About reorganization of the state company "Kyrgyzavtozhol" under the Ministry of Transport and Communications of the Kyrgyz Republic

For the purpose of enhancement of management system of road industry, effective implementation of the state order on running repair and content of highways and further realization of the tasks set for the Ministry of Transport and Communications of the Kyrgyz Republic, increase in responsibility for achievement of results according to Article 92 of the Civil code of the Kyrgyz Republic, Articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Reorganize the state company "Kyrgyzavtozhol" under the Ministry of Transport and Communications of the Kyrgyz Republic by separation and education of the following independent legal entities:

1) the state company "Kyrgyzavtozhol-Sever" under the Ministry of Transport and Communications of the Kyrgyz Republic;

2) the state company "Kyrgyzavtozhol-Yug" under the Ministry of Transport and Communications of the Kyrgyz Republic.

2. Approve:

1) the Charter of the state company "Kyrgyzavtozhol-Sever" under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 1;

2) the Charter of the state company "Kyrgyzavtozhol-Yug" under the Ministry of Transport and Communications of the Kyrgyz Republic according to appendix 2.

3. Determine that the state company "Kyrgyzavtozhol-Sever" under the Ministry of Transport and Communications of the Kyrgyz Republic and the state company "Kyrgyzavtozhol-Yug" under the Ministry of Transport and Communications of the Kyrgyz Republic are legal successors of the state company "Kyrgyzavtozhol" under the Ministry of Transport and Communications of the Kyrgyz Republic according to the separation balance sheet.

4. Determine that the realization of this resolution is enabled within the approved number of staff and means provided to subordinated divisions of the Ministry of Transport and Communications of the Kyrgyz Republic in the republican budget for the corresponding year and the next years.

5. Bring in the order of the Government of the Kyrgyz Republic "About streamlining of activities of the state companies" of September 11, 2019 No. 468 the following changes:

in appendix 1 to the Regulations on the state companies approved by the above-stated resolution:

- in Item 6 the word "Kyrgyzavtozhol" shall be replaced with words "Kyrgyzavtozhol-North";

- add with Item 26 of the following content:

"26. The state company "Kyrgyzavtozhol-Yug" under the Ministry of Transport and Communications of the Kyrgyz Republic.".

6. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About the Ministry of Transport and Communications of the Kyrgyz Republic" of July 1, 2021 No. 55 the following change:

to state the scheme of management of the Ministry of Transport and Communications of the Kyrgyz Republic approved by the above-stated resolution in edition according to appendix 3 to this resolution.

7. Recognize invalid:

1) the subitem 2 of Item 1 and the subitem 5 of Item 2 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About measures for transformation of road industry" of December 24, 2021 No. 346;

2) the subitem 2 of item 4 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About measures for designing, construction, reconstruction, rehabilitation, capital repairs of intra airport roads, elements of airfield (artificial landing strip, rulezhny path and the platform) of the airports of the Kyrgyz Republic" of April 17, 2023 No. 201.

8. To the Ministry of Transport and Communications of the Kyrgyz Republic:

- approve dividing acts of the reorganized legal entity specified in Item 1 of this resolution;

- organize accomplishment of the corresponding procedures for reception-transmission of the available main, financial and material resources;

- take measures for employment of the released established posts in the procedure established by the labor law of the Kyrgyz Republic;

- carry out in accordance with the established procedure state registration and re-registration of the legal entities specified in Item 1 of this resolution;

- in a month to bring the decisions into accord with this resolution.

9. To the state company "Kyrgyzavtozhol-Sever" under the Ministry of Transport and Communications of the Kyrgyz Republic and to the state company "Kyrgyzavtozhol-Yug" under the Ministry of Transport and Communications of the Kyrgyz Republic together with the Ministry of Finance of the Kyrgyz Republic in case of accomplishment of the state order financed from the republican budget to handle issue of inclusion of expenses in single system of treasury.

10. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

11. This resolution becomes effective after ten days from the date of official publication.
