About approval of Requirements to lists of the certified means of the qualified digital signature or seal

According to part six of article 19 of the Law of Ukraine "About electronic identification and electronic confidential services", Items 4, of 8, 10 Regulations on the Ministry of digital transformation of Ukraine, the Cabinet of Ministers of Ukraine approved by the resolution of September 18, 2019 856, ORDER to No.:

1. Approve Requirements to lists of the certified means of the qualified digital signature or seal which are attached.

2. The conformity assessment bodies accredited on carrying out certification of means of the qualified digital signature or seal create and publish lists of the means of the qualified digital signature or seal certified by them on the official websites, and also provide to the Ministry of digital transformation of Ukraine, lists of the means of the qualified digital signature or seal certified by them within a month from the date of entry into force of this order.

3. To provide to the sector of IT (Tsikhanovsky R. V.) forming and the publication on the official website of the Ministry of digital transformation of Ukraine within two months from the date of entry into force of this order, and also support in urgent condition of the list of all means of the qualified digital signature or the seal certified by the conformity assessment bodies accredited on carrying out certification of means of the qualified digital signature or seal.

4. To provide to management of development of digitalization (Haleev A. P.) in the procedure established by the legislation submission of this order on state registration in the Ministry of Justice of Ukraine.

5. This order becomes effective from the date of its official publication.

6. To impose control over the implementation of this order on the First Deputy Minister Vyiskuba of A. A.

Requirements to lists of the certified means of the qualified digital signature or seal

I. General provisions

1. These Requirements establish procedure for maintaining lists of means of the qualified digital signature or the seal certified by conformity assessment bodies, and also the list of all means of the qualified digital signature or seal certified by the conformity assessment bodies accredited on carrying out certification of means of the qualified digital signature or seal (further - conformity assessment bodies), the Ministry of digital transformation of Ukraine.

Action of these Requirements does not extend to provision of electronic confidential services according to provisions of paragraph two of part one of article 2 of the Law of Ukraine "About electronic identification and electronic confidential services" (further - the Law).

2. In these Requirements terms are used in the values given in the Law of Ukraine "About technical regulations and assessment of conformity", the Law and other regulatory legal acts in spheres of electronic identification and electronic confidential services.

II. Procedure for maintaining lists of means of the qualified digital signature or the seal certified by conformity assessment bodies

1. Conformity assessment bodies create, support in urgent condition and publish on the official websites lists of the means of the qualified digital signature or seal certified by them (further - Lists of conformity assessment bodies).

2. Maintaining Lists of conformity assessment bodies is performed in information and communication systems of conformity assessment bodies using complex system of information security or management system by information security with the confirmed compliance according to requirements of the legislation in the sphere of information security.

3. Lists of conformity assessment bodies are represented in the form of lists which each sequence number contains the block of information on one means of the qualified digital signature or seal, namely:

1) the name of means of the qualified digital signature or seal concerning which the document on compliance of means of the qualified digital signature or seal is issued (further - the document on compliance);

2) identification data which unambiguously determine the producer of means of the qualified digital signature or seal including it is obligatory for legal person name and code according to the Unified state register of the companies and organizations of Ukraine for residents;

3) date and document number about compliance;

4) the reference to the document of compliance in the PDF format;

5) effective period of the document on compliance or term for which it is suspended the document on compliance, or date of its cancellation.

4. Lists of conformity assessment bodies are published in the PDF format. The head of conformity assessment body or person authorized by it signs Lists of conformity assessment bodies the qualified digital signature or the advanced digital signature which is based on the qualified digital signature certificate.

5. The bases for entering of data into Lists of conformity assessment bodies is issue, suspension, cancellation of the document on compliance.

6. Data in Lists of conformity assessment bodies are entered no later than the next working day after issue, suspension, cancellation of the document on compliance.
