The government of the Russian Federation decides:

1. Approve enclosed:

Regulations on procedure for forming and maintaining the register of capital construction projects, real estate units, construction (reconstruction, including with restoration elements, modernization) or acquisition of which are performed (it is planned to perform) at the expense of means of the federal budget;

Rules of decision making about implementation of capital investments in capital construction projects and acquisition of real estate units at the expense of means of the federal budget;

Rules of implementation of capital investments in capital construction projects and acquisition of real estate units at the expense of means of the federal budget;

changes which are made to acts of the Government of the Russian Federation.

2. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

3. Determine that from the date of entry into force of this resolution:

a) the component of management of capital investments of subsystem of budgetary planning of the state integrated management information system of public finance "The electronic budget" (further - component of the Electronic Budget system) creates common information space for the organization of management of capital investments which financial provision is performed (it is planned to perform) at the expense of means of the federal budget, with participation of federal executive bodies, other organizations performing powers of the main manager of means of the federal budget according to the budget legislation of the Russian Federation (further - the main manager);

b) the component of the Electronic Budget system is information system primary source concerning information on capital construction projects, real estate units (further - objects) regarding distribution of budgetary appropriations of the federal budget on expenses on their construction (reconstruction, including with restoration elements, modernization) or acquisition and the assigned codes of classification of expenses of the federal budget;

c) with use of component of the Electronic Budget system the following functions are performed:

forming and display in real time aggregative analytical information on the course of implementation of investment projects concerning objects;

forming, storage, exchange, analytical processing and information visualization and documents when forming and maintaining the register of capital construction projects, real estate units, construction (reconstruction, including with restoration elements, modernization) or acquisition of which is performed (it is planned to perform) at the expense of means of the federal budget (further - the register);

ensuring unilateral or bilateral information exchange with other information systems and resources;

d) The Ministry of Construction and Housing and Communal Services of the Russian Federation is functional customer of component of the Electronic Budget system, approves the draft of the specification on performance of works and rendering services in development of component of the Electronic Budget system developed by the Ministry of Finance of the Russian Federation.

4. Determine that:

a) in case of execution of the federal budget in 2024 data on objects are considered included in the register in the presence of such data in reasons for the budgetary appropriations created and provided according to the budget legislation of the Russian Federation, and also the decisions on implementation made in accordance with the established procedure at the expense of means of the federal budget of capital investments in objects;

b) modification of the decisions on implementation which are earlier accepted in the form of legal acts of the main managers at the expense of means of the federal budget of capital investments in objects, data on which are included in the register, is not required;

c) modification of the made decision on implementation at the expense of means of the federal budget of capital investments is not required in case of change (increase) of project cost in connection with increase in the prices of construction resources and the change (increase) of the price of the contract, and also change of total (limiting) amount of capital investments caused by it and (or) distribution of estimated cost of object by years of implementation of the investment project connected with the change in price of the contract according to the order of the Government of the Russian Federation of August 9, 2021 to No. 1315 "About introduction of amendments to some acts of the Government of the Russian Federation".

5. Concerning objects, construction (reconstruction, including with restoration elements, modernization) or acquisition of which is performed at the expense of means of the federal budget outside the territory of the Russian Federation:

a) decisions on implementation of capital investments in the specified objects are made according to the Rules of decision making about implementation at the expense of means of the federal budget of capital investments in objects of state-owned property of the Russian Federation outside the territory of the Russian Federation approved by the order of the Government of the Russian Federation of April 4, 2017 No. 407 "About procedure for decision making about implementation at the expense of means of the federal budget of capital investments in objects of state-owned property of the Russian Federation outside the territory of the Russian Federation";

b) capital investments in the specified objects are performed according to the Rules of implementation at the expense of means of the federal budget of capital investments in objects of state-owned property of the Russian Federation outside the territory of the Russian Federation approved by the order of the Government of the Russian Federation of April 4, 2017 No. 408 "About approval of Rules of implementation at the expense of means of the federal budget of capital investments in objects of state-owned property of the Russian Federation outside the territory of the Russian Federation".

6. This resolution becomes effective from the date of its official publication.

I. General provisions

1. This Provision establishes procedure for forming and maintaining the register of capital construction projects, real estate units, construction (reconstruction, including with restoration elements, modernization) (further - construction) or acquisition of which is performed (it is planned to perform) at the expense of means of the federal budget (further respectively - objects, the register).

2. The register joins data on objects, source of financial provision of construction which acquisitions are the means provided from the federal budget determined by Item 1 of Article 179.1 of the Budget code of the Russian Federation and also in the cases determined by this Provision about actions which provide in various combination construction, acquisition of such objects (further - data).

3. Forming and maintaining the register, including forming, coordination and representation of line items concerning the data included in it and monitoring of construction, acquisition of objects, are performed in component of management of capital investments of subsystem of budgetary planning of the state integrated management information system by public finance "The electronic budget" (further - component of the Electronic Budget system) with observance of requirements of the legislation of the Russian Federation to work with the data which are the state secret.

4. Forming and maintaining the register provides the Ministry of Construction and Housing and Communal Services of the Russian Federation.

5. The presidium (headquarters) of Government commission on regional development in the Russian Federation (further - presidium (headquarters) of the Commission) on representation of the Ministry of Construction and Housing and Communal Services of the Russian Federation considers objects and actions, data on which join in the register, including for the purpose of preparation of offers on calculation of basic budgetary appropriations for construction expenses, acquisition of objects according to the procedure, established according to the budget legislation of the Russian Federation (further - basic budgetary appropriations), except for case of modification of the register according to the subitem "b" of Item 28 of this provision.

6. The Ministry of Construction and Housing and Communal Services of the Russian Federation in coordination with the Ministry of Finance of the Russian Federation approves methodical instructions for forming of the data included in the register, including form of such data (further - methodical instructions).

7. The register concerning each object contains the data determined by methodical instructions including:

a) about object:

type (capital construction project, real estate unit);

name;

unique 18-unit identification code;

location;

direction of investment;

the planned capacity (capacity surplus);

estimate or expected (limiting) construction cost, acquisition value in the prices of the corresponding years of implementation of the investment project;

the planned year of commissioning, acquisition or the planned year of preparation of reasons for investments and carrying out its technological and price audit;

the planned year of approval of the project documentation (concerning capital construction project if on development of the project documentation means of the federal budget are provided);

b) about the builder, the customer;

c) about the state program of the Russian Federation or about the activity which is not entering state programs of the Russian Federation and also about the national project (concerning the object providing goal achievement and indicators of the national project);

d) about the main manager of means of the federal budget (further - the main manager);

e) about amounts and sources of financial provision on construction, acquisition of object or on preparation of reasons for investments and carrying out its technological and price audit with distribution by years in the prices of the corresponding years of implementation of the investment project and to codes of classification of expenses of the federal budget;

e) about control points for monitoring of construction, acquisition of object;

g) about the decisions on implementation of capital investments made in accordance with the established procedure (further - decisions on capital investments) in the form of acts of the Government of the Russian Federation;

h) about the documents loaded according to Item 17 of this provision.

8. The register joins data on the actions providing:

construction, acquisition of objects for the purpose of providing the military personnel with permanent and (or) office housing and persons equated to them on the bases established by the legislation of the Russian Federation;

acquisition of real estate units (premises) for forming of municipal specialized housing stock for the purpose of implementation of measures of social support of separate categories of citizens;

construction, acquisition of other objects relating to state-owned property of the subjects of the Russian Federation (municipal property) which are not included in federal target programs which cost calculated in the prices of the corresponding years of implementation of the investment project constitutes less than 3 billion rubles, and also objects specified in Items 3 (2) - 3(4) orders of the Government of the Russian Federation of September 30, 2014 No. 999 "About forming, provision and distribution of subsidies from the federal budget to budgets of subjects of the Russian Federation".

The register concerning each action specified in paragraphs the second - the fourth this Item, contains the data determined by methodical instructions including the name and unique 18-unit identification codes of action and the data specified in subitems "v" - "d" Item 7 of this provision.

The actions specified in paragraphs second and third this Item are not subject to disaggregation in the register to objects, and the actions specified in paragraph four of this Item are subject to such disaggregation according to Item 26 of this provision.

In the register distribution of total amount of funds for construction, acquisition of objects within implementation of the state defensive order automatically according to the codes of classification of expenses of the federal budget relating to the state defensive order is also reflected (without breakdown by the specified classification codes, objects and actions).

9. Join in the register in first-priority procedure for the data:

a) about objects on which works on construction are begun;

b) about the incomplete capital construction projects included in the federal register of incomplete capital construction projects in stipulated in Article 55.35 Town-planning codes of the Russian Federation if on such objects management decision on feasibility of completion of construction (reconstruction) and commissioning according to the paragraph the second the subitem "an" of Item 1 of the order of the Government of the Russian Federation of July 26, 2022 No. 1333 "About consequences of inclusion of object of construction in progress is made, construction which reconstruction were performed fully or partially at the expense of means of budgets of the budget system of the Russian Federation and are not complete, in the federal register of incomplete capital construction projects, in the regional register of incomplete capital construction projects";

c) about other objects in the presence of orders or instructions of the President of the Russian Federation, orders of the Russian Prime Minister about need of construction, acquisition of such objects;

d) about the objects relating to state-owned property of subjects of the Russian Federation (municipal property), determined according to Rules of forming, provision and distribution of subsidies from the federal budget to budgets of the subjects of the Russian Federation approved by the order of the Government of the Russian Federation of September 30, 2014 No. 999 "About forming, provision and distribution of subsidies from the federal budget to budgets of subjects of the Russian Federation".

10. The register, except for the data which are the state secret and relating to other information of limited access protected in accordance with the legislation of the Russian Federation, corresponding to parameters of the draft of the federal budget for the next financial year and planning period, in the amount determined by methodical instructions is placed on the single portal of the budget system of the Russian Federation according to Article 192 of the Budget code of the Russian Federation.

11. The data included in the register are the basis for forming (refining) by the main managers of reasons for budgetary appropriations according to the budget legislation of the Russian Federation. The data included in the register in the presence of the made decision on capital investments are the basis for adoption of the obligations which are subject to execution at the expense of means of the federal budget including for the term exceeding effective period of the approved limits of the budget obligations according to the budget legislation of the Russian Federation, except for case if the draft of data is not considered according to Item 23 this provision.

12. Forming of the register and entering of changes into it in case of creation of the draft of the federal budget for the next financial year and planning period are performed taking into account the terms determined by the schedule of preparation and consideration of drafts of the Federal Laws, documents and materials developed in case of creation of the draft of the federal budget and budget statements of state non-budgetary funds of the Russian Federation for the next financial year and planning period.
