About approval of Rules of marking of bicycles and bicycle frames means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning bicycles and bicycle frames

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of bicycles and bicycle frames by means of identification.

2. Determine that participants of turnover of the bicycles and bicycle frames belonging to codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union, 8711, the 8712th 00, 8714 91 100 and 9503 00 100 9, to codes of the All-Russian Product Classifier by types of economic activity 30.91.11.120, 30.91.20 (only for frames bicycle), 30.92.10, 30.92.30.110 (only for frames bicycle), 32.40.31.121 (further - goods) according to the Rules approved by this resolution:

a) till September 1, 2024 has the right to be registered in the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), to perform drawing means of identification and to represent data on marking of goods means of identification, about input of goods to turnover in information system of monitoring;

b) since September 1, 2024, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of goods of the activities connected with input of goods in turnover and (or) their turnover, and (or) their conclusion from turnover, are registered in information system of monitoring;

c) in time no later than 15 calendar days from the date of registration in information system of monitoring provide readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

d) pass test of information exchange of own software and hardware and information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of goods, their input in turnover, their turnover and their conclusion from turnover according to the Rules approved by this resolution;

e) since September 1, 2024 put funds of identification for goods and represent to information system of monitoring of the data on marking of goods means of identification, about input of goods in turnover;

e) since March 1, 2025 represent to information system of monitoring of the data on turnover of goods, about conclusion of goods from turnover;

g) in the presence as of September 1, 2024 in the territory of the Russian Federation the unrealized goods made or imported on the territory of the Russian Federation till September 1, 2024 perform till February 28, 2025 (inclusive) their marking by means of identification and enter into information system of monitoring of the data on marking of such goods means of identification and their input in turnover. At the same time turnover and conclusion from turnover of the unmarked specified remaining balance of goods are allowed till February 28, 2025 (inclusive);

h) till January 1, 2025 perform marking of the goods acquired till September 1, 2024 and issued by customs authorities after September 1, 2024 according to customs procedures of release for internal consumption or reimport to the offer of these goods for realization (sale), and enter into information system of monitoring of the data on marking of such goods means of identification according to the Rules approved by this resolution.

3. Determine that the participants of turnover of goods falling under action of provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation":

a) are registered in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of the goods marked by means of identification;

b) has the right to represent the data specified in the Section VIII of the Rules approved by this resolution within 30 calendar days:

from the date of shipment (transfer or acceptance) goods - if transfer (acceptance) of goods within the transactions providing transition of the property right to goods and also within commission agreements and (or) agency agreements is performed;

from the date of conclusion of goods from turnover - if conclusion of goods from turnover is performed;

from the date of return of goods to turnover - if return of goods to turnover is performed;

from the date of change of the data provided by Sections III, IV, VIII and IX of the Rules approved by this resolution - in case of change of the specified data.

4. Registration in the information system used for the purpose of ensuring carrying out experiment according to the order of the Government of the Russian Federation of September 11, 2019 with No. 1183 "About carrying out experiment on marking of bicycles and bicycle frames means of identification and to monitoring of turnover of these products" (further - experiment), legal entities and individual entrepreneurs who as of May 31, 2020 were participants of experiment is equated to registration in information system of monitoring according to subitems "an" and "b" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of goods to information system in which information support of carrying out experiment was performed do not meet the requirements of the Rules approved by this resolution, participants of turnover of goods represent to information system of monitoring missing and (or) urgent data till October 1, 2024 (inclusive).

5. Determine that the operator of information system of monitoring provides:

a) the organization of testing of information exchange of software and hardware of participants of turnover of goods and information system of monitoring no later than 15 calendar days from the date of obtaining from the participants of turnover of goods registered in information system of monitoring, the notification of the readiness to information exchange with information system of monitoring and the request for passing of testing of information exchange electronically;

b) provision to participants of turnover of goods of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by the Rules approved by this resolution no later than 30 calendar days from the date of obtaining from the participants of turnover of goods registered in information system of monitoring, the request for provision of remote access to the issue registration device electronically;

c) provision to the participants of turnover of goods performing marking by means of identification of the goods introduced into circulation till September 1, 2024, codes of marking of the goods necessary for forming of means of identification since day of entry into force of this resolution on condition of submission of all data necessary for registration of goods in information system of monitoring;

d) provision to the participants of turnover of goods performing marking by means of identification of the goods introduced into circulation after September 1, 2024, the codes of marking necessary for forming of means of identification on condition of submission of all data necessary for registration of goods in information system of monitoring.

6. Determine that in the territory of the Russian Federation input of goods in turnover without drawing funds of identification for them and transfer to information system of monitoring of data on marking of goods means of identification, and also turnover and the conclusion from turnover of goods which are not marked by means of identification is allowed till September 1, 2024, except as specified, provided by subitems "zh" and "z" of Item 2 of this resolution.

Till November 1, 2024 release by customs authorities according to customs procedures of release for internal consumption or reimport of the unmarked goods specified in the subitem "z" of Item 2 of this resolution is allowed. At the same time till February 28, 2025 (inclusive) participants of turnover of goods have the right to perform storage, transportation and realization (sale) of the goods which are not marked by means of identification and being at them in ownership, and (or) use, and (or) the order as of September 1, 2024 (remaining balance of goods) and to perform their marking by means of identification for the purpose of the subsequent realization (sale) in case of observance of the conditions provided by the Rules approved by this resolution.

7. This resolution becomes effective since September 1, 2024, except for the subitem "an" of Item 2 and item 4 of this resolution which become effective from the date of its official publication.

Rules of marking of bicycles and bicycle frames means of identification

I. General provisions

1. These rules determine features of marking of the bicycles and bicycle frames which are subject to obligatory marking by means of identification (further - goods), requirements to participants of turnover of goods, procedure for information exchange of the participants of turnover of goods with the state information system of monitoring of turnover of goods who are subject to obligatory marking by means of identification (further - information system of monitoring), characteristics of means of identification, and also procedure for representation by participants of turnover of goods of data in information system of monitoring on input in turnover, about turnover and about conclusion from turnover of goods.

2. The concepts used in these rules mean the following:

"aggregation" - process of consolidation of goods in consumer packagings in shipping package or shipping packages in shipping package of higher level of enclosure with preserving information on interrelation of codes of identification of each enclosed commodity unit in consumer packaging with code of identification of the created shipping package, and also codes of identification of each enclosed shipping package with code of identification of the created shipping package of higher level of enclosure and drawing the corresponding code of identification of shipping package for the purpose of ensuring traceability of movement of goods on goods distribution chain without the need for opening of the created shipping package;
