About procedure for establishment and application of rates for paid medical services

 Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 No. 72 "About some questions of price regulation (rates) in the Republic of Belarus", subitem 1.3 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of January 17, 2014 No. 35 "About approval of lists of socially important goods (services), the prices (rates) for which are regulated by state bodies, and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" the Ministry of Health of the Republic of Belarus DECIDES:

1. Approve the Instruction about procedure for establishment and application of rates for paid medical services it (is applied).

2. Recognize invalid:

the resolution of the Ministry of Health of the Republic of Belarus of February 3, 2015 No. 14 "On regulation of rates for paid medical services";

the resolution of the Ministry of Health of the Republic of Belarus of March 7, 2018 No. 24 "About introduction of amendments to the resolution of the Ministry of Health of the Republic of Belarus of February 3, 2015 No. 14";

subitem 1.2 of Item 1 of the resolution of the Ministry of Health of the Republic of Belarus of November 8, 2021 No. 119 "About change of resolutions of the Ministry of Health of the Republic of Belarus";

the resolution of the Ministry of Health of the Republic of Belarus of July 22, 2022 No. 69 "About change of the resolution of the Ministry of Health of the Republic of Belarus of February 3, 2015 No. 14";

the resolution of the Ministry of Health of the Republic of Belarus of September 29, 2023 No. 148 "About change of the resolution of the Ministry of Health of the Republic of Belarus of February 3, 2015 No. 14".

3. This resolution becomes effective since July 1, 2024.

The instruction about procedure for establishment and application of rates for paid medical services

Chapter 1. General provisions

1. This Instruction determines procedure for establishment and application of rates for paid medical services which are regulated by the Ministry of Health in coordination with the Ministry of anti-monopoly regulation and trade (further – paid medical services).

2. For the purposes of this Instruction the following terms and their determinations are applied:

range of services on radiodiagnosis – set of the medical services in radiodiagnosis provided to one patient within one research;

range of services on ultrasonic diagnostics – set of the medical services in ultrasonic diagnostics provided to one patient within one research.

3. Action of this Instruction extends to the legal entities and individual entrepreneurs rendering paid medical services to citizens of the Republic of Belarus, and also the foreign citizens and persons without citizenship who are constantly living in the territory of the Republic of Belarus if other is not established by legal acts and international treaties of the Republic of Belarus.

Rates for the paid medical services rendered by legal entities and individual entrepreneurs to the foreign citizens and persons without citizenship which are temporarily staying or temporarily living in the Republic of Belarus if other is not established by legal acts and international treaties of the Republic of Belarus, are established by them independently without limiting maximum rates, the limiting standard rate of profitability.

4. Rounding of rates for paid medical services is performed by legal entities and individual entrepreneurs with limiting observance of the maximum rates established by the Ministry of Health, the limiting standard rate of profitability, limiting maximum allowances, coefficients established by this Instruction.

Chapter 2. Procedure for establishment of rates for paid medical services

5. Regulation of rates for paid medical services is performed by the following methods:

5.1. on services in medical examination of the state of health of citizens for receipt of the medical certificate about the state of health confirming the validity to control of hand-operated cars, dental services on services on beam (including when rendering dental services), ultrasonic and laboratory diagnostics by establishment:

5.1.1. limiting maximum rates;

5.1.2. the limiting standard rate of profitability used for determination of the amount of the profit which is subject to inclusion in rates for paid medical services in the amount of 30 percent to planned cost;

5.1.3. limiting maximum allowances to the established rates for paid medical services in the amount of:

30 percent – for rendering paid medical services at night;

50 percent – for rendering paid medical services on the public holidays and holidays established and announced non-working;

5.2. on services in functional and endoscopic diagnostics by establishment:

5.2.1. the limiting standard rate of profitability used for determination of the amount of the profit which is subject to inclusion in rates for paid medical services in the amount of 30 percent to planned cost;

5.2.2. limiting maximum allowances to the established rates for paid medical services in the amount of:

30 percent – for rendering paid medical services at night;

50 percent – for rendering paid medical services on the public holidays and holidays established and announced non-working.

6. Rates for paid medical services are established on costs basis (cost), taxes and other obligatory payments in the sizes and procedure established by the legislation arrived taking into account the features established by this Instruction.

7. Rates for paid medical services are established proceeding from regulations of time for their rendering.

The regulations of time for rendering paid medical services established by the Ministry of Health decrease heads of legal entities and individual entrepreneurs on the basis of the carried-out timing of working hours depending on:

the applied technologies;

material equipment;

rendering paid medical services in beam and ultrasonic diagnostics in complex;

other factors which allow to optimize temporary labor costs.
