1. Approve the enclosed Instruction of use of technical means when implementing the state control and supervision in the field of fire safety for fixing of the facts of making of violations and actions of staff of bodies of civil protection.

2. To provide to committee of fire service of the Ministry of Emergency Situations of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Emergency Situations of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. This Instruction of use of technical means when implementing the state control and supervision in the field of fire safety for fixing of the facts of making of violations and actions of staff of bodies of civil protection (further – the Instruction) determines use by staff of bodies of civil protection (further – the state inspector) technical means (further – the portable wearable video recorder) for fixing of the facts of making of violations and actions of staff of bodies of civil protection.

2. The legal basis of use of the portable wearable video recorder the Entrepreneurial code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About civil protection" and regulatory legal acts of the Republic of Kazakhstan in the field of civil protection constitute the Code of the Republic of Kazakhstan "About administrative offenses".

3. In this Instruction the following concepts are used:

1) the video recorder memory card (further – the memory card) – the removable compact electronic memory device used for storage of information;

2) the data storage server – the server device intended for unloading and storage photo and videos;

3) the subject of the state control and supervision – physical person, the legal entity, its branches and representations, state body behind which activities the state control and supervision are exercised;

4) object of the state control and supervision – the property which is on the property right or other legal cause at the subject of the state control and supervision, subject to the state control and supervision;

5) the portable wearable video recorder is the technical device with function of video and audio of record intended for fixing of the situation occurring during implementation by the state inspectors of the state control and supervision in the field of fire safety.

4. The portable wearable video recorder is intended for fixing of the facts of making of violations and actions of the state inspectors when implementing the state control and supervision in the field of fire safety.

5. The portable wearable video recorder provides the state inspectors when implementing preventive control with visit of subject (object) of control and supervision and check.

Chapter 2. Use of technical means and data storage of audiovideo fixing

The division manager of authorized body determines the employee responsible for issue and acceptance of the portable wearable video recorder (memory card), unloading and storage photo and videos, establishment of date and time on the portable wearable video recorder in case of issue to his state inspector, removal photo and videos from memory cards after their unloading, replacement of the portable wearable video recorder in case of its not working capacity, and also viewing and the analysis of the made photos – and videos (further – the responsible person).

At the same time on the server of data storage the special password which is known only by the responsible person and the division manager of authorized body is established.

7. Accession number for accounting in work in case of issue, acceptance of the device and unloading of details is assigned to each portable wearable video recorder and the memory card.

8. Portable wearable video recorders are stored in divisions of authorized body at the responsible person and issued to the state inspector before implementation of preventive control with visit of subject (object) of control and supervision and check under list in register of issue and delivery of the portable wearable video recorder and memory cards (further – the magazine), according to appendix to this Instruction.

9. The responsible person after installation of memory cards in the portable wearable video recorder, seals seal the specified socket.

10. The magazine is registered in office of divisions of authorized body, sheets are numbered, proshnurovyvatsya and sealed. On the last page of the magazine the responsible person makes entry: "In this magazine it is numbered, strung together and under seal ___ sheets". The log entry is made by ball pen.
