About approval of the Procedure for consideration of addresses of citizens and the organization of personal reception of citizens in the Commission on regulation of gamblings and lotteries

According to the Law of Ukraine "About addresses of citizens", the Presidential decree of Ukraine of February 7, 2008 No. 109 "About first-priority measures for ensuring realization and guaranteeing constitutional right on the appeal to public authorities and local government bodies", the resolution of the Cabinet of Ministers of Ukraine of April 14, 1997 No. 348 "About approval of the Instruction on clerical work according to addresses of citizens in public authorities and local self-government, associations of citizens, at the companies, in organizations, the organizations irrespective of patterns of ownership, in media", the subitem 12 of item 4 of the Regulations on the Commission on regulation of gamblings and lotteries approved by the resolution of the Cabinet of Ministers of Ukraine of September 23, 2020 No. 891, for the purpose of realization of constitutional right of citizens on the personal appeal to the Commission on regulation of gamblings and lotteries, the Commission on regulation of gamblings and lotteries of RESHILA:

1. Approve the Procedure for consideration of addresses of citizens and the organization of personal reception of citizens in the enclosed Commission on regulation of gamblings and lotteries.

2. To provide to department of methodology together with department of legal providing in the procedure established by the legislation submission of this decision on state registration in the Ministry of Justice of Ukraine.

3. To provide to department of documentary providing and organizational work promulgation of this decision after its state registration.

4. This decision becomes effective from the date of its official publication.

5. Control over the implementation of this decision to put on the Chairman of KRAIL.

Procedure for consideration of addresses of citizens and the organization of personal reception of citizens in the Commission on regulation of gamblings and lotteries

I. General provisions

1. This Procedure determines procedure of consideration of addresses of citizens, control of adherence to deadlines of their consideration, the main requirements to the organization and carrying out personal reception of citizens, and also the general principles of record keeping for appeals of citizens to KRAIL.

2. In this Procedure terms are used in the values given in the Law of Ukraine "About addresses of citizens" (further - the Law).

3. The failure in acceptance and consideration of addresses of citizens with reference to political views, party accessory, sex, age, religion, the citizen's nationality, ignorance of language of the address is forbidden.

Persons who are not citizens of Ukraine and legally are in its territory, have the same right to submission of addresses, as well as citizens of Ukraine if other is not provided by international treaties.

4. The addresses which are drawn up properly and submitted in the procedure established by the legislation are accepted and are subject to consideration.

5. Action of this Procedure does not extend on:

consideration of the applications about entering of data into the Register of persons which limits access to gambling institutions and/or participation in gamblings, according to Procedure for forming and maintaining the Register of persons which limits access to gambling institutions and/or participation in gamblings, the No. 167 approved by the Decision of the Commission on regulation of gamblings and lotteries of April 22, 2021 and registered in the Ministry of Justice of Ukraine on June 03, 2021 at No. 747/36369;

consideration of messages on violations in the field of gamblings according to Regulations on obtaining, processing and response to the received messages on violations in the field of gamblings, the No. 482 approved by the Decision of the Commission on regulation of gamblings and lotteries of August 11, 2021 and registered in the Ministry of Justice of Ukraine on September 17, 2021 at No. 1228/36850.

6. The clerical work according to appeals of citizens to KRAIL is performed on the beginnings determined by the Standard instruction for documentation of management information electronically and the organizations of the work with electronic documents in clerical work, electronic interdepartmental exchange approved by the resolution of the Cabinet of Ministers of Ukraine of January 17, 2018 No. 55, and No. 348 is conducted separately from other types of clerical work according to the procedure, established by the Instruction on clerical work on addresses of citizens in public authorities and local self-government, associations of citizens, at the companies, in organizations, the organizations irrespective of patterns of ownership, in media, Ukraine approved by the resolution of the Cabinet of Ministers of April 14, 1997 (further - the Instruction), and assigned to structural division to which functional obligations record keeping according to addresses of citizens is referred (further - division).

II. Organization of work on questions of acceptance, preliminary consideration and registration of addresses of citizens

1. Acceptance of addresses of the citizens arriving in KRAIL, their preliminary consideration, registration and establishment of terms of accomplishment (except for the addresses which are not subject to consideration) are performed in day of their receipt, and arrived in non-working day and time - in the working day following after it.

2. All addresses of citizens are subject to obligatory classification by their types according to article 3 of the Law and the Qualifier of addresses of citizens approved by the resolution of the Cabinet of Ministers of Ukraine of September 24, 2008 No. 858, namely: offers (note), statement (petition) or claim.

3. On the basis of receipt of the address of citizens are recognized primary, repeated, doublet, repeated, mass.
