About measures for enhancement of regulation of the organization and carrying out the lotteries and games based on risk

At the same time the existing prohibitions on the organization of activities of national providers for holding the online games based on risk and lack of legal regulation in this direction, sustained interest of citizens to this sphere become the reason of their active use of foreign and illegal services.

Such situation is caused by lack of mechanisms of barrier from participation in games of citizens at which excessive dependence on games is noted that leads to fraud risks concerning participants of games and to infringement of their rights, foreign exchange outflow from the country.

For the purpose of implementation of the best foreign practices and modern technologies in the field of regulation of activities for the organization of the lotteries and games based on risk:

1. Approve offers of the Cabinet of Ministers, the National agency of perspective projects (further - the Agency), the Ministry of Economics and finance:

about permission since January 1, 2025 in the Republic of Uzbekistan of implementation of activities for the organization of the games based on risk on the worldwide information network the Internet (further - games on the Internet) and bookmaker activities;

about implementation of activities for the organization of lotteries, games on the Internet and bookmaker activities based on the licenses granted by the Agency according to the legislation.

2. Determine that:

The agency is authorized body on regulation and licensing of activities for the organization of lotteries and games on the Internet, bookmaker activities (further - the licensing body);

The agency establishes procedure for licensing of activities for the organization of lotteries and games on the Internet, bookmaker activities;

state bodies and the organizations, public authorities on places, and also charity foundations and the organizations have the right to carry out lotteries only through organizers of lotteries, on contractual basis;

the residents and nonresidents of the Republic of Uzbekistan who reached 18 years can take part in lotteries, games on the Internet and bookmaker bets organized based on licenses only;

The agency and Department on fight against economic crimes under the Prosecutor General's Office perform functions of monitoring and control of observance by organizers of lotteries, games on the Internet and bookmaker activities of acts of the legislation on counteraction of legalization of income gained from criminal activities, to financing of terrorism and financing of distribution of weapons of mass destruction.

3. Agree with the offer of the Agency and Ministry of Economics and finance on determination since January 1, 2025 for the term of 5 years of procedure for the taxation of activities for the organization of lotteries, games on the Internet, bookmaker activities providing the following:

the legal entities performing activities for the organization of lotteries, games in the Internet or bookmaker activities are taxpayers from the turnover at the rate 4 percent levied from comprehensive income from activities for the organization of lotteries, games on the Internet or bookmaker activities less all paid prizes and the returned rates;

income of physical persons gained from prizes in lotteries, games on the Internet, the bookmaker bets which are carried out based on the licenses granted by the Agency is exempted from the tax discharge on the income of physical persons.

4. To the agency taking into account requirements of this Decree together with the interested ministries and departments to enter to the Cabinet of Ministers:

a) in two-month time the draft of the government decision providing:

procedure for the organization of lotteries, games on the Internet, bookmaker activities, including licensed requirements and conditions;
