According to Item 4, the subitem 4 of Item 12 of the Section VII "Final and transitional provisions" of the Law of Ukraine of September 21, 2022 No. 2620-IX "About introduction of amendments to the Law of Ukraine "About obligatory national social insurance" and the Law of Ukraine "About obligatory national pension insurance", Item 7 of the Procedure of insurance payments for obligatory national social insurance from labor accident and the occupational disease which entailed disability of the Cabinet of Ministers of Ukraine approved by the resolution of December 30, 2022 No. 1467, Items 9, 10 Regulations On the pension fund of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 23, 2014 No. 280, Board of the Pension fund of Ukraine DECIDES:

1. Approve the Procedure for appointment, transfer and implementation of insurance payments for obligatory national social insurance from labor accident and occupational disease which entailed disability which is applied.

2. Recognize invalid resolutions of Board of Social Insurance Fund of Ukraine:

of July 19, 2018 No. 11 "About approval of the Procedure for appointment, transfer and carrying out insurance payments";

of December 12, 2018 No. 27 "About approval of the Procedure for provision of insurance payments, financings of the expenses on the medical and public assistance provided by obligatory national social insurance from labor accident and occupational disease for internally displaced persons";

of February 25, 2021 No. 7 "About modification of procedure for appointment, transfer and carrying out insurance payments".

3. To department of provision of pensions, insurance payments, social services, housing subsidies and privileges () submit to Okhrimenko A. this resolution on state registration to the Ministry of Justice of Ukraine.

4. This resolution becomes effective from the date of its official publication.

Procedure for appointment, transfer and implementation of insurance payments for obligatory national social insurance from labor accident and the occupational disease which entailed disability

I. General provisions

1. This Procedure determines the mechanism of appointment, transfer and implementation of such insurance payments for obligatory national social insurance from labor accident and the occupational disease which entailed disability:

temporary disability benefit owing to labor accident or occupational disease;

monthly insurance payment of the lost salary (or its corresponding part);

insurance payment to the victim during its employment rehabilitation;

insurance payment in case of temporary transfer of the victim on easier, low-paid job;

lump-sum allowance to the victim;

insurance payments in case of the death of the victim;

insurance payment to the child who was born with disability owing to injuring on production or occupational disease of his mother during pregnancy;

insurance social security expenses, other indemnity expenses which include:

compensation for expenses on the drive of the victim who became the face with disability to the place of treatment and/or rehabilitation and in the opposite direction and expenses on journey and housing of person accompanying the victim to the place of treatment and/or rehabilitation (if to the victim the need for maintenance is determined);

expense recovery for rendering social service in home care;

monthly monetary compensation of cost of the measures necessary for rendering social service of the natural help;

expense recovery for burial of the victim and the funeral services connected with it.

2. In this Procedure terms are used in the values given in the Law of Ukraine "About obligatory national social insurance" (further - the Law), the Law of Ukraine "About collection and accounting of single fee on obligatory national social insurance".

3. If person at the same time has the right to appointment and payment of the disposable monetary assistance for harm of the life and to health provided by the Law of Ukraine "About the disposable monetary assistance for the harm of life and to health caused to workers of objects of critical infrastructure, government employees, officials of local self-government owing to military aggression of the Russian Federation against Ukraine" and the one-time help, one-time insurance payment according to the law, payment of sums of money is performed exclusively according to the procedure and the sizes determined by the Law of Ukraine "About the one-time monetary assistance for the harm of life and to health caused to workers of objects of critical infrastructure, government employees, officials of local self-government owing to military aggression of the Russian Federation against Ukraine".
