the fact of conclusion from turnover of raw materials and (or) nicotinic raw materials person having the license according to part 1 of article 8 of the Federal Law of June 13, 2023 No. 203-FZ "About state regulation of production and turnover of tobacco products, tobacco products, nikotinsoderzhashchy products and raw materials for their production" providing the right of the licensee to conclusion from turnover of raw materials and nicotinic raw materials in case of absence in GIS MT of data on purchase and (or) production of raw materials and (or) nicotinic raw materials within 90 calendar days in a row from the date of the last purchase and (or) production of raw materials and (or) nicotinic raw materials to the specified conclusion from turnover.
