This Law determines legal, organizational, economic and social basis of development of resorts in Ukraine and is aimed at providing use for the purpose of treatment and improvement of people of natural medical resources, the natural territories of the resorts which are property of the people of Ukraine, and their protection.
In this Law terms are used in the following value:
the resort - the mastered natural territory on lands of improving appointment having the natural medical resources necessary for their operation of the building and construction with infrastructure facilities used for the purpose of treatment, medical rehabilitation, prevention of diseases and for recreation and which is subject to special protection;
the medical and improving area - the natural territory having mineral and thermal waters, therapeutic muds, ozokerite, brine of estuaries and lakes, the climatic and other environment favorable for treatment, medical rehabilitation and prevention of diseases;
especially valuable and unique natural medical resources - the resources which are seldom (not often) found in the territory of Ukraine, having limited distribution or small inventories in fields and being especially favorable and effective for use for the purpose of treatment, medical rehabilitation and prevention of diseases;
popular natural medical resources - the resources which are found in different regions of Ukraine, having considerable inventories and suitable for use for the purpose of treatment, medical rehabilitation and prevention of diseases;
the medical (balneological) certificate is the conclusion made based on medicobiological and other special researches of structure and properties of natural medical resources about possibility of their use for the purpose of treatment, medical rehabilitation and prevention of diseases;
resort case - set of all types of scientific and practical and economic activity directed to the organization and ensuring treatment, medical rehabilitation and prevention of diseases with use of natural medical resources.
The legislation on resorts is based on provisions of the Constitution of Ukraine and consists of this Law and other regulatory legal acts.
Task of the legislation on resorts is regulation of the public relations in the sphere of the organization and development of resorts, identification and accounting of natural medical resources, ensuring their rational production, use and protection for the purpose of creating favorable conditions for treatment, prevention of diseases and rest of people.
State policy of Ukraine in the sphere of resort case is determined by the Verkhovna Rada of Ukraine and is based on the principles:
legislative determination of conditions and procedure for the organization of activities of resorts;
ensuring availability of sanatorium treatment to all citizens, first of all for persons with disability, the veterans of war and work, combatants, citizens injured with the Chernobyl accident, children, women of reproductive age having gynecologic diseases, TB patients and patients with injuries and diseases of spinal cord and backbone;
accounting of demand of the population for specific types of sanatorium services in case of development and approval of nation-wide and local development programs of resorts;
economical and rational use of natural medical resources and ensuring their proper protection;
assistance to transformation of health resort of Ukraine into highly profitable and competitive industry of economy.
On nature of natural medical resources the resorts of Ukraine are divided into resorts of the state and local value.
