RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of provision, charge and payment of housing subsidies and privileges for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel taking into account the energy crisis which developed in Kharkiv and settlements of the Kharkiv region

Cabinet of Ministers of Ukraine decides:

1. Bring the enclosed changes in resolutions of the Cabinet of Ministers of Ukraine.

2. To provide to the pension fund of Ukraine completion of information systems of the Pension fund of Ukraine, including the web portal of electronic services of the Pension fund of Ukraine and mobile application of the Pension fund of Ukraine, for the purpose of realization of technical capability of observance of conditions of provision of housing subsidies and privileges for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, the solid and liquid oven household fuel determined by this resolution.

3. To the pension fund of Ukraine, regional and Kiev city to provide to military authorities carrying out information and explanatory work among the population.

4. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

5. This resolution becomes effective from the date of its publication and is applied since May 1, 2024, except item 4 of this resolution which is applied since June 1, 2024.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In Regulations on the procedure for purpose of housing subsidies approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 1995 No. 848 "About simplification of procedure for provision to the population of subsidies for expense recovery for payment of housing and communal services, acquisition of the liquefied gas, solid and liquid oven household fuel" (ZP of Ukraine, 1996, No. 2, Art. 76; Official Bulletin of Ukraine, 2019, No. 69, Art. 2390; 2021, No. 1, Art. 45):

Item 93 to add 1) with the paragraph of the following content:

"Determine that additional accrual of the housing subsidies which are not paid within February, 2022 - June, 2024 according to resolutions of the Cabinet of Ministers of Ukraine of March 7, 2022 No. 215 "About features of charge and payment of money allowances, privileges and housing subsidies for the period of action of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 25, the Art. 1302) and of April 19, 2022 No. 462 "Some questions of provision of privileges and housing subsidies in the conditions of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 35, the Art. 1906), is carried out by territorial authorities of the Pension fund of Ukraine according to the address of the receiver of housing subsidy.";

Item 98 to add 2) with the paragraph of the following content:

"The housing subsidy in not heated season of 2024 for payment of delivery service and to distribution of electrical energy is provided to receivers whose premises are located in settlements of the Kharkiv region in the presence of the contract between the subject of managing providing utility to the consumer and the consumer of such service, irrespective of the actual availability / absence of service on independent of the consumer or the subject of the managing providing utility to the consumer, the reasons.";

Paragraph two of Item 125 to replace 3) with paragraphs of the following content:

"The amount of excessively transferred (paid) funds of housing subsidy provided according to resolutions of the Cabinet of Ministers of Ukraine of March 7, 2022 to No. 215 "About features of charge and payment of money allowances, privileges and housing subsidies for the period of action of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 25, the Art. 1302) and of April 19, 2022 No. 462 "Some questions of provision of privileges and housing subsidies in the conditions of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 35, the Art. 1906), before their complete return is kept by authorized body in case of payment of the monthly amounts of subsidies by their reduction no more than for 20 percent according to the procedure of their provision according to this Provision.

In case of identification based on the recommendations of the Ministry of Finance by results of the verification of the fact of lack of the right which is carried out by him further housing subsidy provided according to the resolution of the Cabinet of Ministers of Ukraine of March 7, 2022 to No. 215 "About features of charge and payment of money allowances, privileges and housing subsidies for the period of action of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 25, of the Art. 1302), the territorial authority of the Pension fund of Ukraine in the presence of the fact of excessively paid means informs person on need of return of the amount of excessively paid means with delivery under the personal signature of the adequate notice in paper form with indication of the reasons of the termination of payments, calculation of the amount of excessively paid means and procedure for their return, and also procedure for appeal of the made decision or through the web portal of electronic services of the Pension fund of Ukraine.

During action of legal regime of warlike situation in Ukraine the territorial authority of the Pension fund of Ukraine can report to person about the made decision according to the procedure, stipulated in Item 62 this provision.".
