About additional measures for increase in efficiency of use of the subsoil plots containing nonmetallic minerals

In the country for last period considerable work on simplification of the procedure of transfer to use of the subsoil plots containing nonmetallic minerals and to development of nonmetallic source of raw materials of economy is carried out.

At the same time there is number of problems in ensuring effective use of the nonmetallic minerals which are shown in discrepancy of legal acts for allocation of the parcels of land to the regulations regulating provision in use of subsoil plots, operation in the course of production and conversion obsolete, the expired machinery and equipment, the low level of application of modern information and communication technologies on informing subjects of entrepreneurship on fields, prospective areas and rendering the state services to them.

Only during the studying which are carried out in September - November of the current year the facts on 186 subjects who without receipt of the corresponding license got in the illegal way nonmetallic minerals on 26,7 of one billion sum are elicited, besides, 23 subjects who were inefficiently using subsoil plots and did not fulfill licensed requirements are ahead of schedule deprived of right to use by subsoil plots, on balance of the state is returned 55,6 of one million cubic meters and 3,4 of one million tons of inventories of minerals.

For the purpose of ensuring transparency of procedures for transfer of right to use by the subsoil plots containing nonmetallic minerals, broad application of advanced technologies in the course of production and conversion, and also attraction in industry of potential investors:

1. Determine that since January 1, 2019:

in case of allocation (realization) by the ministries, departments and public authorities on places of the parcels of land on which inventories of minerals, and also fields and prospective areas which are on the state balance irrespective of category of land fund are placed the positive decision of the State committee of the Republic of Uzbekistan on geology and mineral resources is received;

provision of the corresponding parcels of land according to borders of subsoil plots, is performed by public authorities on places according to the address of the user the subsoil plots containing nonmetallic minerals, based on permission to right to use by these sites directly and in time not exceeding ten days, without carrying out open tenderings;

works on delimitation of the parcels of land of nonmetallic minerals on places are carried out by at the same time territorial subdivisions of the State committee on land resources, geodesy, cartography and the state inventory and Inspectorate for control of mining-and-geological activities under the State committee of the Republic of Uzbekistan on geology and mineral resources with participation of the user by subsoil plots;

in case of the expiration or early termination of effective period of permission, the State committee of the Republic of Uzbekistan on the geology and mineral resources issued to users by subsoil plots in three-day time in writing notifies on it the State Tax Committee, the State committee of the Republic of Uzbekistan on ecology and environmental protection and public authorities on places;

in case of the expiration or early termination of effective period of permission, issued on right to use by the subsoil plots containing nonmetallic minerals, public authorities on places return the corresponding land in reserve;

in case of failure to carry out by users of subsoil plots of amounts of production of nonmetallic minerals within two years in a row (except for force majeur circumstances), proceeding from the actual amount of production of nonmetallic minerals, undeveloped part of their inventories is transferred to fixed assets of the state, and the parcels of land on which they are placed return to reserve of public authorities on places. At the same time corresponding changes are made to conditions of use of natural resources without renewal of earlier issued permission;

in the conditions of use of subsoil plots for production of nonmetallic minerals investment obligations of the subsoil user are provided.

2. Establish procedure according to which:

since July 1, 2019 the fields of nonmetallic minerals revealed at the expense of means of the Government budget of the Republic of Uzbekistan;

since January 1, 2020 permissions to right to use by the subsoil plots containing all nonmetallic minerals (except for production of sand-gravel materials when clearing beds of the rivers), are issued by the State committee of the Republic of Uzbekistan on geology and mineral resources in time, not exceeding 20 days, on the basis of results of electronic auction on electronic trade platform of "E-AUKSION" in accordance with the established procedure through the information system "License". At the same time it is possible to submit the statement for receipt of permission and the documents attached to it also through the Single portal of interactive state services.

At the same time in case of receipt of permission to mining from the fields reconnoitered by the legal entities and physical persons financing works on geological studying of subsoil the rights established for them by the legislation remain.

The starting price of right to use by the subsoil plots containing nonmetallic minerals is determined in the amount of at least sum of all expenses spent for the organization of auction.

3. Determine that the money acquired from realization rights to use by the subsoil plots containing nonmetallic minerals on electronic trade platform "E-AUKSION" and the amount of the withheld deposit less benefits amount for the organization of auction is enlisted in equal shares:

in local budgets of the respective areas (cities) in the territory of which activities for production of nonmetallic minerals are performed;

into special treasurer accounts of the State committee on geology and mineral resources with the target direction on implementation of annual state programs of development and reproduction of mineral resources.

4. All business entities having permissions to production of natural facing stone (marble, granite, travertine, limestone) and to right to use of technogenic mineral educations till January 1, 2022:

are exempted from customs payment (except charges for customs clearance) for the equipment imported from abroad for own production needs and the special equipment which are not made in the Republic of Uzbekistan, intended for production and conversion of natural facing stones and also for conversion of technogenic mineral formations of natural facing stones according to the lists created in accordance with the established procedure;

the established rate of calculation of the income tax of the legal entities who are engaged in production and processing of natural facing stones, and also conversion of technogenic mineral formations of natural facing stones decreases twice.

5. To the Cabinet of Ministers of the Republic of Uzbekistan in two-month time:

on the basis of studying of environment of the foreign market to approve the actions plan on deep conversion of nonmetallic minerals and increases in export volume of the finished goods made from nonmetallic minerals;
