About production and turnover of organic products

This Law determines the legal, economic, social and organizational basis of production and turnover of organic products directed to preserving and rational use of natural resources, assistance in forming of healthy power supply and market development of organic products.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) organic products - agricultural products, products from wild-plants, the seeds of agricultural plants, yeast and mushrooms, products of their conversion, including food products meeting the requirements of this Law and national standards. Organic products are not products of hunting and fishery;

2) turnover of organic products - processes (stages) of realization (purchase and sale or delivery) of organic products, including import (import) and export (export) of organic products, and also the related processes of packing, packaging, marking, storage, transportation and other processes;

3) system of accounting and traceability of organic products - the part of information system of authorized body in the field of production and turnover of organic products containing data on organic products and its components, on production process and turnover of organic products;

4) marking of organic products - drawing information on organic products in the form of texts, drawings, signs, symbols, other designations and (or) their combinations on interior package, shipping package or on other type of the data carrier attached to interior package and (or) to shipping package either placed in them or attached to them;

5) national mark of conformity of organic products - the mark of conformity informing consumers on passing by production of organic products of the procedure of confirmation of conformity of production of organic products;

6) production of organic products - activities of which creation (production) of organic products according to the legislation of the Republic of Kazakhstan in the field of production and turnover of organic products and national standards is result. The production process of organic products includes the related processes of packing, packaging, marking, storage, transportation and other processes;

9) authorized body in the field of production and turnover of organic products - the central executive body performing management and cross-industry coordination in the field of production and turnover of organic products.

Article 2. The legislation of the Republic of Kazakhstan in the field of production and turnover of organic products

1. The legislation of the Republic of Kazakhstan in the field of production and turnover of organic products is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

2. The international agreements ratified by the Republic of Kazakhstan have priority before this Law. The procedure and conditions of action in the territory of the Republic of Kazakhstan of international treaties which participant is the Republic of Kazakhstan are determined by the legislation of the Republic of Kazakhstan.

Article 3. The purposes and tasks of the legislation of the Republic of Kazakhstan in the field of production and turnover of organic products

1. The purposes of the legislation of the Republic of Kazakhstan in the field of production and turnover of organic products are:

1) ensuring integrity of organic products at all stages of its production and turnover;

2) development of the domestic market of organic products and requirements satisfaction of the population in it;

3) development of national brand of organic products;

4) scientific providing in the field of production and turnover of organic products.

2. Tasks of the legislation of the Republic of Kazakhstan in the field of production and turnover of organic products are:

1) improvement of quality of food products;

2) assistance to use of seeds of the agricultural plants and farm animals adapted for local conditions and the purposes of production of organic products;

3) protection of producers of organic products against unfair competition;

4) increase in competitiveness and assistance to increase in export of organic products;

5) providing measures of the state support of organic products to producers.

Article 4. The principles of the legislation of the Republic of Kazakhstan in the field of production and turnover of organic products

The principles of the legislation of the Republic of Kazakhstan in the field of production and turnover of organic products are:

1) creating favorable conditions for development of production of organic products, not causing environmental damage, to health of the person, health of plants, and also health and welfare of animals;

2) use of steady management systems natural resources, including the soil, water, air, maintenance of biodiversity.

Chapter 2. State regulation in the field of production and turnover of organic products

Article 5. Competence of the Government of the Republic of Kazakhstan in production and turnover of organic products

Government of the Republic of Kazakhstan:

1) develops the main directions of state policy in the field of production and turnover of organic products and will organize their implementation;

2) performs other functions assigned to it by the Constitution, this Law, other laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.

Article 6. Competence of authorized body in production and turnover of organic products

Authorized body in the field of production and turnover of organic products:

Creates 1) and implements state policy in the field of production and turnover of organic products;

Develops 2) and approves regulatory legal acts in the field of production and turnover of organic products according to the legislation of the Republic of Kazakhstan;

3) is conducted by the register of seeds of the agricultural plants and farm animals used for production of organic products;

Develops 4) and approves the list of the permitted means applied in case of production of organic products in coordination with state body in the field of sanitary and epidemiologic wellbeing of the population;
