1. Approve Regulations on procedure for issue of documents for designing, construction and other changes of real estate objects and assessment of conformity put into operation completed by construction of facilities in the Kyrgyz Republic according to appendix.

2. To the ministries, the state committee, administrative departments and other executive bodies, local public administrations and local government bodies (under approval) to bring the decisions into accord with this resolution in a month.

3. Declare invalid the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Regulations on procedure for issue of documents for designing, construction and other changes of the real estate objects and assessment of conformity put into operation completed by construction of facilities in the Kyrgyz Republic" of August 6, 2021 No. 114.

4. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

5. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for issue of documents for designing, construction and other changes of real estate objects and assessment of conformity put into operation completed by construction of facilities in the Kyrgyz Republic

Chapter 1. General provisions

1. This Provision is developed for the purpose of regulation of processes of issue of documents for designing and construction of facilities, according to the Land code of the Kyrgyz Republic, the Housing code of the Kyrgyz Republic, the laws of the Kyrgyz Republic "About bases of the town-planning legislation of the Kyrgyz Republic", "About town planning and architecture of the Kyrgyz Republic" and "About individual housing construction in the Kyrgyz Republic".

2. This Provision regulates procedure and procedures of issue of allowing documents for designing, construction and other changes of real estate objects in process:

1) preparation and issue of the town-planning conclusion with the agreed project;

2) examinations of the project documentation;

3) assessments of conformity put into operation completed by asset construction.

3. The right to construction and other construction changes of real estate objects have the physical persons and legal entities having the property rights, leases, urgent (temporary) or unlimited use on the parcels of land and other real estate objects according to the legislation of the Kyrgyz Republic in the field of land relations, architectural and town-planning activities and this Provision.

4. In case of influence of construction intentions on the immovable objects which are monuments of historical and cultural heritage and the nature, their conservation zones according to the legislation of the Kyrgyz Republic in the field of protection and use of historical and cultural heritage the customer before filing of application in territorial authority in the field of architectural and construction activities shall receive the consent of authorized state body on protection and use of historical and cultural heritage and on environmental protection.

5. In this Provision the following concepts are used:

designer's service - implementation by the author of the project of control of compliance of architectural and construction, technology and other technical solutions in the period of construction and commissioning of construction objects to project decisions;

the architectural town-planning council (ATPC) - the permanent collegiate organ formed for the solution of questions in the field of designing and construction of gradoformiruyushchy, particularly complex and unique objects which structure and powers affirm authorized state body of architecture and town planning;

the architectural and technical council (ATC) - the permanent collegiate organ formed for the strategic solution of questions of construction, engineering support and regulation of construction which structure and powers affirm authorized state body of architecture and town planning;
