About production and realization of material for reproduction and landing of the fruit crops intended for production of fruits

Based on part (7) article 9 of the Law on seeds No. 68/2013 (The official monitor of the Republic of Moldova, 2013, Art. No. 130-134, 417), with subsequent changes, DECIDES: the Government

1. Approve Regulations on production and realization of material for reproduction and landing of the fruit crops intended for production of fruits it (is applied).

2. To impose control over accomplishment of this resolution on the National agency on safety of foodstuff.

3. To assign monitoring of implementation of this resolution to the Ministry of Agriculture and the food industry.

4. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

5. From the effective date this resolution to declare invalid the Order of the Government No. 415/2013 about Norma's statement on production, control, certification and realization of material for reproduction and landing of fruit crops (The official monitor of the Republic of Moldova, 2013, Art. No. 136-139, 502), with subsequent changes.

6. To suppliers to implement material for reproduction and landing of the fruit crops intended for production of fruits which was made according to requirements of the Order of the Government No. 415/2013, before exhaustion of inventories provided that within 60 days from the date of publication of this resolution in the Official monitor of the Republic of Moldova they will report to the National agency on safety of foodstuff the complete information about amount of this material.

Regulations on production and realization of material for the reproduction and landing of fruit crops intended for production of fruits

This Provision shifts the Directive 2008/90/EC of September 29, 2008 on realization of material for reproduction and landing of the fruit crops intended for production of fruits (CELEX: 32008L0090), published in the Official magazine of the European Union by L 267 of October 8, 2008, with the last amendments made by the Executive decision (EU) 2022/1993 of the Commission of October 12, 2022; The Executive directive 2014/96/EU of the Commission of October 15, 2014 about requirements to labeling, sealing and packaging of material for reproduction and landing of the fruit crops intended for production of the fruits falling under action of the Directive 2008/90/EC (CELEX: 32014L0096) of Council, published in the Official magazine of the European Union by L 298 of October 16, 2014, with the last changes made by the Executive directive (EU) 2019/1813 of the Commission of October 29, 2019; The executive directive 2014/97/EU of the Commission of October 15, 2014 about accomplishment of the Directive 2008/90/EC concerning registration of suppliers and grades, and also the general list of grades (CELEX: 32014L0097), published in the Official magazine of the European Union by L 298 of October 16, 2014, and the Executive directive 2014/98/EU of the Commission of October 15, 2014 about accomplishment of the Directive 2008/90/EC of Council concerning specific requirements to childbirth and types of the fruit plants mentioned in appendix I to the directive, specific requirements to which there shall correspond suppliers, and detailed rules of official checks (CELEX: 32014L0098), published in the Official magazine of the European Union by L 298 of October 16, 2014, with the last changes made by the Executive directive (EU) 2022/2438 of the Commission of December 12, 2022.

Chapter I Scope and determinations

1. The regulations on production and realization of material for reproduction and landing of the fruit crops intended for production of fruit (further – the Provision), establish specific conditions for production and realization of material for reproduction and landing of the fruit crops intended for production of fruit in the territory of the Republic of Moldova.

2. This Provision is applied:

1) to the childbirth and types listed in appendix No. 1, and also to their hybrids;

2) to stocks and other parts of the plants belonging to the childbirth or types other than No. listed in appendix 1, or to their hybrids if on them the material belonging to the childbirth or types listed in appendix No. 1, or to their hybrids is imparted or shall take root;

3) without prejudice to the phytosanitary regulations provided in the Law No. 422/2023 on protective measures against organisms, harmful to plants (further – the Law No. 422/2023); and also

4) to groups of goods of the goods items given below in the table according to the Combined commodity nomenclature approved by the Law No. 172/2014:

3. This Provision is not obligatory to application concerning material for reproduction and landing of fruit crops in case of which it was shown that it is intended for export to the countries which are not members of the European Union provided that it is identified and remains in sufficient isolation.

Application of regulations on identification and isolation shall be performed according to the measures developed by the National agency on safety of foodstuff and approved by the Ministry of Agriculture and the food industry.

4. The terms used for the purposes of this provision have the following values:

1) material for reproduction – seeds, parts of plants and any vegetative material, including the stocks intended for reproduction and production of fruit crops;

2) fruit planting stock – the plants intended for landing or change after their realization;

3) grade – group of the plants belonging to one botanical taxon of the lowest of known rank in classification which can:

a) to be determined by expressiveness of the signs caused by this genotype or combination of genotypes;

b) differ from any other group of plants in expression at least of one of the specified signs; and

c) be considered as a unit, considering possibility of its reproduction when preserving in invariable type;

4) clone – genetically homogeneous posterity arising in case of vegetative propagation from one plant;

5) prebasic material – material for reproduction, which:

a) it was made according to the commonly accepted methods for preserving high-quality identity, including relevant pomological characteristics for the prevention of diseases;

b) it is intended for production of basic material or the certified material which are not fruit planting stock;

c) meets special requirements to prebasic material;

d) it is acknowledged as a result of official check to the answering conditions specified in letters a), b) and c);

6) basic material – material for reproduction, which:

a) it is made in the vegetative way from prebasic material directly or as a result of passing of the known number of stages when preserving high-quality identity, including the corresponding pomological characteristics for the prevention of diseases;

b) it is intended for production of the certified material;

c) meets special requirements to basic material;

d) it is acknowledged as a result of official check to the answering conditions specified in letters a), b) and c);

7) the certified material is:

a) material for reproduction, which:

- it was made in the vegetative way directly from basic material or prebasic material or it is intended for production of stock from the certified seeds coming from the basic or certified stock material;

- it is intended for production of fruit planting stock;

- meets the specific requirements to the certified material;

- it was recognized as official check to the answering conditions specified in paragraphs from the first on third;

b) fruit planting stock, which:

- it was made directly from the certified, basic or prebasic material for reproduction;

- it is intended for production of fruit;

- meets the specific requirements to the certified material;

- it was recognized as official check to the answering conditions specified in paragraphs from the first on third;

8) the material CAC (Conformitas Agraria Communitatis) – material for reproduction and landing of fruit crops, which:

a) has high-quality identity and the corresponding varietal purity;

b) it is intended for:

- productions of material for reproduction;

- productions of fruit planting stock; and/or

- productions of fruits;

c) meets the specific requirements to the material CAC;
