About approval of requirements to marking and packaging of seeds and planting stock

According to the paragraph to the eleventh articles 7, of article 21 of the Law of Ukraine "About seeds and planting stock", Item 8 of the Regulations on the Ministry of Agricultural Policy and Food of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of February 17, 2021 No. 124, I ORDER:

1. Approve enclosed:

Requirements to marking and packaging of seeds;

Requirements to marking and packaging of planting stock.

2. Determine that:

forms of labels, numbers to which were assigned by the conformity assessment body falling within the scope of management of Minagropolitiki before entry into force of this order can be used by subjects of seed farming and pitomnikovodstvo within two months after entry into force of this order;

provision in the market of batches of seeds which are marked and packed according to procedure for marking and packaging of batches of seeds of the Ministry of Agricultural Policy and Food of Ukraine approved by the order of July 10, 2017 No. 348, registered in the Ministry of Justice of Ukraine on September 18, 2017 baking plate No. 1142/31010, and are introduced into circulation before entry into force of this order or within two months after entry into force, cannot be limited or it is forbidden for the reasons of discrepancy to all or separate requirements approved by this order.

3. Declare invalid the order of the Ministry of Agricultural Policy and Food of Ukraine of July 10, 2017 No. 348 "About approval of procedure for marking and packaging of batches of seeds and forms of the label", the baking plate No. 1142/31010 registered in the Ministry of Justice of Ukraine on September 18, 2017.

4. To provide to department of agrarian development in the procedure established by the legislation submission of this order on the state registration in the Ministry of Justice of Ukraine.

5. This order becomes effective in six months from the date of its official publication.

6. To impose control over the implementation of this order on the deputy minister according to distribution of obligations.

Requirements before marking and packaging of seeds

1. These Requirements extend to marking and packaging of seeds which is performed by subjects of seed farming and pitomnikovodstvo, physical persons - the entrepreneurs and legal entities (further - subjects) performing production, completion, storage and realization of seeds according to requirements of the Law of Ukraine "About seeds and planting stock".

2. In these Requirements terms are used in the following values:

sealing fixing of seal, the label and/or other designation, method which makes impossible opening of packaging (container) without its damage;

batch of seeds (except seed mixture) - certain quantity of seeds of one category (generation) and one grade;

seed mixture batch - the mixed batches of seeds relating to different grades and/or types.

3. All batches of seeds of categories dobazovy and basic irrespective of assignment and seeds of category certified the first generation which are intended for realization are subject to obligatory packaging and marking.

4. Batches the category seeds certified (except the first generation) which are intended for realization, it is allowed to store unpacked (in granaries, open heaps), but with obligatory placement of the relevant information on such batch on granary, open heap.

5. The main types of packaging (containers) applied to packaging of seeds are sacks, bags, packets, containers and bigbeg of different reservoir, with use, in particular, of such methods of closing: self-becoming isolated, stuck together, hermetic, connected, welded, the changes of their content providing reliable integrity of their content in storage time and transportations and excluding after closing.

Sacks, bags and packets with seeds sew up with machine method, using threads according to the existing regulating documents providing the mechanical durability of sewing.

7. Packaging (container) shall be whole, strong, net, dry and disinfected from wreckers and causative agents of diseases. For packaging of the seeds intended for realization use only new packagings (containers).

Seeds of oil-bearing, essential oil-bearing, feed and melliferous crops pack into double sack tare or multi-wall paper bags and packets. It is allowed to use as external packaging - cloth sacks and as internal - the plastic bags or investments made of polyethylene film or polypropylene.

8. The seeds intended for retail trade pack up in small consumer pack (small packets) with possible subsequent bagging, boxes, boxes, packs and other containers, taking into account provisions of these requirements.

Those which net weight does not exceed are considered as small packets:

for seeds of bean cultures - 5 kg;

for seeds of onions, chervil, asparagus, spinach or mangold, red beet, turnip, water-melon, pumpkin, vegetable marrows, carrots, garden radish, skortsoner or black loach, corn salad or mutton salad-0,5 of kg;

for seeds of all other types of vegetable cultures-0,1 of kg;

for seeds of sugar or fodder beet of category certified - 2, kg or 100 000 seeds, mnogorostkovy seed-10,0 of kg (less weight or the mass of substance, used for pelleting or incrustation);
