1. Approve the Instruction on the organization of anti-terrorist protection of settlement and cash departments of banks of the second level, vulnerable in the terrorist relation, according to appendix to this resolution.

2. To provide to department of bank regulation in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.

3. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.

4. This resolution becomes effective after ten calendar days after day of its first official publication.

The instruction on the organization of anti-terrorist protection of settlement and cash departments of banks of the second level, vulnerable in the terrorist relation

Chapter 1. General provisions

1. This Instruction on the organization of anti-terrorist protection of settlement and cash departments of banks of the second level, vulnerable in the terrorist relation, (further – the Instruction) is developed according to Item 1 of article 10-2 of the Law of the Republic of Kazakhstan "About counteraction to terrorism".

2. The instruction disaggregates requirements to the organization of anti-terrorist protection of settlement and cash departments of banks of the second level (further – rasschetno-cash departments), vulnerable in the terrorist relation, approved by the order of the Government of the Republic of Kazakhstan of May 6, 2021 No. 305 "About approval of requirements to the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation" and establishes actions for ensuring anti-terrorist security of settlement and cash departments, obligatory for accomplishment, vulnerable in the terrorist relation.

3. The instruction according to the order of the Government of the Republic of Kazakhstan of April 12, 2021 No. 234 "About approval of Rules and criteria of reference of objects to vulnerable in the terrorist relation" extends to the settlement and cash departments expected simultaneous stay with a (capacity) of 200 (two hundred) and more people.

4. The instruction is held for use the heads, owners, owners of settlement and cash departments and employees providing holding actions for anti-terrorist security of settlement and cash departments, the staff of law-enforcement bodies of the Republic of Kazakhstan, bodies of homeland security of the Republic of Kazakhstan, members of the anti-terrorist commissions in case of control, estimates of anti-terrorist protection of rasschetno-cash departments and also studying of condition of anti-terrorist security of settlement and cash departments.

5. In the Instruction the concepts provided by the Law of the Republic of Kazakhstan "About counteraction to terrorism", the Rules of functioning of National system of video monitoring approved by the order of the Chairman of Committee of homeland security of the Republic of Kazakhstan of October 27, 2020 No. to 69-ka registered in the Register of state registration of regulatory legal acts at No. 21693, (further – Rules of functioning of National system of video monitoring), by Requirements to the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation, approved by the order of the Government of the Republic of Kazakhstan of May 6, 2021 No. 305, and also the following concepts are used:

1) settlement and cash departments – specially equipped premises of banks of the second level intended for carrying out cash transactions and transactions on collection of banknotes, coins and values;

2) the private security organization – the commercial organization rendering security services as business activity;

3) the subject of security activities – specialized security divisions of law-enforcement bodies of the Republic of Kazakhstan and the private security organizations;

4) assessment of anti-terrorist protection of settlement and cash department – the action directed to estimation of access control, readiness of settlement and cash department and also the subjects performing security activities on them to hindrance to making of the act of terrorism, ensuring minimization and mitigation of consequences;

5) perimeter of settlement and cash department – border of settlement and cash department according to documents of title;

6) evacuation in case of threat of the act of terrorism (further – evacuation) – organized movement of personnel, visitors of settlement and cash department to safe places (rooms, sites of the area);

7) the passport of anti-terrorist security (further – the passport) – the directory document containing the general and technical information about settlement and cash department reflecting condition of its anti-terrorist security, and intended for planning of actions for the prevention, suppression, minimization and (or) mitigation of consequences of acts of terrorism in settlement and cash department, vulnerable in the terrorist relation.
