About measures for the effective organization of activities of Committee of industrial, radiation and nuclear safety under the Cabinet of Ministers

According to the Presidential decree of the Republic of Uzbekistan of May 24, 2024 No. UP-79 "About Measures for Enhancement of System of Public Administration and Control in the field of Use of Subsoil, Industrial, Radiation and Nuclear Safety, and also Use of Atomic Energy":

1. Approve:

The main activities of Committee of industrial, radiation and nuclear safety under the Cabinet of Ministers according to appendix No. 1;

Organizational structure of Committee of industrial, radiation and nuclear safety under the Cabinet of Ministers according to appendix No. 2;

"Road map" on establishing activities of Committee of industrial, radiation and nuclear safety under the Cabinet of Ministers and to enhancement of the state control in the field of industrial, radiation and nuclear safety according to appendix No. 3*.

Appendix No. 3 is given in Uzbek.

2. Form:

in structure of Committee of industrial, radiation and nuclear safety under the Cabinet of Ministers (further - Committee) - the Department of radiation and nuclear safety (further - Department) financed by means of the Government budget without formation of legal entity;

under Committee - Scientific and technological center of radiation and nuclear safety (further - the Center) in the form of public institution.

3. Approve the Main objectives of Department of radiation and nuclear safety of Committee of industrial, radiation and nuclear safety under the Cabinet of Ministers according to appendix No. 4.

4. Determine that:

a) the vice-chairman of Committee at the same time is department head;

b) officials of Committee when implementing the state control have the right:

easy access to objects under control to Committee;

control observance of requirements of industrial, radiation and nuclear safety on hazardous production facilities;

stop works which are conducted without observance of requirements of industrial, radiation and nuclear safety or can lead to emergence of unfortunate incidents and accidents, and also to remove people from workplaces in case of threat of their life;

make decisions on administrative prosecution of officials of the organizations and physical persons for violations of requirements of the legislation and regulating documents in the field of technical regulation within the powers;

c) accommodation of personnel of the Committee providing constant control behind condition of the subjects to use of atomic energy which are under construction and operated in regions of the republic, is performed directly on these objects.

At the same time the organizations operating subjects to use of atomic energy, and the organizations performing construction of facilities of use of atomic energy on a grant basis provide necessary conditions for accommodation and accomplishment of the assigned functions by personnel of Committee.

5. Form under Committee off-budget fund on support of the sphere of industrial safety (further - Fund) without the status of the legal entity.

Determine that:

a) sources of forming of fund are:

the means arriving in Committee from rendering the state services in the field of industrial, radiation and industrial safety according to the procedure and the sizes established by the legislation;

means in the amount of 40 percent of the amount of the penalties collected by Committee at business entities, their officials and physical persons for violation of requirements of the legislation in the field of industrial, radiation and nuclear safety and regulating documents in the field of technical regulation according to the procedure and the sizes established by the legislation;

the funds allocated by the organizations in system of Committee in accordance with the established procedure;

means of the international financial institutions, grants of the donor organizations;

other sources which are not forbidden by the legislation;

b) fund is allocated on:

strengthening of material and technical resources of Committee and the organizations in its system;

implementation in activities of Committee of information technologies and their upgrade;

material stimulation and social protection of employees of Committee;

preparation, retraining, advanced training of employees of Committee and passing of training by them, including organization of official journeys to foreign countries, ensuring participation in the international conferences, seminars and other actions;

rendering expert and advisory services in the sphere of radiation and nuclear safety;

financing of other actions connected with support and development of activities of Committee.

6. Grant to the chairman of Committee the right:

establish the additional stimulating payments for employees of Committee by fund on the basis of assessment of key performance indicators of their activities;

attract foreign specialized institutes and the companies, and also foreign specialists and experts to implementation of works on examination for the purpose of licensing of activities in the field of use of atomic energy in the territory of the Republic of Uzbekistan.

7. To committee:

a) in week time to approve structure of Department;

b) together with the Department of Energy, the Ministry of the mining industry and geology, the Agency on atomic energy till September 1, 2025 to make in the Cabinet of Ministers reasonable offers on increase in quantity of established posts of Department, proceeding from the level of development of nuclear power in the republic and the international standards;

c) together with the Ministry of Economics and finance to bring in the Cabinet of Ministers:

in three-months time - offers on step-by-step adjustment in 2024 - 2026 of activities of the Center financed by the means of the Government budget and other sources which are not forbidden by the legislation and also regulations on the Center, having provided determination of its main objectives;

till December 1, 2024 - suggestion for improvement of activities of Committee on the basis of the best practices of the developed states in the field of control of industrial, radiation and nuclear safety, safety of elevators and park attractions with direct involvement of the international financial institutions and consulting companies. At the same time to provide:

measures for enhancement of mechanisms of interaction with subjects of entrepreneurship in the direction of implementation of the state control in the field of industrial safety;

implementation of the expenses connected with purchase of the modern equipment for Committee, upgrade of its material technical base, complete digitalization of activities at the expense of means of the Government budget.

8. To the Ministry of Economics and finance to allocate limit for maintenance of 3 office vehicles for central office of Committee, including 2 personally fixed and 1 vehicle on duty, and also 5 automobile office vehicles for territorial inspectors.
