About pensions for special merits in front of Ukraine

This Law provides establishment for separate categories of citizens for making of outstanding heroic act or outstanding labor achievement in certain period of the additional social benefits in the form of the additional or increased money payments, privileges or compensations for satisfaction of separate requirements.

The additional social benefits are established on permanent basis or for certain period within the means provided by the Government budget of Ukraine. The additional social benefits in the form of pension for special merits in front of Ukraine are established on permanent basis.

Article 1.

Pension for special merits in front of Ukraine (further - pension for special merits) is established to the following citizens of Ukraine:

1) to the Heroes of Ukraine, persons who are awarded the order Heroes of People killed during Euromaidan, four and more awards of Ukraine after declaration of independence of Ukraine, to persons which are marked out by honorary title of Ukraine "national" after declaration of independence of Ukraine;

2) to veterans of war who after declaration of independence of Ukraine are awarded the order for personal courage (personal deposit), revealed in protection of the state sovereignty and territorial integrity of Ukraine;

3) to outstanding winner athletes of the Olympic and Paralympic Games, World games of deafs, champions and world record-holders and Europe;

4) to the astronauts who made flight in space, to members of flight-test crews of planes;

5) to persons which are marked out by the honorary title of Ukraine "deserved", the State prize of Ukraine awarded with one of awards of Ukraine;

6) to the mothers who gave birth to five or more children and brought up them to six-year age. If in case of the death of mother or deprivation of its parent rights education of children to the specified age was performed by the father, the pension entitlement for special merits is granted to the father. At the same time the children adopted in the procedure established by the law are considered;

7) to persons who according to the Law of Ukraine "About legal status and celebration of memory of fighters for independence of Ukraine in the 20th century" are recognized as fighters for independence of Ukraine in the 20th century and according to the Law of Ukraine "About recovery of victims of repressions of communist totalitarian regime of 1917-1991" are rehabilitated, from among those which for political or religious motives were subjected to repressions in shape (forms) of imprisonment (conclusion) or the forced groundless placement of the healthy person to mental health facility according to the decision of extrajudicial or other repressive body.

Article 2.

Pensions for special merits are established by territorial authority of the Pension fund of Ukraine.

Article 3.

Under this Law pensions are established:

on age;

on disability;

on the occasion of loss of the supporter;

for long service.

Article 4.

Pensions for special merits are established to the citizens specified in article 1 of this Law, having pension entitlement on age, on disability on the occasion of loss of the supporter and for long service according to the law.

Article 5.

Pension for special merits is established as the allowance to the size of pension to which person under the law, in the following sizes has the right:

4200 hryvnias faces, specified in Item 7 of article 1 of this Law;

from 35 to 40 percent of the size of the subsistence minimum determined for persons which lost working capacity - to persons specified in Items 1 and 6 of article 1 of this Law;

from 23 to 35 percent of the size of the subsistence minimum determined for persons which lost working capacity - to persons specified in Items 2-5 of article 1 of this Law.

The allowance size to persons specified in Items 1-6 of article 1 of this Law is determined according to the scheme of determination of the sizes of allowances depending on merits in front of Ukraine approved by the central executive body providing forming of state policy in the sphere of social protection of the population, and to persons specified in Item 7 of article 1 of this Law - according to the paragraph the second parts one of this Article. If person at the same time has the right to allowances on several bases, the stipulated in Article 1 this Law, the allowance which is bigger, in the maximum size is established.

Pension for special merits is established from the date of the request for establishment of pension or from the date of acquisition of right to it if the request for its establishment happened no later than 12 months from the date of acquisition of right. Day of the request for establishment of pension for special merits day of reception of an application about establishment of pension for special merits with all necessary documents is considered. If the application for establishment of pension for special merits is directed by mail and all necessary documents are attached to it, day of the request for establishment of pension for special merits the date specified on postage stamp of the place of departure of the statement is considered. If not all necessary documents are enclosed to the application, the territorial authority of the Pension fund of Ukraine reports the applicant what documents shall be submitted in addition. If such documents are submitted no later than three months from the date of the notification on need of submission of additional documents in the afternoon of the request for in the establishment of pension for special merits day of acceptance or departure of the statement for establishment of such pension is considered.

In case of increase in the size of the subsistence minimum determined for persons which lost working capacity, the territorial authority of the Pension fund of Ukraine performs recalculation of pension for special merits which size is determined according to paragraphs of the third and fourth part one of this Article, from date with which the new size of subsistence minimum is established. The pension size for special merits determined according to the paragraph to the second part one of this Article since 2024, annually since March 1 increases by increase coefficient which is determined according to paragraphs two and third part two of article 42 of the Law of Ukraine "About obligatory national pension insurance" by the decision of the Cabinet of Ministers of Ukraine.
