About streamlining of celebrations and ceremonies in the Republic of Tajikistan

This Law determines procedure for holding celebrations and ceremonies, Tajikistan is directed to protection of true values of national culture, prevention of superstition and fanaticism, increase in spirituality, social and economic level of the life of people.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) ceremony - set of the symbolical and traditional actions expressing the relation of person and social groups to the important phenomena of cultural life of society;

2) celebration - the celebration of events or historical, cultural, public, professional and family dates.

Article 2. Coverage of this Law

1. Operation of this Law extends to state bodies, self-government institutions of settlements and dekhot, public and religious associations, the companies, organizations and other organizations, irrespective of their departmental subordination and patterns of ownership, and also to physical persons, irrespective of their social and economic situation.

2. Representatives of other nations and the people, other religions and sects can hold the celebrations and ceremonies, proceeding from the customs and traditions. They hold the celebrations and ceremonies provided by this Law with observance of provisions of this Law.

Article 3. Legislation of the Republic of Tajikistan on streamlining of celebrations and ceremonies

The legislation of the Republic of Tajikistan on streamlining of celebrations and ceremonies is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.

Chapter 2. Competence and powers of public authorities and self-government institutions of settlements and dekhot on streamlining of celebrations and ceremonies

Article 4. Competence of the Government of the Republic of Tajikistan on streamlining of celebrations and ceremonies

1. On streamlining of celebrations and ceremonies treat competence of the Government of the Republic of Tajikistan:

1) conducting state policy on streamlining of celebrations and ceremonies;

2) determination of authorized state body on streamlining of celebrations and ceremonies;

3) approval of standard provision of the local permanent commissions on streamlining of celebrations and ceremonies;

4) approval of standard provision of the public commissions on streamlining of celebrations and ceremonies;

5) approval of procedure for trip of citizens for making of hajj and umra;

6) decision making about celebration at the national level of date of creation of the companies, organizations and other state organizations, and also anniversaries and days of remembrance of persons having high merits before the state and society;

7) implementation of other powers, stipulated by the legislation Republic of Tajikistan.

2. In exceptional cases, with observance of provisions of the legislation of the Republic of Tajikistan, the Government of the Republic of Tajikistan in case of emergency state, pandemic of infectious diseases, emergency situations of natural and technogenic nature, can establish rationing arrangements on holding celebrations and ceremonies.

Article 5. Powers of authorized state body on streamlining of celebrations and ceremonies

On streamlining of celebrations and ceremonies treat powers of authorized state body:

1) implementation of state policy on streamlining of celebrations and ceremonies;

2) project development of the laws, other regulatory legal acts of the Republic of Tajikistan on streamlining of celebrations and ceremonies;

3) approval of procedure for carrying out ceremony of funeral and mourning;

4) the organization of trip of citizens for making hajj and umra;

5) explanation and interpretation of questions on streamlining of celebrations and ceremonies;

6) control of execution of requirements of this Law and other regulatory legal acts about celebrations and ceremonies;

7) taking measures to ensuring compliance with this Law;

8) making recommendations for the correct implementation of charitable works and donations;

9) taking measures to eradication of superstition and fanaticism;

10) taking measures to prevention of squandering and excess in holding celebrations and ceremonies;

11) taking measures to prevention of early and unofficial marriages;

12) ensuring interaction between state bodies and public and religious associations on streamlining of celebrations and ceremonies and the organization of educational and propaganda activities among the population;

13) promotion scientifically - popular literature on streamlining of celebrations and ceremonies;

14) requesting of information from the ministries and departments, local executive bodies of the government, the local permanent commissions on streamlining of celebrations and ceremonies, public and religious associations, the companies, organizations and other organizations, irrespective of departmental subordination and patterns of ownership, about accomplishment of regulatory legal acts of the Republic of Tajikistan on streamlining of celebrations and ceremonies;

15) implementation of other powers, stipulated by the legislation Republic of Tajikistan.

Article 6. Powers of local executive bodies of the government and self-government institutions of settlements and dekhot on streamlining of celebrations and ceremonies

On streamlining of celebrations and ceremonies treat powers of local authorities of the government and self-government institutions of settlements and dekhot:

1) participation in implementation of state policy on streamlining of celebrations and ceremonies;

2) taking measures to ensuring compliance with this Law;

3) ensuring interaction between state bodies and public and religious associations on streamlining of celebrations and ceremonies and the organization of educational and propaganda activities among the population;

4) participation in promotion is scientific - popular literature on streamlining of celebrations and ceremonies;

5) implementation of other powers, stipulated by the legislation Republic of Tajikistan.

Article 7. Local permanent commissions on streamlining of celebrations and ceremonies

1. For implementation of this Law under local executive bodies of the government and jamias of settlements and dekhot the local permanent commissions on streamlining of celebrations and ceremonies are created.
