About conscription and military service

This Law performs legal regulation of the relations between the state and citizens of Ukraine in connection with accomplishment of the constitutional debt by them on protection of the Fatherland, independence and territorial integrity of Ukraine, and also determines the general principles of passing in Ukraine of military service.

Chapter I. General provisions

Article 1. Military obligation

1. Protection of the Fatherland, independence and territorial integrity of Ukraine constitutional obligation of citizens of Ukraine.

2. The conscription is established for the purpose of training of citizens of Ukraine for protection of the Fatherland, providing with staff the Armed Forces of Ukraine formed according to the laws of Ukraine of other military forming, and also law enforcement agencies of special purpose (further - the Armed Forces of Ukraine and other military forming) in which positions are completed with the military personnel.

3. The military obligation includes:

training of citizens for military service;

capture of citizens on military accounting;

acceptance in voluntary procedure (under the contract) and appeal (direction) on military service;

passing of military service;

execution of military duty in inventory;

service in war reserve;

observance of rules of military accounting.

4. Citizens of Ukraine have the right to replacement of accomplishment of military duty by alternative (not military) service according to the Constitution of Ukraine and the Law of Ukraine "About alternative (not military) service".

5. Citizens of Ukraine are exempted from execution of conscription on the bases determined by this Law.

6. The conscription does not extend to the foreigners and persons without citizenship who are in Ukraine.

In the cases provided by the law, foreigners and stateless persons (including exempted from captivity before completion of fighting according to the procedure, determined by the Cabinet of Ministers of Ukraine) which on legal causes are in the territory of Ukraine (further - foreigners and stateless persons), can in voluntary procedure (under the contract) to pass military service in the Armed Forces of Ukraine, the Public special service of transport and National guard of Ukraine.

7. Accomplishment of military duty by citizens of Ukraine the state bodies, local government bodies formed according to the laws of Ukraine military forming, the companies, organizations and the organizations irrespective of subordination and patterns of ownership within their powers provided by the law, the centers of provision of administrative services, the centers of recruiting and district (the integrated district) city (district in the cities, the integrated city) provide the territorial centers of completing and social support, the territorial centers of completing and social support of the Autonomous Republic of Crimea, areas, cities of Kiev and Sevastopol (further - the territorial centers of completing and social support).

8. Regulations on the centers of recruiting, the territorial centers of completing and social support affirm the Cabinet of Ministers of Ukraine. Activities of the territorial centers of completing and social support, the centers of recruiting are coordinated and goes the Ministry of Defence of Ukraine.

9. Concerning conscription citizens of Ukraine are divided into the following categories:

youths of premilitary age - persons who are subject to capture on military accounting;

recruits - persons taken on military accounting;

military personnel - persons passing military service;

persons liable for call-up - persons who are in inventory for completing of the Armed Forces of Ukraine and other military forming for the special period, and also for performance of works on ensuring defense of the state;

reservists - persons who serve in war reserve of the Armed Forces of Ukraine of other military forming also are intended for their completing in peace time and during the period.

Foreigners and stateless persons are equated to category of the military personnel, according to the law pass military service in the Armed Forces of Ukraine, the Public special service of transport and National guard of Ukraine.

The military and accounting document which is the document determining belonging of its owner to accomplishment of military duty is processed and issued to recruits, persons liable for call-up, reservists and military personnel. The form, procedure for registration (creation) and issue of the military and accounting document for recruits, persons liable for call-up and reservists are determined by the Cabinet of Ministers of Ukraine, and for the military personnel - respectively the Ministry of Defence of Ukraine, the Ministry of Internal Affairs of Ukraine, the Security Service of Ukraine, prospecting bodies of Ukraine, Management of the state protection of Ukraine and Public service of special communication and information security of Ukraine.

10. The citizens of Ukraine who are subject to capture on military accounting, staying on the military registry of recruits or in inventory of the Armed Forces of Ukraine, in inventory of the Security Service of Ukraine, prospecting bodies of Ukraine or serving in war reserve, shall:

specify within 60 days from the date of entry into force of the Presidential decree of Ukraine about the announcement of mobilization approved by the Verkhovna Rada of Ukraine, the personal data through the center of provision of administrative services or through electronic office of the recruit, person liable for call-up, reservist or in the territorial center of completing and social support;

arrive on challenge district (the integrated district), city (district in the city, the integrated city) the territorial center of completing and social support (further - the relevant district (city) territorial centers of completing and social support), the Central management or regional body of security service of Ukraine, the relevant division of prospecting bodies of Ukraine for execution of military and accounting documents, capture to military accounting, passing of medical examination, the direction on preparation for the purpose of obtaining or enhancement of military specialty, conscription or to charges of persons liable for call-up and reservists;

have medical examination according to decisions of the commission on questions of capture on military accounting, the commission on direction questions for passing of basic military service or the military-medical commission of the relevant district (city) territorial center of completing and social support, healthcare institutions of the Security Service of Ukraine, and in Service of foreign intelligence of Ukraine, prospecting body of the Ministry of Defence of Ukraine or prospecting body of the central executive body realizing state policy in the field of protection of frontier - according to the decision of heads of the relevant divisions or military-medical commission of Service of foreign intelligence of Ukraine, the prospecting body of the Ministry of Defence of Ukraine or central executive body realizing state policy in the field of protection of frontier, respectively;

have training for military service, military service and carry out military obligation in inventory;

carry out the rules of military accounting established by the legislation.

Reservists shall arrive to military unit where they serve in war reserve, on challenge of the commander of this military unit.

11. Women who are suitable for passing of military service for health reasons and I will increase and showed willingness to pass basic military service, just before the direction for passing of basic military service according to their statement (address) undertake on military accounting of recruits. Article 2. Military service and accomplishment of military duty in inventory

1. The military service is public service of special nature which consists in professional activity suitable for it for health reasons and to age of citizens of Ukraine (except as specified, determined by the law), of foreigners and stateless persons, Ukraine connected with defense, its independence and territorial integrity. Time of passing of military service is set off to citizens of Ukraine in their insurance years of service, length of service, length of service in the specialty, and also in years of service of public service.

2. Passing of military service is performed:

citizens of Ukraine - in voluntary procedure (under the contract), in the direction or at the call of;

foreigners and stateless persons - in voluntary procedure (under the contract) on positions in the Armed Forces of Ukraine, the Public special service of transport and National guard of Ukraine.

3. Citizens of Ukraine, foreigners and stateless persons which pass military service are military personnel.

4. The procedure for passing of military service, the right and obligation of the military personnel are determined by it and other laws, relevant provisions on passing of military service which affirm the President of Ukraine, and other regulatory legal acts.

The strategy of attraction, development and content of human capital in forces of defense of Ukraine is determined by the Ministry of Defence of Ukraine.

5. The military service in Ukraine will be organized with observance of the constitutional requirement about department of church and the religious organizations from the state.

6. Types of military service:

basic military service;

military service on mobilization, for the special period;

military service under the contract of faces of ordinary structure;

military service under the contract of faces of sergeant and foreman structure;

military service (training) of cadets of the highest military educational institutions and higher educational institutions which incorporate military institutes, faculties of military preparation, department of military preparation, department of military preparation (further - the highest military educational institutions and military educational units of higher educational institutions), and also organizations of professional prehigher military education;

military service under the contract of faces of officers;

military service of faces of officers;

military service of persons from among reservists during the special period.

7. Citizens of Ukraine pass basic military service according to the laws of Ukraine in the Armed Forces of Ukraine and other military forming for the purpose of receipt of military specialty, acquisition of practical skills and abilities for the armed protection of the Fatherland.

8. The conscription in inventory consists in observance by persons liable for call-up of procedure and rules of military accounting, passing of charges for preserving and enhancement of knowledge, skills and abilities necessary for accomplishment of obligations of military service during the special period.

9. Citizens of Ukraine can serve in war reserve of the Armed Forces of Ukraine or other military forming. Procedure for selection and acceptance on service in war reserve, terms, conditions and procedure for its passing, and also the basis and procedure for dismissal from service are determined by this Law, relevant provisions on passing by citizens of Ukraine services in war reserve which affirm the President of Ukraine, and other normative legal acts.

10. On military service of persons from among reservists during the special period in the procedure determined by this Law for operational fitting of the Armed Forces of Ukraine and other military forming citizens of Ukraine who signed contracts on service in war reserve are called and/or are enlisted in war operational reserve.

11. The structure of war reserve of human resources is established by the Cabinet of Ministers of Ukraine.

12. Each citizen of Ukraine, for the first time enlisting in the Armed Forces of Ukraine, other military forming, personally takes Military oath of allegiance to the Ukrainian people and fastens it with the sign manual. The foreigner or the stateless person who (which) for the first time is accepted on military service in the Armed Forces of Ukraine the Public special service of transport or National guard of Ukraine assumes official obligation strictly to observe the Constitution and the laws of Ukraine, to honesty fulfill duties of military service.

13. Citizens of Ukraine who being on military accounting, go for preparation for military service the persons which called, directed or accepted on military service are employed in war reserve, and the persons liable for call-up intended for completing of positions on the corresponding military specialties and other specialties in the Security Service of Ukraine during mobilization have obligatory medical examination, except the cases provided by this Law. The procedure for passing of medical examination affirms as compliance the Ministry of Defence of Ukraine, the central executive bodies which according to the law perform management of military forming, the Security Service of Ukraine, Service of foreign intelligence of Ukraine in coordination with the central executive body providing forming and realizes state policy in the field of health care, according to the procedure, determined by the Cabinet of Ministers of Ukraine. 14. Accomplishment of military duty during the special period is performed with the features determined by this Law and other regulatory legal acts.

Article 3. The legal basis of conscription, military service, service in war reserve

1. The legal basis of conscription and military service, service in war reserve are the Constitution of Ukraine, this Law, the Law of Ukraine "About defense of Ukraine", "About the Armed Forces of Ukraine", "About mobilization preparation and mobilization", other laws of Ukraine, and also presidential decrees of Ukraine and other regulatory legal acts accepted according to them on ensuring defense capability of the state, execution of conscription, passing of military service and the status of the military personnel, and also the international agreements of Ukraine which consent to be bound is this the Verkhovna Rada of Ukraine.

Article 4. Completing by the military personnel of the Armed Forces of Ukraine and other military forming

1. The Armed Forces of Ukraine and other military forming are completed with the military personnel in the way:

appeal (direction) of citizens of Ukraine on military service;

acceptances of citizens of Ukraine on military service under the contract.

2. The Armed Forces of Ukraine and other military forming cannot be completed with persons having criminal record for making of crimes against bases of homeland security of Ukraine, making of the premeditated murder of two or more persons or committed with special cruelty or combined with rape or sexual violence, or especially heavy corruption criminal offenses or criminal offenses having criminal record for making provided by Articles 152-156-1, 258-258-6, part four of Article 286-1, article 348 of the Criminal code of Ukraine and also the condemned officials who according to the subitem 1 of Item 3 of the note to article 368 of the Criminal code of Ukraine held especially responsible position if such criminal record is not extinguished or is not removed in the procedure established by the law.

3. The procedure for completing of the Armed Forces of Ukraine, the Public special service of transport and National guard of Ukraine by the military personnel from among foreigners and stateless persons is established by this Law and regulatory legal acts adopted according to it.

4. The procedure for completing of the Armed Forces of Ukraine, the Public special service of transport and National guard of Ukraine and other military forming by the military personnel is established by this Law and regulatory legal acts adopted according to it.

5. For fitting of the Armed Forces of Ukraine and other military forming by the military personnel for the special period, and in case of acceptance in the cases and procedure determined by the law, the relevant decision of the President of Ukraine - and systematic military preparation is carried out to peace time and stay in inventory and war reserve of necessary number of the military trained citizens is provided.
