Some questions of forest management during action of legal regime of warlike situation and introduction of amendments to the resolution of the Cabinet of Ministers of Ukraine of May 12, 2007 No. 724

The Cabinet of Ministers of Ukraine decides:

1. Determine that for action of legal regime of warlike situation and within six months from the date of its termination or cancellation:

1) the cabins of trees and bushes connected with requirements for defense and safety of the state (further - cabins), are carried out on:

to appeals of military authorities, military command;

the requirement arising in case of change of operational situation in the territories in which fighting is conducted within areas which territorial communities according to the resolution of the Cabinet of Ministers of Ukraine of December 6, 2022 No. 1364 "Some questions of forming of the list of the territories on which are conducted (were conducted) fighting or temporarily occupied by the Russian Federation" (The Official Bulletin of Ukraine, 2022, 99, Art. 6191) are included No. or were included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation (was conducted);

2) cabins are carried out taking into account the following features:

purpose of cabins is performed on materials of inspections of plantings by the commission which is formed in one-day time according to the decision of owners of the woods, permanent forest users accepted based on the received appeals of military authorities, military command (further - the commission).

The commission can be formed in such structure:

- from the consent representatives of local government bodies in the territory of which the plantings requiring cabins grow;

- representatives of military authorities and/or military command, executive body concerning forestry of the Autonomous Republic of Crimea or territorial authority of the State agency of forest resources, territorial authority of the State ecological inspection, the state forest shelter organization, the specialized forest shelter enterprise, and for inspection of plantings within natural and reserved fund - representatives of military authorities and/or military command, the regional, Kiev and Sevastopol city military authorities, and in the territory of the Autonomous Republic of Crimea - executive body of the Autonomous Republic of Crimea concerning protection of the surrounding environment.

Examination of plantings is conducted by the commission in three-day time from the date of its education;

the appeal of military authorities, military command together with materials of inspections of plantings by the commission join the application which is submitted by owners of the woods or permanent forest users for issue of special permission to special use of forest resources (the lesorubny ticket) according to Item 14 of the Procedure for implementation of the pilot project on issue of special permission to special use of forest resources (the lesorubny ticket) electronically approved by the resolution of the Cabinet of Ministers of Ukraine of May 12, 2023 No. 483 (The Official Bulletin of Ukraine, 2023, No. 51, the Art. 2846).

Cabins are also carried out concerning the trees and bushes damaged as a result of military (fighting) operations. Cutting down of such trees is performed only based on materials of inspections within areas which territorial communities according to the resolution of the Cabinet of Ministers of Ukraine of December 6, 2022 No. 1364 "Some questions of forming of the list of the territories on which are conducted (were conducted) fighting or temporarily occupied by the Russian Federation" (The Official Bulletin of Ukraine, 2022, 99, Art. 6191) are included No. or were included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation (was conducted).

Registration of special permission to special use of forest resources (the lesorubny ticket) within a month from the beginning of cabins, except cutting down of the trees damaged as a result of military (fighting) operations is allowed;

the register of the lesorubny tickets issued on carrying out cabins except cutting down of the trees damaged as a result of military (fighting) operations is not subject to promulgation in the form of open data;

if necessary, which arises in case of change of operational situation in the territories in which fighting is conducted, within areas which territorial communities according to the resolution of the Cabinet of Ministers of Ukraine of December 6, 2022 No. 1364 "Some questions of forming of the list of the territories on which are conducted (were conducted) fighting or temporarily occupied by the Russian Federation" (The Official Bulletin of Ukraine, 2022, 99, Art. 6191) are included No. or were included in the list of the territories in which are conducted fighting or temporarily occupied by the Russian Federation (was conducted), cutting down of trees and their export during cabins can be performed by divisions of forces of defense without registration of special permission to special use of forest resources (the lesorubny ticket) and without inspections of the commissions.

In case of change of quantitative and high-quality structure of forest fund which were performed as a result of such actions information is transferred by owners of the woods and permanent forest users of the state forest shelter organization for the purpose of modification of forest utilization materials.

Such changes are made based on materials of inspections by the commissions within six months from the date of approach of safe conditions (cessation of hostilities, deokkupation, cleaning of explosive objects, etc.) of stay on the respective timberland.

Special permission to special use of forest resources (the lesorubny ticket) for cabins of the trees and bushes connected with requirements for defense and safety of the state, and also damaged as a result of military (fighting) operations is issued on carrying out other cabins and works which are not connected with forest management.

2. Bring in the Rules of improvement of high-quality structure of the woods approved by the resolution of the Cabinet of Ministers of Ukraine of May 12, 2007 No. 724 (The Official Bulletin of Ukraine, 2007, No. 37, the Art. 1478), the enclosed changes.

3. After three years from the date of entry into force of this resolution to prohibit continuous cabins of the main use in the mountain woods of the Carpathian region.
