About approval of Rules of accreditation of space activities

According to article 2 of the Federal law "About Accreditation in National Accreditation System" and article 5 of the Law of the Russian Federation "About space activities" the Government of the Russian Federation decides:

1. Approve the enclosed Rules of accreditation of space activities.

2. This resolution becomes effective since September 1, 2024 and is effective till September 1, 2030.

Rules of accreditation of space activities

I. General provisions

1. These rules:

a) govern the relations arising between participants of works on accreditation in the field of space activities and other persons in communication:

with implementation of accreditation of the certification bodies performing assessment works of compliance of the space equipment including space objects, objects of space infrastructure, scientific and social and economic appointment, the space equipment of dual purpose created within the Federal space program, other federal programs in the field of space activities (further - the space equipment), according to Rules of assessment of conformity of the space equipment, including space objects, objects of space infrastructure, scientific and social and economic appointment, the space equipment of dual purpose created within the Federal space program, other federal programs in the field of space activities, processes connected with development, creation, use (operation) of the specified space technology, works (services) in the field of space activities approved by the order of the Government of the Russian Federation of November 28, 2023 No. 2005 "About approval of Rules of assessment of conformity of the space equipment, including space objects, objects of space infrastructure, scientific and social and economic appointment, the space equipment of dual purpose created within the Federal space program, other federal programs in the field of space activities, processes connected with development, creation, use (operation) of the specified space technology, works (services) in the field of space activities" (further - Rules of assessment of conformity of the space equipment), regarding compliance to the established mandatory requirements;

with implementation of accreditation of test laboratories (centers) performing works on carrying out testing and measurements of the space equipment which is subject to obligatory certification (further - testing), according to Rules of assessment of conformity of the space equipment which results are applied to the purposes of assessment of conformity of the space equipment;

with certification of experts in accreditation, selection of the technical experts involved to performance of works on accreditation of applicants (accredited persons) according to these rules;

b) determine participants of works on accreditation and their function;

c) establish procedure for forming, maintaining and storage of accreditation cases and certification cases.

2. Accreditation of certification bodies and test laboratories (centers), certification of experts in accreditation is performed by the State corporation on space activities Roskosmos according to these rules and accreditation criterions.

3. In these rules the following concepts are used:

"accreditation" - the confirmation of conformity of the applicant, accredited person to accreditation criterions which is the official certificate of his competence to perform activities in certain area of accreditation;

"accredited person" - the legal entity irrespective of form of business accredited as certification body or test laboratory (center) according to these rules;

"certification of the expert in accreditation" - confirmation of conformity of the physical person applying for receipt of the status of the expert in accreditation, the requirements established by these rules and recognition of his competence when evaluating compliance of the applicant (accredited person) to accreditation criterions of certain area of accreditation;

"exit assessment" - set of the events for assessment of conformity of the applicant (accredited person) to accreditation criterions held by commission of experts of accreditation body on site (places) of implementation of activities in certain area of accreditation;

"the statement from the register of accredited bodies (the certificate of accreditation)" - the document created by accreditation body in electronic form on the basis of the data containing in the register of accredited bodies on certification and test laboratories (centers) in the field of space activities (further - the register of accredited bodies), and certifying accreditation in certain area of accreditation at the time of its forming;

"documentary examination" - set of the events held by commission of experts of accreditation body including examination by the submitted applicant (accredited person) of documents and data, confirming the applicant's compliance (accredited person) to accreditation criterions;

"applicant" - the Russian legal entity irrespective of form of business applying for accreditation as certification body or test laboratory (center);

"the manufacturer of the space equipment" - the organization performing production of the space equipment;

"test laboratory (center)" - the Russian legal entity (structural division of this legal entity) accredited according to these rules, included in the register of accredited bodies and who is carrying out based on the agreement signed with certification body of work on carrying out testing which results are applied to the purposes of assessment of conformity of the space equipment in the form of obligatory certification;

"the adjusting measures" - the actions undertaken by the applicant (accredited person) in connection with elimination of discrepancy to accreditation criterions including the reasons and conditions of such discrepancy;

"accreditation criterions" - set of requirements to which the applicant (accredited person) when implementing activities in certain area of accreditation shall satisfy, in compliance with accreditation criterions of the certification bodies performing assessment works of compliance of the space equipment, and test laboratories (centers) performing carrying out testing and measurements of the specified space equipment according to appendix No. 1;

"monitoring" - process of observation of accredited persons regarding their compliance or discrepancy to accreditation criterions, and also behind activities of experts in accreditation and technical experts;

"discrepancy" - failure to meet requirements, shown to the applicant (accredited person), and is equal failure to carry out by the applicant or expert in accreditation of the established requirements;

"area of accreditation" - field of activity of the applicant (accredited person) for which implementation the application is submitted and (or) which is determined by accreditation body;

"area of certification" - field of activity of the expert in accreditation concerning which his competence is confirmed with accreditation body;

"accreditation body" - the State corporation on space activities Roskosmos performing accreditation according to these rules;

"certification body" - the Russian legal entity (structural division of this legal entity) accredited according to these rules, included in the register of accredited bodies and performing assessment works of compliance of the space equipment in the form of obligatory certification;

"assessment of conformity" - positive or indirect confirmation that the applicant (accredited person) conforms to requirements imposed to it according to these rules;

"applicant" - the physical person applying for receipt of the status of the expert in accreditation in the field of space activities;

"developer of the space equipment" - the organization performing development of the space equipment;

"the technical expert" - the physical person having special knowledge according to specialization of the technical expert and included in the register of the technical experts involved to performance of works on accreditation of certification bodies and test laboratories (centers) in the field of space activities (further - the register of technical experts);

"the accreditation expert" - the physical person which is certified by accreditation body as the accreditation expert in the declared area of certification according to these rules is included in the register of the certified accreditation experts in the field of space activities (further - the register of experts in accreditation) and is attracted by accreditation body for assessment of conformity of the applicant (accredited person) to accreditation criterions.

4. The concepts "evidentiary materials", "applicant on carrying out certification", "request for carrying out certification", "obligatory certification", "mandatory requirements", "certified testing of the space equipment", "certificate of conformity", "certified case" and "technical documentation" used in these rules are applied in the values used in Rules of assessment of conformity of the space equipment.

II. Participants of works on accreditation and their function

5. Participants of works on accreditation according to these rules are:

a) accreditation body which part the commission on appeals and certifying commission are;

b) applicants and accredited persons;

c) applicants, accreditation experts, technical experts.

6. The accreditation body according to these rules performs the following functions:

a) registers statements for accreditation, for expansion or reducing area of accreditation, for issue of the statement from the register of accredited bodies, about early termination of accreditation, about certifications of the expert in accreditation, other statements and reports of the applicant (accredited person), the applicant, the accreditation expert and the documents attached to them according to these rules;

b) checks completeness and completeness of the documents necessary for evaluating compliance of the applicant (accredited person) provided by the applicant (accredited person), the applicant or the expert in accreditation of statements and attached to them in the field of the accreditation specified in the statement for accreditation or the register of accredited bodies, applicants or accreditation experts in the field of the certification specified in the statement for certification or in the register of experts in accreditation and also fulfillment of requirements to execution of the specified documents;

c) in the cases established by these rules:

sends to applicants (accredited persons), applicants and experts in accreditation of the notification, provided by these rules;

considers reports of applicants (accredited persons) on elimination of discrepancies to accreditation criterions and the documents confirming their elimination for the purpose of decision making about accreditation or about refusal in accreditation;

d) will organize and carries out according to these rules:

documentary examination and exit assessment;

confirmation of competence of accredited person;

certification of applicants and confirmation of competence of experts in accreditation;

monitoring of activities of accredited persons, accreditation experts and technical experts;

e) performs the analysis of the statements specified in the subitem "b" of this Item;

e) makes decisions:

about accreditation or about refusal in accreditation;

about conducting documentary examination;

about carrying out exit assessment;

about modification of the information about accredited person containing in the register of accredited bodies;

about accreditation action confirmation;

about suspension (renewal) of action of accreditation;

about expansion (reducing) of area of accreditation;

about refusal in expansion of area of accreditation;

about accreditation cancellation;

about carrying out planned (unplanned) confirmation of competence of accredited person;

about carrying out exit assessment of effectiveness taken and the adjusting measures implemented by accredited person;

about certification (about refusal in certification) the applicant as the accreditation expert;

about confirmation of action of certification of the expert in accreditation;

about modification of the register of experts in accreditation;

about cancellation of certification of the expert in accreditation;

about evaluating knowledge (confirmation of knowledge) of the expert in certification;

about inclusion (exception) of technical experts in the register of technical experts;

g) claims:

methodical recommendations about forming of commission of experts for performance of works about accreditation, confirmation of competence of accredited person;

structures of the commissions of experts provided by these rules for performance of works on accreditation of the applicant, confirmation of competence of accredited persons;

h) will organize and provides:

work of the commissions of experts provided by these rules for performance of works on accreditation of the applicant, confirmation of competence of accredited persons on compliance to accreditation criterions in the field of the accreditation specified in the statement for accreditation or the register of accredited bodies;

consideration of appeals by the appeal commission;

i) creates and claims:

structures of the appeal commission and certifying commission are also provided by their activities;

annual plan of carrying out confirmation of competence of accredited persons;

j) creates and conducts:

register of accredited bodies;

register of experts in accreditation;

register of technical experts;

k) performs provision of the data containing in the registers specified in the subitem "k" of this Item;

l) performs during the procedures of accreditation assessment of knowledge (confirmation of knowledge) of experts in certification, including by means of audio and video conferencing;

m) issues statements from the register of accredited bodies;

o) posts on the official site on the Internet (the Section of the official site of the State corporation on space activities Roskosmos) (further - Internet network):

the list of the regulatory legal acts of the Russian Federation regulating the procedure of accreditation in the field of space activities and establishing accreditation criterions of certification bodies and test laboratories (centers);

the list of the documents confirming compliance of certification bodies and test laboratories (centers) to accreditation criterions;

forms of statements for accreditation, of expansion of area of accreditation, of issue of the statement from the register of accredited bodies, about modification of the information about accredited person containing in the register of accredited bodies about carrying out confirmation of competence, about reducing area of accreditation, about early termination of action of accreditation, about certification of the expert in accreditation, about confirmation of competence of the expert in accreditation, about modification of the information about the expert in accreditation containing in the register of experts in accreditation about early termination of action of certification of the expert in accreditation;

forms of submission of data on the declared area of accreditation for certification body and test laboratory (center);

annual plan of carrying out confirmation of competence of accredited persons;

the documents regulating activities of the appeal commission and certifying commission;

structures of the appeal commission and certifying commission;

data from the register of accredited bodies, from the register of experts in accreditation, from the register of technical experts and the rule of provision of the data containing in the specified registers;

o) requests the data confirming the fact of entering of information about the applicant into the Unified State Register of Legal Entities in the federal executive body performing state registration of legal entities and individual entrepreneurs, and also the data confirming the fact of statement of the applicant on accounting in tax authority - in the federal executive body performing functions on control and supervision of compliance with law of the Russian Federation about taxes and fees based on interdepartmental requests with use of single system of interdepartmental electronic interaction (if the documents confirming such data are not provided by the applicant as a part of the documents enclosed to the application for accreditation);

p) performs interaction:

with federal executive bodies, the state corporations, national authority on accreditation, the accreditation body authorized according to the order of the Government of the Russian Federation of February 4, 2023 No. 245-r to perform functions on accreditation of certification bodies and test laboratories (centers) performing assessment works (confirmation) of compliance concerning the defense products (works, services) delivered according to the state defense order - concerning information exchange about cases of discrepancy of accredited persons to accreditation criterions, and also for the purpose of enhancement of activities of accreditation body within the powers established by these rules;

with the international organizations on accreditation - concerning enhancement of rules and procedures of accreditation of applicants (accredited persons), certification of experts in accreditation and confirmation of their competence in the field of the relations regulated by these rules;

c) provides protection and nondisclosure of data, components the state, commercial, protected by the law other secret, other data, access to which is limited by the Federal Laws, and the data received by accreditation body in case of accomplishment of the functions determined by these rules, except as specified, established by the legislation of the Russian Federation;

r) performs forming, maintaining and storage of accreditation cases in the relation of each applicant (accredited person), and also certification cases in the relation of each applicant and the certified accreditation expert;

s) performs other functions according to the Federal Laws, decisions of the President of the Russian Federation and the Government of the Russian Federation.

7. Selection of experts in accreditation and technical experts is performed according to the methodical recommendations about forming of commission of experts for performance of works about accreditation, confirmation of competence of accredited person approved by accreditation body.

8. Accreditation experts shall conform to qualification requirements, stipulated in Item 193 these rules, and also observe the restrictions set by these rules.

9. The technical expert shall conform to the following qualification requirements:

a) have the higher education according to programs of bachelor degree, programs of specialist programme, programs of magistracy and (or) programs of training of research and educational personnel in postgraduate study on specialties and the directions of preparation of the higher education "Mathematical and natural sciences" and "Engineering, technologies and technical science" and (or) additional professional education in the specialty and (or) to the direction of preparation on the profile corresponding to the declared area of specialization of the technical expert according to the list of areas of specialization of the technical experts involved to performance of works on accreditation of certification bodies and test laboratories (centers) according to appendix No. 2 (further - the list of areas of specialization of technical experts);

b) have length of service at least 3 years in the organizations performing development, creation, testing and (or) use (operation) of the space equipment;

c) have knowledge of the legislation of the Russian Federation in the field of development, creation, testing, use (operation) of the space equipment, in the field of assessment of conformity of the space equipment, documents on standardization in the respective area;

d) be independent of any commercial, financial or other kind of pressure which could break impartiality and exert impact on performance of works on accreditation;

e) have the admission to the data which are the state secret, in accordance with the legislation of the Russian Federation about the state secret (if performance of works on accreditation is connected with use of the data which are the state secret).

10. The technical expert involved by accreditation body to performance of works, test laboratories (centers), necessary for accreditation, in addition to the requirements specified in Item 9 of these rules shall conform to the following requirements:

a) have knowledge of methods and techniques of testing of the space equipment according to area of specialization of the technical expert confirmed with work experience in test laboratories (centers) and (or) test divisions of developers of the space equipment or manufacturers of the space equipment;

b) have knowledge of characteristics, rules of certification and operation of the test equipment used to carrying out testing in test laboratory (center), according to area of specialization of the technical expert, confirmed with work experience in test laboratories (centers) and (or) test divisions of developers of the space equipment or manufacturers of the space equipment;

c) have knowledge of requirements to the measuring instruments, standard samples and measurement techniques, metrological rules and regulations applied by test laboratory (center) to carrying out testing, according to area of specialization of the technical expert, confirmed with work experience in test laboratories (centers) and (or) test divisions of developers of the space equipment or manufacturers of the space equipment.

11. The accreditation expert carries out according to these rules works on accreditation of the applicant (confirmation of conformity of accredited person) in the area of certification determined by accreditation body according to the list of areas of certification of experts in accreditation according to appendix No. 3 (further - the list of areas of certification of experts in accreditation).

12. The technical experts included in the register of technical experts for consultation of members of commission of experts are involved in works on accreditation in case special knowledge is necessary for accreditation criterions for assessment of conformity of the applicant (accredited person).

13. Technical experts have no right to perform functions of members of commission of experts.

14. In case of selection of the technical expert for performance of works in accreditation of applicants (accredited persons) its specialization and experience of activities in the field of the accreditation specified in the statement for accreditation or in the register of accredited bodies is considered.

15. The accreditation expert and the technical expert in day of receipt of information on passing of selection or the offer on inclusion in structure of commission of experts shall notify accreditation body on the compliance to requirements and observe the restrictions set by these rules.
