About approval of the Regulations on public control in the sphere of improvement of settlements

According to article 41 of the Law of Ukraine "About improvement of settlements", for the purpose of establishment of the legal basis of activities of public inspectors of improvement of settlements of PRIKAZYVAYU:

1. Approve Regulations on public control in the sphere of improvement of settlements which is applied.

2. To submit to management of improvement and public service (Ya. A. Stetsenko) together with Department of legal providing (O. I. Liashengko) this order in accordance with the established procedure to the Ministry of Justice for state registration.

3. To management of improvement and public service (Ya. A. Stetsenko) to bring this order to permission of local executive bodies and local government bodies.

4. To impose control of execution of this order on the deputy minister G. M. Semchuk.

Regulations on public control in the sphere of improvement of settlements

1. General provisions

1.1. This Provision is developed according to article 41 of the Law of Ukraine "About improvement of settlements".

1.2. Public control in the sphere of improvement of settlements is exercised by public inspectors of improvement of settlements (further - public inspectors).

2. Organization of activities of public inspectors

2.1. Activities of public inspectors are organized and coordinate local public administrations.

2.2. Public inspectors in the activities are guided by the Constitution of Ukraine, the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, other regulatory legal acts and standards concerning requirements for improvement of settlements, orders of the central executive body concerning housing and communal services, orders and orders of Council of Ministers of the Autonomous Republic of Crimea, local public administrations, village, settlement, city councils and their executive bodies, the Rules of improvement of the territories approved in accordance with the established procedure in the respective settlement and this Provision.

3. Procedure for appointment of public inspectors

3.1. Public inspectors can be citizens of Ukraine who reached 18 years, have work experience in the sphere of improvement and had interview in the relevant local public administration.

3.2. The citizen wishing to be the public inspector submits the written application of any form to the relevant local public administration. Representation to the organization recommending it or the written petition of the relevant structural division of local public administration concerning housing and communal services to which conducting the question on improvement of the settlement belongs can be enclosed to the application.

3.3. Public inspectors are appointed by the relevant local public administrations after interviewing and manifestation by the applicant of knowledge of legislation bases concerning improvement of settlements.

3.4. Public inspectors receive certificates of the established sample, the powers (appendix) confirming them.

3.5. Certificates of the public inspector of improvement of settlements issue the relevant local public administrations for a period of one year with annual prolongation by results of assessment quarterly and the annual public inspector of reports on the performed work.

3.6. In the certificate of the public inspector the territory within which he can perform the powers is determined.

3.7. Public inspectors perform work on a voluntary basis, without release from the main work and without additional payment of work.

3.8. The public inspector shall undergo instructing in the relevant local public administration to which the certificate, concerning implementation of inspection checks, creation by their results of protocols on legislation offense in the sphere of improvement of settlements and personnel safety notification is issued.

4. Coordination of activities of public inspectors

4.1. Public inspectors work in close interaction with the relevant local public administrations which appointed them and issued the certificate of the public inspector of improvement of settlements, other state bodies exercising control of condition and content of subjects to improvement of settlements.

4.2. Each public inspector is assigned to department or the sector of the relevant structural division of local public administration concerning housing and communal services to which conducting the question on improvement of the settlement which field of activity matches industry activity of the public inspector belongs.
