About approval of the Charter of the state company "Bishkek Forming Plant"

For the purpose of optimization of activities of subordinated divisions of the Ministry of Defence of the Kyrgyz Republic, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Charter of the state company "Bishkek Forming Plant" (further - the Company) according to appendix.

2. Determine that the common directorship and coordination of activities of the Company is performed by the Ministry of Defence of the Kyrgyz Republic.

3. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of the Ministry of Economy and Trade of the Kyrgyz Republic" of November 15, 2021 No. 250 the following changes:

- in Item 2 of the word", except for the state company "Bishkek Forming Plant" under the Ministry of Economy and Trade of the Kyrgyz Republic which is financed to exclude from other sources which are not contradicting the legislation of the Kyrgyz Republic";

4. Declare invalid the subitem 16 of Item 1 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of subordinated divisions and organizations of the Ministry of Economy and Trade of the Kyrgyz Republic" of December 10, 2021 No. 300.

5. To the Ministry of Defence of the Kyrgyz Republic:

- bring the decisions into accord with this resolution;

- make the state re-registration of the Company in judicial authorities;

- resolve the issues of material, financial and other provision of activities of the Company following from this resolution.

6. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

7. This resolution becomes effective after ten days from the date of official publication.

Charter of the state company "Bishkek Forming Plant"

Chapter 1. General provisions

1. The state company "Bishkek Forming Plant" (further - the Company) is the independent legal entity created in form of business of the state company founded on the right of economic maintaining by state-owned property.

2. Founder of the Company is the Cabinet of Ministers of the Kyrgyz Republic. The constituent document of the Company is the Charter.

3. The state managing body of the Company is the Ministry of Defence of the Kyrgyz Republic (further - the Ministry).

4. The company in the activities is guided by the Constitution and the laws of the Kyrgyz Republic, regulatory legal acts of the Kyrgyz Republic, international treaties which became effective according to the legislation of the Kyrgyz Republic, decisions of the Ministry and this Provision.

5. Full trade name of the Company:

- accomplishment of the direct state order by the Company for production of goods, works or services;

- implementation of state programs and socially oriented projects of all-republican value;

- generation of profit.

15. The main objectives of the Company are:

- goal achievement and execution of the functions specified in this Charter;

- creation of the corresponding infrastructure providing realization of the made products, achievement of the maximum profitability by effective management of the capital, financial resources and the raised funds.

16. The main functions of the Company are:

- development, production and military sales of products and services;

- production, repair, arms trade and the ammunition, and also other types of products (works, services) which are not forbidden by the legislation of the Kyrgyz Republic and having demand in the markets;
