About measures for the effective organization of execution of the Law of the Republic of Uzbekistan "About conflict of interest"

Determine that effective implementation of the requirements and mechanisms established by the Law in state bodies and the organizations, ensuring protection of the rights and interests of employees in this process, and also carrying out necessary explanatory work among them is assigned to the first heads of state bodies and organizations.

Determine the main objectives of the Republican interdepartmental commission:

the analysis of opportunities of effective implementation of mechanisms of identification of conflict of interest in state bodies and the organizations;

studying of the situations leading to conflict of interest in the state bodies and the organizations, forming of single practice on taking measures directed to their elimination according to the legislation;

ensuring enhancement of information systems, trade platforms and other software of state bodies and organizations according to the requirements established by the Law;

taking measures to coordination of activities and development of cooperation of the state bodies performing activities for anti-corruption regarding identification and elimination of cases of conflict of interest;

the organization of development and implementation of measures for increase in legal culture for prevention and elimination of conflicts of interest in society.

Determine that the anti-corruption Agency and the Ministry of Justice are working bodies of the Republican interdepartmental commission.

3. Republican interdepartmental commission (A. Aripov):

a) till July 1, 2024 to provide forming of the specific list of state bodies and organizations to which operation of the Law will extend (further - the list);

b) before entry into force of the Law to organize studying of the questions connected with practical implementation of the requirements and mechanisms specified in it by forming of the corresponding working groups in the state bodies and the organizations specified in the list.

At the same time to pay special attention:

to identification of situations in state bodies and the organizations which can lead to conflict of interest, and taking measures to their elimination;

to studying of observance of restrictions on prevention of conflict of interest by the staff of state bodies and the organizations in their activities, including to identification of such cases, as part-time job, participation in business activity;

to studying of adjustment in state bodies and the organizations of activities of divisions for anti-corruption, and also their completeness by qualified personnel;

to carrying out the analysis of the data connected with conflict of interest on the E-anticor.uz platform implemented for activities efficiency evaluation in state bodies and the organizations for anti-corruption;

to studying of compliance of information systems, trade platforms and other software of state bodies and organizations to requirements of the Law, and also taking measures to their enhancement;

c) after entry into force of the Law to provide:

quarterly carrying out accident analysis by working bodies of the Republican interdepartmental commission, led to emergence of conflict of interest, by state bodies and the organizations, and also introduction of the corresponding submissions to state bodies and organizations in which such cases, for determination of immediate measures became frequent;

each half a year carrying out critical discussion at meetings of the Republican interdepartmental commission of the measures taken on identification and elimination of conflicts of interest, and also prevention of such situations with participation of the first heads of the relevant state bodies and organizations.

4. To anti-corruption agency (A. Burkhanov) together with the Ministry of digital technologies (Sh. Shermatov) and other interested departments until the end of 2024 for the purpose of creation of conditions for identification of cases of conflict of interest in state bodies and the organizations to provide:

start of the electronic module on the electronic E-anticor.uz platform allowing to perform online monitoring and identification of the situations connected with conflict of interest;

integration of the corresponding information systems of the Ministry of employment and reducing poverty, the Ministry of Justice, Ministry of Economics and finance, the Tax Committee, Agency of development of public service with the Interdepartmental integration platform of the Electronic Government system.

At the same time by means of the electronic E-anticor.uz platform at the initiative of anti-corruption Agency or on the basis of online request of state bodies and organizations in the following situations cases of conflict of interest come to light:

when studying the notification on real conflict of interest, and also declarations on potential conflict of interest;

when studying protocols and agreements on public procurements, and also information about affiliates and beneficiaries of the commercial organizations;

when checking observance of the set restrictions on prevention of conflict of interest in activities of employees;

when studying the data received from electronic databases for identification of conflicts of interest by structural divisions for regulation of conflict of interest;

in case of verification of addresses about assumption of conflict of interest in state bodies and the organizations in mass media, including on the World information Internet and social networks.

Determine that the expenses connected with creation and upgrade of the electronic module on the electronic E-anticor.uz platform become covered at the expense of Fund of development of public control under anti-corruption Agency.

5. For the purpose of ensuring participation of the public in identification of the cases connected with conflict of interest to implement practice:

payments of the monetary reward in the amount of fifty percent from the amount of the collected penalty to persons which were actively assisting identification of cases of conflict of interest in activities of employees of state bodies and organizations with appendix of the corresponding proofs;

quarterly informing the public by working bodies of the Republican interdepartmental commission on situations in case of which conflicts of interest in state bodies and the organizations, about the taken measures for their elimination, and also prevention of such situations are allowed.

6. To anti-corruption agency (A. Burkhanov) together with the Ministry of Justice (A. Tashkulov):

in two-month time to develop methodical recommendations about regulation of conflicts of interest for state bodies and the organizations;

till October 1, 2024 with involvement of the international experts to approve standard forms of the register of accounting of conflicts of interest, notifications on real conflict of interest and the declaration on potential conflict of interest.

7. To the Ministry of Justice (A. Tashkulov) together with the Prosecutor General's Office (N. Yuldoshev) and anti-corruption Agency (A. Burkhanov):

in a month to carry out online tests for assessment of knowledge and skills of conflict of interest among the staff of the state bodies and the organizations specified in the list;
