About approval of the Regulations on electronic regulatory platform

According to part five of article 8 of the Law of Ukraine "About electronic communications", "About the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service" the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service DECIDES: parts five of Article 1 and the subitem "o" of Item of 1 part four of article 4 of the Law of Ukraine

1. Approve the enclosed Regulations on electronic regulatory Platform.

2. To submit to legal support department in the procedure established by the legislation this resolution on state registration to the Ministry of Justice of Ukraine.

3. This resolution becomes effective from the date of its official publication.

4. The electronic regulatory platform is put into operation step by step (separate subsystems) after the end of trial operation with participation of suppliers of electronic communication networks and/or services.

Start date of functioning of electronic regulatory platform (its separate subsystem) is the date determined in the decision of NKEK on the beginning of functioning of electronic regulatory platform (its separate subsystem), published on the NKEK official website.

Regulations on electronic regulatory platform

I. General provisions and organizational bases of functioning

1. The electronic regulatory platform (dalee-Platforma) is the automated information-analytical system of NKEK used for accomplishment by it of the powers provided by the Law of Ukraine "About electronic communications" (further - the Law), the Law of Ukraine "About the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service", the Law of Ukraine "About mail service", and provisions of administrative services in electronic form, electronic information exchange, documents and interactions with operators of mail service, suppliers of electronic communication networks and/or services, suppliers of the radio equipment, users of radio-frequency range and resources of numbering, users of electronic communication services, the state electronic information resources.

2. In this Provision terms are used in the values given in the Laws of Ukraine "About electronic communications", "About electronic identification and electronic confidential services", "About information protection in information communications systems", "About information", "About access to public information", "About the basic principles of ensuring cyber security of Ukraine", "About public electronic registers".

3. The owner (holder) Platformy and exclusive property rights of intellectual property on its software is the state on behalf of NKEK. Holder Platformy is NKEK.

4. Manager of information in platform is NKEK providing its obtaining, creation, processing, accumulating, preserving and protection, its promulgation and provision in the procedure established by the legislation, permanent updating in the structured type which provides convenience of navigation and search capability.

5. The platform is object of the right of state-owned property, the state information resource.

6. Representation according to the Law and the Laws of Ukraine "About the National commission performing state regulation in spheres of electronic communications, radio-frequency range and provision of services of mail service", "About mail service" messages, information letters, statements, reports, requests on provision of excerpts from registers, other documents and information in NKEK and obtaining from NKEK of decisions, licenses, permissions, other documents by suppliers of electronic communication networks and/or services, users of radio-frequency range, users of resource of numbering, suppliers of the radio equipment, operators of mail service are performed through electronic office on platform using means of the qualified digital signature according to the Law of Ukraine "About electronic identification and electronic confidential services".

In case of impossibility of use of platform (suspension of its work more than for one days) sending documents, except the reporting, stipulated by the legislation, can be performed by one of methods, stipulated in Item 8 these Sections. At the same time the terms of submission of the relevant documents established by the legislation or NKEK are prolonged for 3 working days.

Information which is available in the NKEK databases is automatically entered to messages, statements, reports, other documents and information in case of their forming on the Platform.

NKEK on the official website reports about impossibility of use of platform (in particular, celebrates date and time of suspension of work) and about renewal of its work.

Notifications, statements, reports, other documents and information which could not be submitted to the time determined for this purpose because of suspension of work of the Platform (its part) are considered given in time if they are given within 3 working days from the date of resumption of work of the Platform, irrespective of duration of such suspension.
