1. Approve the enclosed Regulations on receipt of guarantees of immunity, safety and timely return of temporarily exported property belonging on the property right of the Russian Federation out of limits of the Russian Federation.

2. The realization of this resolution is enabled within the established extreme number of federal executive bodies, and also budgetary appropriations provided to these federal executive bodies in the federal budget on management and management in the sphere of the established functions.

3. To federal executive bodies, other federal bodies of the government (federal state bodies) and the organizations performing temporary export of the property belonging on the property right of the Russian Federation out of limits of the Russian Federation in 6-month time to bring the normative legal and other acts into accord with this resolution.

Regulations on receipt of guarantees of immunity, safety and timely return of temporarily exported property belonging on the property right of the Russian Federation out of limits of the Russian Federation

1. This Provision establishes procedure for receipt of guarantees of immunity, safety and timely return of temporarily exported property belonging on the property right of the Russian Federation out of limits of the Russian Federation from authorized state bodies of foreign state (further - guarantees of foreign state).

2. The property belonging on the property right of the Russian Federation (further - federal property), for the purposes of this provision is understood as equipment samples, the equipment, materials and other personal estate which is objects of material world.

3. Temporary export of federal property for the purposes of this provision is understood as movement of federal property from the Russian Federation in the foreign states which are not state members of the Eurasian Economic Union with the obligation of its return import for the purpose of exhibiting, carrying out displays and demonstrations, scientific studying and use in research projects (further - actions).

4. This Provision does not extend to temporary export:

the cultural values including included in structure of Museum fund of the Russian Federation, Archival fund of the Russian Federation, in national library stock;

the precious metals, gemstones and primary goods containing precious metals, provided by the Presidential decree of the Russian Federation of September 20, 2010 No. 1137 "About approval of the Regulations on import in the Russian Federation from the states which are not entering into the Eurasian Economic Union and export from the Russian Federation to these states of the precious metals, gemstones and primary goods containing precious metals";

property of the bodies and organizations which are under authority of the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response intended for implementation of measures for extraordinary humanitarian response outside the Russian Federation.

5. This Provision is applied to federal executive bodies (their territorial authorities), other federal bodies of the government (federal state bodies), federal state budgetary institutions, federal state institutions, federal autonomous institutions, the federal state unitary enterprises, the federal state companies or other legal persons to whom the federal property belongs on the appropriate corporeal right or by law (further - owners).

6. The federal property is subject to temporary export on condition of obtaining from authorized state bodies of foreign state on which territory or through the territory of which (except for transit movement of federal property by air transport) temporary export of federal property (further - foreign state), providing guarantees for the entire period of temporary export of immunity is performed (legal immunity, immunity concerning measures for providing the claim and immunity concerning execution of the judgment, immunity from requisition, arrest and other executive or forced actions) and timely return of temporarily exported federal property, and also in case of absence at owners of data on the circumstances interfering ensuring immunity, safety and timely return of temporarily exported federal property in foreign state (natural disaster, armed conflict, availability of data that temporarily exported federal property is matter in issue about the property right, and other circumstances).

7. If according to the legislation of foreign state it is not provided by authorized state bodies of foreign state of guarantees of providing for the entire period of temporary export of immunity (legal immunity, immunity concerning measures for providing the claim and immunity concerning execution of the judgment, immunity from requisition, arrest and other executive or forced actions) temporarily exported federal property, then export of federal property requires obtaining from authorized state bodies of this foreign state of guarantees of providing for the entire period of temporary export of safety and timely return of temporarily exported federal property, and also documentary confirmation of the fact that in judicial authorities of the corresponding foreign state are not considered claims of property nature concerning the Russian Federation (are not submitted).

8. Receipt of the guarantees of foreign state specified in Items 6 and 7 of this provision is provided with owners.

The request about need of receipt of guarantees of foreign state on which territory it is supposed to perform temporary export of federal property goes the owner to the organizer of the event.

In case of impossibility to provide with the organizer of the event provision of guarantees for foreign state or in the presence at the owner of good causes to believe that such guarantees will not be provided by the organizer of the event, and also in need of receipt of guarantees of foreign state through which territory temporary export of federal property is performed (except for transit movement of federal property by air transport), the request about receipt of guarantees of foreign state prepared by the owner goes to competent authority of foreign state through diplomatic channels through the federal executive body performing functions on development and realization of state policy and normative legal regulation in the sphere of the international relations of the Russian Federation.
