Procedure for factual determination of execution of the passport of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation in the territory of the Russian Federation based on forgery, false or invalid documents or obviously false data

1. Head department concerning migration of the Ministry of Internal Affairs of the Russian Federation <1>, the Center for questions of migration of the Ministry of Internal Affairs of the Russian Federation <2> or territorial authorities of the Ministry of Internal Affairs of Russia at the regional and district levels <3> for the purpose of factual determination of execution of the passport of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation in the territory of the Russian Federation <4> based on forgery, false or invalid documents or obviously false data it is performed <5>.

3. Subject of check is establishment of validity of documents, reliability of data based on which the passport, availability of the bases for its issue is drawn up.

4. The basis for conducting check is detection by the employee of law-enforcement bodies of the Russian Federation, the federal government civil servant or the worker <6> GUVM Ministries of Internal Affairs of Russia, TsVM Ministry of Internal Affairs of Russia or division concerning migration of territorial authority of the Ministry of Internal Affairs of Russia <1> of the signs testimonial of execution of the passport based on forgery, false or invalid documents or obviously false data.

In the presence of the bases specified in paragraph one of item 4 of this Procedure, the chief of GUVM Ministry of Internal Affairs of Russia, the chief of structural division of TsVM Ministry of Internal Affairs of Russia or the chief of division concerning migration reports on the found signs within three working days from the date of their detection on the officials specified in Item 6 of this Procedure.

6. The decision on conducting check is made:

6.1. According to the official report of the chief of GUVM Ministry of Internal Affairs of Russia - the Minister of Internal Affairs of the Russian Federation or the deputy minister of internal affairs of the Russian Federation responsible for activities of the specified division of the Ministry of Internal Affairs of Russia.

6.2. According to the official report of the chief of structural division of TsVM Ministry of Internal Affairs of Russia - the chief of TsVM Ministry of Internal Affairs of Russia or person replacing it.

6.3. According to the official report of the chief of division concerning migration - the head (chief) of the relevant territorial authority of the Ministry of Internal Affairs of Russia, his deputy or persons fulfilling their duties.

7. The term of conducting check shall not exceed two months from the date of decision making about its carrying out.

In case of not receipt of information on earlier sent inquiries and also if the data received during conducting check do not allow to pass the decision concerning subject of check, need of holding actions and (or) researches based on the arrived data, the term of conducting check according to the decision of the official who made the decision on its carrying out can be prolonged, but no more than for one month.
