About hydrometeorological activities

This Law determines the general legal, economic, social and organizational principles of implementation of hydrometeorological activities in Ukraine, legal status of national hydrometeorological service and its workers.

Section I. General provisions

Article 1. Terms and determinations

In this Law terms are used in the following value:

hydrometeorological activities - the activities of national hydrometeorological service, other legal entities irrespective of patterns of ownership and physical persons directed to implementation of observations of hydroweather conditions, geophysical processes in the atmosphere, the analysis and generalization of the obtained data, active impacts on hydrometeorological processes, providing with hydrometeorological information, forecasts and warnings of the dangerous and spontaneous hydrometeorological phenomena of public authorities, local government bodies, population, and also hydrometeorological servicing of the interested legal entities and physical persons;

national hydrometeorological service - system of the state bodies, companies, organizations and organizations providing accomplishment of complex of works on carrying out observations, to collection, processing, transfer, storage and use of data in the field of hydrometeorology, climatology, atmosphere geophysics, and also basic observations of pollution of the surrounding environment and provision of the relevant information;

the state system of hydrometeorological observations - the complex multi-level observation information system intended for carrying out systematic observations of hydroweather conditions, condition of the atmosphere, pollution of the surrounding environment under the influence of natural and anthropogenous factors and providing consumers with information on their actual and expected condition;

hydrometeorological observations - tool measurements and visual assessment of hydroweather conditions and condition of the atmosphere;

specialized hydrometeorological observations - hydrometeorological and other observations which are made for needs of certain consumers;

hydrometeorological information - data set about actual state and the expected changes of the hydroweather conditions received as a result of the observations processed and analyzed by the established techniques and brought on paper or technical data carriers;

the actual hydrometeorological information - the hydrometeorological information obtained according to actual data of hydrometeorological observations in specific time;

hydrometeorological information of general use - data set about the actual and expected hydroweather conditions and condition of the surrounding environment received as a result of standard observations and processed by the established techniques, the public authorities intended for hydrometeorological providing, local government bodies and the populations;

urgent hydrometeorological information - data set about the dangerous and spontaneous hydrometeorological phenomena and extremely high levels of pollution of the surrounding environment which are subject to immediate bringing to data of relevant organs and the population for acceptance of necessary measures for the prevention or liquidation of negative effects;

specialized hydrometeorological information - data set about the actual and expected hydroweather conditions and state of pollution of the surrounding environment received as a result of the standard and additional observations used for paid hydrometeorological servicing of the interested legal entities and physical persons in the amounts and forms satisfying their requirements;

the hydrometeorological forecast - scientifically and methodically reasonable anticipation of hydroweather conditions or values of separate elements of weather, hydrological mode;

materials of hydrometeorological observations - the results of tool and visual hydrometeorological observations, basic observations of pollution of the surrounding environment processed and analyzed by the established techniques and brought on paper or technical data carriers;

hydrometeorological providing - the activities of bodies of national hydrometeorological service directed to obligatory and systematic finishing hydrometeorological information public and also urgent hydrometeorological information to data of public authorities, local government bodies and the population;

hydrometeorological servicing - provision to users for a fee on a contract basis hydrometeorological and other information.

Article 2. The legislation of Ukraine in the field of hydrometeorological activities

The relations in the field of hydrometeorological activities are governed by this Law, other regulatory legal acts adopted according to it, and also international treaties which consent to be bound is this the Verkhovna Rada of Ukraine.

Article 3. The basic principles of state policy in the field of hydrometeorological activities

The basic principles of state policy in the field of hydrometeorological activities are:

state regulation and control in the field of hydrometeorological activities;

combination of the state and public concerns in receipt and use of information on actual state and the expected changes of hydroweather conditions and conditions of the surrounding environment;

systemacity, complexity, continuity and representativeness of hydrometeorological observations and forecasting;

observance of requirements, standard rates and rules of metrology, use of gages, devices, the equipment, safe for health and life of employees of hydrometeorological service, the population and the surrounding environment;

precautionary and immediate nature of hydrometeorological providing and servicing concerning the dangerous and spontaneous hydrometeorological phenomena;

priority of requirements of ecological safety;

free of charge hydrometeorological providing public authorities, local government bodies and population information public and paid nature of hydrometeorological servicing, rendering hydrometeorological services to legal entities and physical persons;

implementation of hydrometeorological activities on the basis of the principles of international cooperation and priority of rules of international law.

Article 4. Directions of hydrometeorological activities

The main directions of hydrometeorological activities is carrying out observations of hydroweather conditions, geophysical processes in the atmosphere and basic observations of the level of pollution of the surrounding environment;

collection, processing, transfer and data storage of observations;

development of hydrometeorological forecasts, hydrometeorological providing public authorities, local government bodies and population;

hydrometeorological servicing and rendering hydrometeorological services to the interested legal entities and physical persons;

implementation of active impacts on hydrometeorological processes.

Article 5. Subjects of the relations in the field of hydrometeorological activities
