About purchase of the machinery and equipment

For the purpose of purchase of the machinery and equipment by the insolvent organizations, and also I decide debt repayments under agreements of finance lease (leasing):

1. JSC Promagroleasing:

1.1. in 2024 to conduct procurement of the machinery and equipment for subsequent their transfer under agreements of finance lease (leasing) on the conditions established by the Presidential decree of the Republic of Belarus of April 2, 2015 No. 146 through the credits of JSC Development Bank Republic of Belarus (further - Development bank) provided within the amount of financing according to the Presidential decree of the Republic of Belarus of the April 2, 2015 to No. 146 "About financing of purchase of the modern machinery and equipment" determined in funding plan of state programs and actions for 2024:

to the insolvent organizations for construction and operation of meliorative systems based on the lists determined by regional executive committees and the decisions on financing made by them in the amount to 26, 7 million rubles, including on the organizations:

The Brest region - to 2 million rubles;

The Vitebsk region - to 10, 6 million rubles;

The Gomel region - to 2, 4 million rubles;

The Minsk region - to 6, 7 million rubles;

The Mogilev region - to 5 million rubles;

to the insolvent organizations of agro-industrial complex based on the lists determined by regional executive committees and the decisions on financing made by them in the amount to 81, 1 million rubles, including on the organizations:

The Brest region - to 16 million rubles;

The Gomel region - to 13, 9 million rubles;

The Grodno region - to 25, 6 million rubles;

The Mogilev region - to 25, 6 million rubles.

Acquisition of the machinery and equipment according to part one of this subitem is performed by the insolvent organizations without payment of advance payment.

Regional executive committees:

within five working days from the date of entry into force of this Decree direct the decisions provided in part one of this subitem, in JSC Promagroleasing;

in case of change of the insolvent organization or the name of the machinery and equipment and (or) their cost within one working day inform JSC Promagroleasing with the subsequent introduction in coordination with this society of corresponding changes into the decisions specified in part one of this subitem;

1.2. obligation fulfillment under agreements of finance lease (leasing) is performed at the expense of the means accumulated on the special accounts of the insolvent organizations of agro-industrial complex opened in Development bank according to item 4 of the Presidential decree of the Republic of Belarus of April 2, 2015 No. 146, and own means of data of the organizations and also at the expense of own means of the insolvent organizations for construction and operation of meliorative systems.

In case of non-execution of obligations by the insolvent organizations * under agreements of finance lease (leasing) their execution is performed by regional executive committees for the account:

means of the corresponding local budgets provided on financing of agricultural industry and fishing activities;

the subventions provided in Item 5 of this Decree by their direction into the special account opened for JSC Promagroleasing in Development bank according to the Presidential decree of the Republic of Belarus of June 21, 2011 No. 261 "About creation of "Development Bank of the Republic of Belarus" open joint stock company.

JSC Promagroleasing no later than the 15th following reporting sends to the Ministry of Finance information on availability delayed more than for 30 days of debt of the insolvent organizations for agreements of finance lease (leasing).

The Ministry of Finance based on information of JSC Promagroleasing stops on the overdue debt amount transfer from the republican budget to consolidated budgets of areas of grants and (or) subventions on financing of expenses on development of agricultural industry and the fishing activities transferred according to the law on the republican budget for the corresponding financial year before complete repayment of overdue debt or refining of indicators of the republican budget according to Item 5 of this Decree.

2. To the Vitebsk regional executive committee:

2.1. perform in 2024 bond emission, nominated in Belarusian rubles, in the amount of no more 34, 5 million rubles with the following provisions:

circulation period - till December 31, 2025;

the size of rate of interest income - 2/3 refunding rates of National Bank (taking into account its change). Payment of interest income is performed monthly, since the month following after month of the beginning of placement of bonds;

early repayment of bonds - monthly equal shares since January, 2025.

Bonds are placed by the closed sale of JSC Promagroleasing step by step (monthly) in the amounts which are not exceeding the amount of the overdue debt formed on the date of entry into force of this Decree on the first day of every month in December, 2024 - for December 23, 2024 under agreements of finance lease (leasing), before JSC Promagroleasing of the organizations of the Vitebsk region (except for JSC Vitebskoblavtotrans) on which according to the Presidential decree of the Republic of Belarus of April 2, 2015 No. 146 makes decisions of regional executive committee on financing at the expense of means of the regional budget of acquisition of the modern machinery and equipment. The amount of overdue debt is determined according to reconciliation statements of calculations between JSC Promagroleasing and the specified organizations;

2.2. allocate the funds received from placement of the bonds specified in part one of subitem 2.1 of this Item no later than one working day following behind day of their placement on repayment of overdue debt of the organizations of the Vitebsk region (except for JSC Vitebskoblavtotrans) before JSC Promagroleasing.

3. It is allowed:

execution of the consolidated budget of the Vitebsk region in 2024 with reduction of the minimum extent of surplus (increase in the maximum extent of deficit) in connection with financing of the expenses provided in subitem 2.2 of Item 2 of this Decree;
