Questions of implementation of the pilot project on implementation of commodity-transport delivery note electronically in the field of domestic freight transportation

The Cabinet of Ministers of Ukraine decides:

1. Agree with the offer of the Ministry of development of communities, the territories and infrastructures concerning realization within two years of the pilot project on implementation of commodity-transport delivery note electronically with use of electronic document management system electronic commodity-transport waybill in the field of domestic freight transportation (further - the pilot project).

2. Approve the Procedure for implementation of the pilot project on implementation of commodity-transport delivery note electronically in the field of the enclosed domestic freight transportation.

3. Determine that:

1) for implementation of the pilot project Items 2 and 18 of the Procedure for maintaining the Unified register of commodity-transport delivery notes on movement of alcoholic beverages approved by the resolution of the Cabinet of Ministers of Ukraine of October 9, 2013 No. 806 (The Official Bulletin of Ukraine, 2013, No. 87, Art. 3219; 2019, No. 54, Art. 1878), are applied in the part which is not contradicting the Procedure approved by this resolution;

2) coordinator of the pilot project is the Ministry of development of communities, territories and infrastructure;

3) participants of the pilot project are the Ministry of development of communities, territories and infrastructure, Public service of safety on transport, the Department of Energy, the Ministry of agrarian policy, the Ministry of Internal Affairs, National police, the State Tax Service, the Agency of recovery and development of infrastructure, Public service on safety issues of foodstuff and consumer protections, the state company "Industry Center of Digitalization and Cyber Security", and also from consent "Institute of Analytics and Advokation" public organization, participants of freight transportation, operators of platforms of electronic document management, users.

4. Financial provision of actions for implementation of the pilot project is performed due to the international technical irretrievable financial aid of the international organizations within aid programs and grants of the European Union, the governments of foreign states, the international organizations, donor organizations, and also at the expense of other sources which are not prohibited by the legislation.

5. To the ministry of development of communities, territories and infrastructures:

1) within three months from the date of entry into force of this resolution to approve procedure for functioning of electronic document management system electronic commodity-transport waybill;

2) to provide electronic information exchange between electronic document management system electronic commodity-transport waybill and the state electronic information resources, in particular system of weighing in movement (WIM), the unified register of commodity-transport delivery notes on movement of alcoholic beverages, single state system of electronic accounting of wood, information systems of Public service on safety on transport, etc.;

3) tax not later than in two months after completion of implementation of the pilot project to the Cabinet of Ministers of Ukraine the report on results of its realization;

4) by results of implementation of the pilot project to submit to the Cabinet of Ministers of Ukraine proposals on feasibility of modification of legal acts.

Procedure for implementation of the pilot project on implementation of commodity-transport delivery note electronically in the field of domestic freight transportation

1. This Procedure establishes the realization mechanism in the territory of Ukraine of the pilot project on implementation of commodity-transport delivery note electronically in the field of domestic freight transportation with use of electronic document management system electronic commodity-transport waybill (further - the pilot project).

2. The terms used in this Procedure have the following value:

the database of commodity-transport delivery note in electronic form - the specialized electronic database which is component of electronic document management system electronic commodity-transport waybill (further - system of commodity-transport delivery note) also performs functions of accounting of commodity-transport delivery note electronically by participants of freight transportation;

the user person which underwent the procedure of registration and got access to personal account of the user and is the participant of freight transportation or the subject of managing providing (carries out) services (work) referred to complex of the auxillary operations connected with domestic freight transportation either on position or on other bases (under the agreement, the power of attorney, etc.) acts from their name and in their interests;

the operator of platform of electronic document flow subject of managing registered in the procedure established by the law in the territory of Ukraine which has the right to use platform of electronic document management also provides access to it to participants of freight transportation, and underwent the procedure of accession to system of commodity-transport delivery note;

personal account of the user - the personified web interface or the applied program interface (API) on the Internet provided to the user on platform of electronic document management which provides opportunity to use functions of system of commodity-transport delivery note;

the platform of electronic document flow - the software (online service), access to which is provided by means of the Internet which provides functioning of electronic document management, including gives to participants of freight transportation opportunity to use functions of system of commodity-transport delivery note and to perform exchange of information between them;

the system of commodity-transport delivery note - the information and communication system providing information processing on commodity-transport delivery note electronically is equipped with mechanisms of safety and information security from its loss, misuse and changes which consists of the database of commodity-transport delivery note electronically and the software intended for data exchange and interaction with platforms of electronic document management and other information, electronic communication or information and communication systems;

participants of cargo transportations - legal entities, physical persons and physical persons - entrepreneurs who in the course of domestic freight transportation can act in the status of the customer of services in cargo hauling, the consignor, the consignee or the freight forwarder.
